It's Guest Post Monday! The Mayor?

I have to apologize for not putting these 2 submissions to bendbubble2@gmail.com up sooner. I am just lame. Anyway, 2 guest posts, 1 from the Mayor, and 1 from an RE dude. First, his highness:

To whom it may concern ... (is this you Bruce?) I was looking at your blog and came across an amazing bit of text. A quote attributed to me that is not only inaccurate, but I never said it.

January 3, 2008 you wrote "Green is not alone as a second-home owner in Deschutes County. These days, two of every three dwellings in Bend, Oregon is a second home, according to Bend, Oregon Mayor Bruce Abernethy, himself a real estate broker."

What??? First of all, I would never say two out of three homes are second homes because it isn't true. Secondly, I am not and never have been a real estate broker. Where do you make this stuff up? I suppose I should give you some credit because you did get the part about me being mayor right.

General State of the Economy

I am a Real Estate Appraiser. I have worked as a Realtor, Loan Officer and Real Estate Appraiser here in Central Oregon since 1995. While I agree with the majority of your opinions regarding our local real estate industry, I wholeheartedly agree with your comments regarding the "bailout".

Bailout-
I think the term "pissing in the ocean" applies here. There is a reason the administration rushed this legislation through congress. The bailout is the biggest hoax on the American people since Reagan's deregulation. It would have been better to let these financial institutions fail, because the free market has shown that something better and stronger will take it's place. Think of these mortgages as a game of musical chairs... taxpayers are once again out of the game without a chair, but holding all the debt. As you've seen from the stock market the last few days... those in the know are not buying into the bailout as a saviour.

Family Wage Jobs-
The Central Oregon area has some special challenges that occur in other areas of the country (Aspen, Durango, Lake Tahoe come to mind). Unfortunately, we have a number of groups which have formed political alliances to maintain the status quo. The number one priority of our local government should be in obtaining family wage jobs. The status quo group of Realtors, Politicos, Developers and the Bend Bulletin believe that we should be building additional resorts. While tourism brings needed dollars and businesses to our area, the minimum wage jobs these industries spawn does nothing to raise the standard of living for the majority of Central Oregonians. The developing of our land, for resort use, benefits those at the top of our economic food chain with very little dribble down to the majority of Central Oregonians. The time, effort and money wasted by our local government spent in kowtowing to this cartel would be much better spent in wooing businesses to the area with tax breaks and/or other benefits.

The Local Housing Market-
I told my clients at the beginning of this year, that I believed our local housing market was going to get worse. The bad news is that we have not hit bottom yet. This makes the March 2008 prediction of recovery by Dana Bratton, one of our local appraisers, look that much more ridiculous. Home pricing will continue to spiral downward as credit tightens - it's a horrible snowball that is still gaining strength as it rolls down the hill. Check out Kevin Phillips book - Bad money : reckless finance, failed politics, and the global crisis of American capitalism. This gives a glimpse of how short sighted politicians have allowed greed to ruin our economy. Locally, foreclosures are increasing and driving the median home pricing down. This will continue to snowball as local businesses begin to fail and thereby force more pressure on homeowners already struggling to pay their monthly mortgage. This financial pressure has tragically manifested itself through a number of suicides and a rise in divorce filings. The financial strain of our declining real estate market takes a very real toll on the personal lives of all Central Oregonians.

Folks - it's going to get a bit worse before it gets better. There may be a very real up-tick in consumer confidence after the Presidential election. Look for positive signs in the economy after the first of the year. However, if this economic snowball continues, it could turn into an avalanche and take most of the world with it. Most economic experts are predicting a few years of stagflation. The only fix is to pry open the credit markets. This 700 billion dollars would have been much better spent establishing a direct government mortgage system. If consumers know they can once again have access to credit, then home pricing will stabilize and people will start spending again.

Of course, Central Oregon is still a great place to live and work. I am heartened by the citizens of Bend who care deeply about this place. I moved here for the lifestyle and I have not been disappointed, those who moved here to "get rich" in the housing industry can't help but be disappointed.

U.S. military boffins are looking into pheromone-based weapons as an alternative to more conventional and somewhat brutal, yet ineffective, means of making the enemy run away from the battlefield or surrender.

Pheromones are nothing new as far as defense and security agencies go. The Stasi, or Staatssicherheit, East Germany's notorious secret police, used them to track democracy-loving misbehavers during the Cold War with great effect. They used insects to track the movement of suspicious persons throughout East Berlin, especially in its crowded mass transit system. Smell you at checkpoint Charlie, we guess.

U.S. scientists are apparently working on developing synthesized fear inducing pheromones, which could eventually make the enemy, well, fear them. It does seem a bit odd that the U.S. Armed Forces, of all people, are working on such a project. Honestly, if you don't fear them as it is, you don't need pheromones, you need professional help, and lots of it.

Maybe this in itself is the answer to why the they might be developing such substances. How do you strike fear into the hearts of persons who simply don't give a damn if they live or die? With pheromones, of course, paid for by the oblivious taxpayer. Sounds like an interesting weapon for game developers, too; fear grenades, anyone ?

Another application for the same technology would be the use of "fear sensors" which could detect elevated fear pheromone levels in subjects.

So, as FDR would put it ,there is nothing to fear but fear itself. Literally.

Suterra,makers of CheckMate calls their product a "biochemical".

Suterra lawyers issued at least 5 Cease and Desist order to silence people and newspapers from disclosing what is in the spray.

The Santa Cruz Sentinel September 28, 2007, printed edition, listed the ingredients and then was threatened by Suterra lawyer's to remove the on-line list. The list included "Tricaprylyl methyl ammonium chloride" and "polymethylene polyphenyl isocyanate." (bad stuff) However the list can still be found in places.

Helene Wright, USDA, APHIS, (the Feds), issued threats on 10/16/07 at the Santa Cruz County Board of Supervisors Meeting to quarantine ALL of California, and take over biochemical spray operation if the State of California can not handle it. She also promised that if the Feds have to come in and take over the spraying will be worse for the people.

When they spray we the people are told not to go outside after 8pm and stay indoors until 5am. After the spray, when we go outside we are told to wash down everything!

OH but they say it is safe and to trust them.

The maker of controversial pesticides state agricultural officials want to spray over parts of Santa Cruz and Monterey counties has made a second attempt to seal court documents detailing the ingredients of its products.

Late Wednesday, Suterra LLC, creator of the CheckMate pesticide used to steer the crop-eating light brown apple moth off course, filed a second motion asking Monterey County Judge Robert A. O'Farrell to close records because trade secrets are at stake. O'Farrell did not issue an immediate ruling Thursday.

O'Farrell ruled Tuesday on Suterra's first attempt to seal the records, saying he did not have authority to cut off public access to documents because Suterra was not a party to the ongoing lawsuit seeking to stop the spraying in Monterey County. The Carmel-based Helping Our Peninsula's Environment, or HOPE, is seeking to ban the spraying, saying that nearly 100 Monterey County residents reported respiratory problems after spraying began last month.

However, at the end of his order Tuesday, O'Farrell invited Suterra to provide proof that it had a stake in the lawsuit. The full text of Suterra's latest motion was not immediately available Thursday, but a portion of it obtained by the Sentinel simply claims state law does not preclude third parties from making arguments.

An attorney for Suterra did not immediately return a message seeking comment late Thursday.

In response to Suterra's second bid for secrecy, the Santa Cruz Sentinel and Monterey County Weekly filed a motion Thursday to block the request, saying the public has the right to know the safety of the chemicals in the spray. Santa Cruz County officials have not sought a ban on the state's plans to spray here starting early next month.

In a pleading for the newspapers, attorneys said Suterra can't prove that cloaking the court's discourse about its product would expose trade secrets. Suterra sought the seal after Judge O'Farrell named an ingredient -- polymethylene polyphenyl isocyanate, or PPI -- in a court order granting HOPE a temporary ban on the spraying.

The Sentinel first published details about PPI late last month after the Environmental Protection Agency reported the chemical was part of the CheckMate compound -- information the agency later said was inaccurate. The Monterey County Weekly had published the name of the ingredient.

"The press did what the press is supposed to do: It asked the government for the ingredients in CheckMate in order to inform the public as to whether there are any health risks associated with the aerial spraying," James Chadwick, a San Francisco lawyer representing the Sentinel, wrote in the newspapers' motion.

Suterra also sought a temporary restraining order in Los Angeles Superior Court to keep the newspapers from publishing information about CheckMate's ingredients, again arguing that trade secrets were violated. A Los Angeles judge denied the request Tuesday.

1.) Chemically poison and sterialize liberals around the bay-area, in cali.

2.) Get paid US government contracts to accomplish #1.

Schwab was dear to heart of old Bend, his name meant 'magic & money'.

Lonsdale ( Bend Sci mother of Suterra ) is an old liberal tycoon of Bend, his company brings tears to the eyes of Bend's minority liberal elite.

You put Lonsdale & Schwab on the same ticket in Bend, you could pass anything, no matter how fucking evil and sick.

In October 2000 Cryptome learned of an apparent CIA function located at Bend, Oregon, by browsing the Gov Whois, which listed it under the domain of ISTAC.gov (search on the word "cia"; a once-listed address in Bend has been removed). The first treatment of a biochemical "pesticide" known as Checkmate, was completed on the
anniversary of the tragic 9/11 attack.
In order to initiate the aerial spray, which occurred on 9/09/07over populated area’s of Monterey County, the US
EPA initiated an emergency exemption under section 18 of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA) for the light brown apple moth (LBAM). The reason: the "USDA estimates the impact on plant
production costs may exceed $100 million in the state of California."

What has dumbfounded people is the feeling that they are being personally attacked by the aerial spraying of
Checkmate. Protestors hold up signs that say, “We are not moths.” They say this, because the aerial applications
are scheduled to take place over their homes. People will be in contact with the supposed moth pheromone for

30 days at a time, while the pheromone is time released into the air.
These all seem like drastic, and unnecessary measures, for a moth for which there is no evidence of damage.
Even though twist ties, and sticky traps are effective at limiting the moth, these options seem for some reason to
be unappealing to the California State Department of Food and Agriculture (CDFA). During one session, the
claim by CDFA Secretary A.G. Kawamura, was that the state had to eliminate the moth as fast as possible, and
that the only way to this was the aerial treatments. Yet it does not make any logical sense, because, aerial
treatments are designed to disrupt mating habits, and are designed for long term containment, not short term
elimination. At least one year of spraying planned, continuing in March 2008, for 9 months in a row, every month.
Aerial treatments are planned to continue to as late as 2010, which coincidently is the maximum amount of time
given to use an untested pesticide under the EPA emergency quarantine exemption.
Intent to Destroy
When you look at the attached aerial spraying map. You will see something that is deeply disturbing. The zones
for aerial spraying, do not seem to closely follow the LBAM moth trap finds. In other words, it seems like the
aerial boundaries are arbitrary and capricious.
What is most alarming, is that two grids have been laid out, over the highly populated area’s of Santa Cruz
County and Monterey County consisting of approximately 100,000 people. It looks almost as if these cities are
the targets of the aerial spraying, with the two other spray boundaries in between them, merely added to distract
the eye.
The Checkmate formulations are claimed by the EPA, USDA, and CDFA to be safe. The reason is that, they are
supposed to be Bacillus thuringiensis (B.t.) formulas. Bt’s are naturally-occurring soil bacterium that produces
poisons which cause disease in insects but lack of toxicity to humans or the natural enemies of many crop pests.
One individual who participated in the late 1970’s and early 1980’s in forestry efforts to eliminate another moth
with Bt chemicals, claimed that she got sprayed with the chemicals several times, that she stored the chemicals,
and that moth’s would flock to her when the chemicals were on her clothes; all without any noticeable side
effects.
As you will see, it is impossible to believe that solely a Bt formula is being applied due to the over 200 health
complaints filed from Monterey County Residents after the first aerial application. The real number of health
effects is many times greater than this 200, but a variety of factors, including doctor’s refusal to see patients who
are affected by the chemicals, has limited the reports. Knowingly applying some other substance than the Bt
formula with no side effects, especially a formula which is known to cause harms to humans, would qualify and
intent to destroy.
Serious Bodily Harm & Hiding Facts About Harm
One of the complaints was that an 11 month old baby nearly died from asphyxiation due to contact with
Checkmate. Other severe complaints include: intestinal distress, coughing up blood, severe lethargy, severe
rashes from playing outside, headaches, and female reproductive disorders. Several people went to the
emergency room due to aerial treatments.
The CDFA claims that the Checkmate formulations, along with the micro-flake mating disruption and isomate
pheromone’s are totally safe. Originally on their website, they had an online flyer stating that one should not be
outside during the spray, and not touch anything that had been sprayed. Later they removed these statements
claiming that these precautions are now unnecessary.
The CDFA is also hiding their plans to spray Santa Cruz County beginning 11/4/07 for six nights. They have
removed the treatment map from their website, and they have not sent out the required warnings to citizens yet.
If the CDFA is so confident about the health and safety of their program, then why are they trying to not give
notice to citizens about aerial spraying? It is almost as if the CDFA is pretending like they won’t spray.
Normally, when one files a complaint with the CDFA, regarding a possibly dangerous food, the CDFA may
immediately issue a large recall of the food item, sometimes without any evidence that the food is even
hazardous.
Of the 117 signed health claims submitted to the CDFA, not one has been investigated. No recall of the aerial
treatments have been issued. No doctor’s examinations, no blood chemistry tests, no allergy response tests.

What is the CDFA’s purpose in ignoring health claims in this situation? Is there a secret plan?
It is also known that birds can see and eat the microcapsules, and that bee’s can mistake the microcapasules for
pollen (see article regarding Checkmate and Particle Pollution). Yet the CDFA falsely claims that spraying
Checkmate regularly over time will not cause a significant health or environmental hazard.
Calculated to Bring About Destruction & Imposing Measures to prevent Births
Checkmate is formulated in a microcapsule. This is a miniature ball of plastic with a liquid core. It is obvious that
inhaling miniature fragments of plastic is unsafe. The micro-flake distribution system, and micro-particles from
the biodegradable polymer microcapsule shell, likely fall into the range of particle pollution that cause known
human health effects at the sizes between 2.5 – 10 microns. We do not know, because neither the CDFA, nor
anyone else, is testing for particle pollution from the microcapasules. Over 36 billion microcapsules were
distributed over the citizens of Monterey County during the last aerial spraying. Particle pollution is linked to
premature death.

Microcapsules and their associated particles, are also not safe to breathe in unless they are biocompatible -
meaning that they are designed to degrade safely in the human body. Since Checkmate was developed for
agricultural use, it is not biocompatible. The fact that a non-biocompatible substance is being sprayed on, and
thus, touched, absorbed, and inhaled, on tens of thousands of humans, is evidence of a calculated action to
bring about destruction of life since the non-biocompatible elements of Checkmate will be harmful to humans.
One of the published ingredients in Checkmate, is a Xenochemical called 2-hydroxy-4-n-
octyloxybenzophenone.

Chemical messengers in our bodies are called hormones. They are secreted in minute amounts by our glands,
to create chemical and physiological changes in our bodies. It is of the gravest alarm to note that 2-hydroxy-4-n-
octyloxybenzophenone can bind to human estrogen receptors in men, women and children. Many women who
are in the spray zone in Monterey County, have immediately experienced severe symptoms related to their
reproductive health. These symptoms include: extremely swollen and tender breasts, exacerbated PMS
symptoms, extreme mood swings, hot flashes, sweating, spotting and delayed periods. This even happened to
women who were not directly sprayed, but who entered the spray area several days after the spray.
If this Xenochemical is delivered directly into the bloodstream, then even a minute amount, from just one or
several microcapsules, could significantly influence estrogen receptors, convincing the body to create chemical
reactions. The symptoms described indicate that something in the aerial applications, whether it is a listed or
unlisted chemical, is designed to target human estrogen receptors for the purpose of birth control! Clearly a
measure to prevent births.
Microcapsules are Drug Delivery Devices
One method for delivering minute amounts of hormone directly into the blood stream, would be a system of
micro-encapsulation. Microcapsules in medicine are a new field and can be used to design a slow release drug
into the body. In these cases, biocompatible capsules are created so that the body can absorb the capsule shell.
The evidence of the symptoms described by those who have inhaled the time release substance within the
microcapsules, shows that some aspects of aerial formulations sprayed on citizens, are designed to deliver
minute but potent amounts of substances directly into the human bloodstream. Thus, violating FDA laws about
delivering untested drugs to the populace, and clearly violating human rights for all who are in the aerial spray
path.
It is clear that the used and applied chemical formulation of Checkmate has effects on female reproductive
health, and that these affects are not typical with Bt chemicals. Thus a typical Bt chemical is not the only
chemical being deployed.

Human Experimentation with “pesticides” by EPA
In February 2005, the EPA released plans to begin, experimenting on humans with pesticides.

now include testing on young children and pregnant women. The House and Senate voted to ban these plans,
so the EPA has found a work-around solution.
The Checkmate chemicals applied to Monterey County in the last two months, with plans for further applications
in Santa Cruz County at the end of this week, fall under the category of human experimentation and are in
violation of the Nuremberg Code. It is illegal by EPA’s laws to spray pesticides on people. The Checkmate
chemicals have never been thoroughly tested due to the EPA’s an emergency exemption, until they where tested
on the citizens of Monterey County in September and October of 2007.
Finally, in an iron clad set-up, it is seems impossible to have any legitimate independent testing of the
Checkmate chemicals. We must “trust” the EPA, that these chemicals are safe. Yet they cannot be known to be
safe for humans, without first, human experimentation. Apparently these aerial treatments over California citizens
are the EPA’s experiments.
Why would the EPA violate its own laws, if not for some other plan is at stake? How is it that we allowed, the
CDFA to spray people with untested chemicals that do cause harm, while they lie to and mislead the public about
the safety of the chemicals.
Senator Barbara Boxer stated, “If the EPA can get away, testing on babies, infants, then they can get away with
anything when it comes to human testing."

Something that explains why cities and not crops are targeted. That explains why human rights are being
violated to protect from the possibility of crop damage which there is no evidence for.
This is a plan for a biochemical experiment on humans to test a newly developed chemical weapon,
which contains potent hormonal disrupters, and possibly other deadly ingredients.
The weapon is likely designed to have long term affects (1 month to 20 years), to prevent women from having
children, and to cause premature death. Its design is likely so that the immediate connection from spraying
would remain unrecognized, and that its true ingredients may be difficult to detect.
In this scenario, it is likely that the LBAM was artificially introduced into the environments of Santa Cruz and
Monterey Counties to great a false alarm. It was introduced in other counties to make it appear like an
infestation. Even though the LBAM did not multiply greatly in Monterey, that area was target as the first aerial
location. This is possibly because of the close government ties to the owner of Checkmate’s manufacturing firm,
Suterra, who also owns Dole. This also would allow for easy monitoring of the results.
Santa Cruz and Monterey Counties have relatively clean air from ocean breezes, and are not too large in size.
This is ideal for conducting an experiment such as this because many other air pollutant variables can be
eliminated, so that the results of the biochemical can be clearly seen.
A legal structure was formed over a period of time, to try to limit or prevent resistance to the aerial treatments
under an emergency exemption.
The light brown apple moth, is not the issue here, but rather is a hoax, or a front, for the CDFA, EPA, and USDA,
under the direction of the Department of Homeland Security, to experiment on citizens.
Future Strategies to Look For To Prove Genocidal Plans
Already Moth Quarantines have begun for the gypsy moth. Thus a new emergency already declared, and in the
future, another EPA exemption would allow 3 more years of aerial treatments.

CheckMate LBAM-F was registered by the EPA in 1997 as a toxic III substance. The agency says it"s generally safe when diluted as prescribed by the manufacturer, Suterra LLC. In greater concentrations testing on lab animals caused irritation to the skin and eyes and is harmful when swallowed. These same symptoms were experienced by Monterey County residents who sought medical treatment after they were aerial sprayed in September. A spokesman for the State Dept. of Food and Agriculture suggested if anyone wants to increase their margin of safety they can leave the area. Spraying is taking place in residential and organic farming communities along the coast for at least three years.

There are alternative methods to aerial spraying which would keep this stuff off produce, out of water including the ocean and off people. The couple who own Suterra LLC through a holding company reportedly donated approx. $144,000. to Arnold"s re-election campaign, this contract is worth $15 million dollars. The current California Food and Agriculture Secretary, A.G. Kawamura, who is in charge of the project was appointed to the position and had donated $21,200. to Arnold. Santa Cruz and Monterey counties are major producers of certified organic produce. The cries for cessation to the aerial spraying over people, homes, food, water, etc of an untested toxic chemical has been deafening but Arnold is not listening. Congressman Sam Farr (D-Carmel) at a Town Hall Meeting in
Salinas Wed. night, affirmed his hope that his Agricultural Appropriations Committee will have a hearing with the US Department of Agriculture (USDA) Light Brown Apple Moth (LBAM) reclassification.


Farr has already submitted a 97 page petition to the US Department of Agriculture arguing to lower the classification of the LBAM from Class A (voracious pest) to Class C (minor pest).


“I am very excited about putting the USDA on the spot,” Farr had commented earlier. “I hope that we (the Appropriations Committee) can have a hearing on it.”


The USDA gets all of its money from the appropriations committee, so USDA “has to be responsive to our questions.” In his letter submitting the petition, Farr wrote, “I urge the Department to make a determination of the merits of the petition on the basis of sound science and proceed accordingly as soon as feasible.”


The petition challenges the quality of the science used by USDA in listing the moth class A and establishing trade quarantines. “The Plant Protection Act (PL 106-224:2000) . . . requires that decisions affecting trade be based on sound science.” the petition states.


In California, no damage from the moth has been found. Wherever the moth exists in the world, damage is not an issue, the petition reports. “The totality of published scientific literature suggests LBAM is at worst an episodically minor pest . . ..”


Along with three others, Roy Upton, LBAM Liaison for Citizens for Health, prepared the petition, which cites 182 sources, six from USDA and California Department of Food and Agriculture (CDFA) publications or statements.


Supporting letters with the petition are from Professors James R. Carey and Frank G. Zalom, internationally recognized University of California, Davis, entomologists, and Doctor Derrell Chambers and Doctor Hilary Lorraine, retired US agriculture officials.


“The current classification of LBAM is based on out-of-date information, incomplete understanding of LBAM biology, and does not reflect the true potential agricultural impact of LBAM on agriculture within the context of modern practices,” wrote Chambers and Lorraine.


The petition details all of the points made by Chambers and Lorraine.


Regarding classification and the associated quarantine on California produce, the petition says USDA relied on pre-1998 scientific and agricultural literature, ignoring one New Zealand scientist who changed a previous unsupported opinion that LBAM was a problem by reporting that LBAM “. . . is neither constant or endemic, nor characterized by sporadic plague-like outbursts.”


The petition also points out that some pests are classified A but without a quarantine. The USDA’s own figures show that most costs associated with LBAM in Australia and New Zealand are caused by requirements to meet the US zero-tolerance for LBAM, not for controlling LBAM.


Can the Mexico and New Zealand quarantines be lifted? Both governments have indicated that a change in US policy will be the main impetus needed for them to “harmonize” their policies. The discoverer of the first LBAM found in California in 2006, retired entomologist Jerry Powell, said, “. . . it doesn’t seem to me there’s much point to quarantining things . . ..”


Regarding LBAM biology, the petition recounts numerous errors, including the fact that USDA originally thought LBAM could not survive in coastal California, its only known home in the US.


The most frightening error was the projection of LBAM offspring provided by CDFA in 2007. It assumed that every egg laid by an LBAM would survive to maturity, increasing the California population to a range of 6.7 million to 7.8 trillion in a year.


In fact, the LBAM population has remained relatively stable. A main reason is predators. USDA and CDFA assumed no native predators would control LBAM. The petition lists 65 US LBAM predators, including six Trichogramma wasp species, a type of wasp that CDFA proposed importing.
Regarding modern agricultural practices, if LBAM were a threat, the petition offers this: “The success of New Zealand agriculture and horticulture professionals in controlling LBAM and other leafrollers using IPM (integrated pest management) techniques and few or no chemical applications is a model of best IPM practices that can readily be adopted in California.”

Is it safe to douse cities with synthetic pheromones? Prof. Joe Cummins and Sam Burcher

How organic agriculture and localised food, and energy systems can potentially compensate for all greenhouse gas emissions due to human activities and free us from fossil fuels Northern California is in the grip of a horrific aerial spray programme designed to eradicate an insect pest, Epiphyas postvittana, the light brown apple moth (LBAM). The LBAM is native to Australia and is also found in New Zealand, Hawaii, and the United Kingdom where it is not considered a significant pest. However, the California Department of Food and Agriculture (CDFA) and the United States Department of Agriculture (USDA) have prescribed a $74.5 million pesticide plan using a synthetic insect sex hormone to eradicate the perceived threat to a number of plant species thought to be susceptible to attack by the LBAM. These species may include the Californian cypress, oak and redwood trees, as well as ornamental and nursery plants; and a broad range of citrus, grapes, and deciduous fruit tree crops.

Botanist Daniel Harder, the executive Director of the Arboretum at UC Santa Cruz, visited New Zealand in 2007 to study the behaviour of the LBAM where its presence does not cause economically significant crop damage, or had a detrimental effect on native flora. His research has led him to conclude that, “It is not such a nasty pest. You’re not going to see a plant succumbing to the LBAM.” Furthermore, he says that there is no reason to believe that this moth will be any more of a problem in California than any other moth from the Torticidae family. He is confident that earwigs, birds and spiders will eat the moth and its larvae and prevent the devastation envisaged by agricultural officials, and rejects the expensive, unnecessary spraying of a dozen urban communities in the coast and bay areas. Jim Carey, a UC Davis entomology professor, says that the pesticide plan won’t work because the LBAM has been in California for at least thirty, if not fifty years, or more, and that the money would be better spent trying to contain the spread of the LBAM rather than eradicate it altogether. UC Berkeley associate Professor of Agro-ecology Miguel Altieri agrees, and says that the fact that the moth is here doesn’t mean devastation.
Aerial pesticides sprayed over urban communities

A pheromone is a natural scent that an insect produces in very small quantities to communicate with a potential mate. In the case of the aerial spray, the pheromone works by confusing the male moth, which disrupts the mating cycle, thereby decreasing or eradicating the pest population. Several rounds of aerial spraying with ‘CheckMate LBAM-F’, and ‘CheckMate OLR-F’, have already blanketed Monterey and Santa Cruz counties in September through to November 2007 with the insect pheromone, and further sprays planned for June 2008 have been temporarily halted by the courts until after 17 August 2008 when test results from the spray formula are expected. The counties of Alameda, Albany, Contra Costa, Marin, Santa Clara, San Mateo, San Francisco, Solano, and Oakland are fresh targets for the summer aerial spraying campaign in 2008. The CDFA and USDA have identified the LBAM as a Class ‘A’ pest to obtain an “emergency exemption” from the California Environmental Protection Agency (EPA), and both claim that synthetic pheromones are not toxic to humans or to the environment. However, a report from a Task Force set up by the city of Albany, California has provided evidence to the contrary. The report states that, “Following the spraying in Monterey and Santa Cruz in 2007, there were more than 600 reports of health problems, including asthma-like attacks and difficulty breathing, chest pains, headaches, blurred vision, swollen glands, skins rashes, and feelings of chronic fatigue.”

The symptoms reported by Monterey and Santa Cruz residents are consistent with the known health effects of several of the ten ingredients found in the pheromone formula. Matthew Sluder of the Sustainable Health Institute [6] recently outlined his concerns to the Marin Country Agricultural officer and to the Integrated Pest Management Commission of two of CheckMate’s published ingredients:

* Butylated hydroxytoluene is mutagenic for mammalian somatic cells, also for bacteria and/or yeast. Repeated or prolonged exposure can produce organ damage and may be toxic to blood, central nervous system (CNS) and liver.
* 2-hydroxy-4-n-octyloxybenzophenone is a xenochemical that binds to estrogen receptors in humans and animals. Even small doses will signal specific biological action in the body. Prolonged disruption the endocrine system is a cause of breast cancer.

CheckMate OLR-F® also contains (E)-11-tetradecen-1-yl acetate and (Z)-11- tetradecen-1-yl acetate as the active ingredients (A.I.s); while CheckMate LBAM-F® and DISRUPT Micro-Flake®, contain in addition to (E)-11-tetradecen-1-yl acetate and (Z)-11- tetradecen-1-yl acetate, (E, E)-9,11- tetradecadien-1-yl acetate. All formulations include the ‘inert’ ingredients, Polymethylene Polyphenyl Isocyanate (PPI), Tricapryl Methyl Ammonium Chloride and 1, 2-benzisothiazolin-3-one. The EPA’s claim that these chemicals are inert fails to disclose the fact that these substances are toxic. Inert ingeredients are chemical formulations that accompany the main chemicals responsible for eradicating the pest, in this case the pheromones.

Registration of the synthetic pheromones themselves seems to be a dangerously cursory process, in which data relating to toxicity, mutagenicity, allergenicity or teratogenicity may be waived if the substance is a member of a well characterized chemical group in the major OECD countries including the United States. In general, the registration of the synthetic pheromones seems to be slipshod and inadequate.

A recent study on CheckMate LBAM-F® by the Aquatic Toxicology Laboratory at UC confirms the danger of aerial application particularly from the ‘inert’ microcapsules ranging in size from approximately 10 microns to 190 microns. According to the American Lung Association (ALA) microcapsules in the region of 10 microns come under the category of ‘Particle Pollution’ defined by the ALA as a combination of fine solids and aerosols that are suspended in the air we breathe and are small enough to lodge deep in the lungs where they can do serious damage. Particle Pollution is well documented for its adverse effects on short and long term health, including the increased severity of asthma attacks in children, damage to the small airways of the lungs and dying from lung cancer, respiratory and cardiovascular causes. Children and the elderly are most at risk from these ingredients.
Severe reactions ignored

One eleven month old infant called Jack had such a severe reaction after the first aerial spraying in Monterey that his father Air Force Major Tim Wilcox called a military doctor. The boy was hospitalized on three occasions and stopped breathing on one occasion. The previously healthy child spent his first birthday on medication and oxygen and is now permanently on medication. Major Wilcox’s letters and complaints to the state about the possible bad reaction to the spraying were ignored. CDFA spokesman Steve Lyle said his agency had received 330 complaints of spray-related illness but he downplayed the news, insisting that “the agencies with the jurisdiction to review the product have told us it’s safe to use.... and the CheckMate products were unlikely the cause of the illnesses reported.” California’s Governor Arnold Schwarzenegger supports the urban spraying liquid and backs the CDFA’s position on the spray being safe.

California State’s official emergency exemption under Section 18 of the Federal Insecticide, Fungicide and Rodenticide Act has allowed CheckMate LBAM-F, and CheckMate OLR-F to bypass the normal vetting processes to assess safety under California law. This effectively allows a substance that has not been thoroughly tested to be used in urban areas, and despite the manufacturer Suterra LLC of Bend, Oregan admission that “long term studies on the active ingredients have not been done”. Further aerial onslaughts of the LBAM are to be coupled with “complementary techniques” such as ground treatments and foliar sprays of Bacillus thuringiensis (bt), a bacterium known to have adverse health effects on human and animal populations (see More Illnesses Linked to Bt Crops. It also infects open sores or abrasions of people with weak immune systems from age, HIV infection, or from treatment for autoimmune diseases. Spinosad is a natural insecticide obtained from bacteria (synthetic Spinosad derivatives are also available) that is to be applied to areas of LBAM infestation. Even though Spinosad is approved for organic production, laboratory experiments showed that it was harmful to honeybees and bumblebees. Later experiments showed that dried residues of the natural insecticide are not harmful to bees. But as the bees are already stressed and threatened by colony collapse disorder (CCD) see Saving the Honeybee Through Organic Farming it is advisable to apply the natural insecticide, if at all, only at night when bees are not foraging.
Elephants are white mice

In modern toxicology the adverse effects of pesticides is evaluated by exposing test animals and carefully evaluating the impact of the pesticide. Most testing is done with either rats or mice. In the case of the Lepidopteran (moth) pheromones, there is clear evidence that pheromones similar if not identical to those delivered from the air in California are active in inducing aggression and sexual arousal in the African elephant. The female elephant excretes the pheromone in her urine and the smell of that urine arouses male elephants. The elephants should be regarded as the white mice, as their response is relevant, not only to elephants that might be in the Bay Area but a large array of mammals including humans. Male sexual aggression should be considered a marker and evaluated from police records in the communities sprayed with insect pheromone from the air.

Both vertebrate and invertebrate animals are influenced by pheromones similar to those sprayed in California. Higher primates and humans have retained many of the genes specifying pheromone receptors of ‘lower’ vertebrates as inactive pseudo-genes, though humans have retained active pheromone receptor genes as well. The safety of a synthetic cockroach sex pheromone was questioned when it was found to be toxic to human cells. It would be prudent to presume all synthetic pheromones toxic to humans until fully evaluated for toxicity and unintended behaviour modification. Olfaction and pheromones are well documented to be a part of human behaviour.

According to the California Department of Pesticide Regulation (CDPR) US EPA states that “Based on low toxicity in animal testing, and expected low exposures to humans, no risk to human health is expected from the use of these pheromones. During more than 10 years of use of lepidopteran pheromones, no adverse effects have been reported. The safety record for lepidopteran pheromones has allowed the Agency to conclude that consumption of food containing residues of the pheromones presents no risk. ... Adverse effects on non target organisms (mammals, birds, and aquatic organisms) are not expected because these pheromones are released in very small amounts to the environment and act on a select group of insects.” For that reason little motoring of non-target effects was undertaken even though the toxicity of the pheromone to invertebrate organisms and fish was noted by CDPR. The ‘inert ingredients’, were of no toxicological concern according to CDPR. However, had they examined the actual; ‘inert’ ingredients’ they would have observed that more than on such ingredient posed a risk to human health.
Sex hormone makes manufacturer millions

The “organic biopesticides” market is specifically designed to target organic farmers in the US and Canada who can use Bt and pheromones on the premise that it is based on natural substances without losing their organic status. The biopesticides market is currently a small fraction of the overall $30 billion pesticides industry. By 2010, it is estimated to be worth $1 billion. It is also estimated that each aerial spray of CheckMate LBAM-F and CheckMate OLR-F® is worth $3 million paid directly to the manufacturer Suterra LLC. Initially the US EPA did not approve biopesticide use, but they appear to have slipped through the regulatory net along with GM crops. Health Canada, the federal department responsible for helping Canadians maintain and improve their health has approved the aerial spraying of a Bt formula Foray 48b to control the Gipsy Moth (Lymantria dispar). The manufacturer Valent BioSciences’ material safety data sheet [29] states that the “inert ingredients – identity withheld as a Trade Secret” are not known to be absorbed by the skin, or cause inhalation or ingestion problems. The same sheet warns that Foray 48b could possibly irritate target organs, skin, eyes and respiratory tract and goggles and overalls should be used when in contact with it. In West Auckland, New Zealand, an urban population was subject to aerial spray of Bt Foray 48b for moth eradication during cycles of 2-3 weeks for over 2 years. This was part of multimillion dollar aerial spray campaign between 1996 and 2004 in New Zealand. A ‘People’s Inquiry’ set up by those whose health was adversely affected by the spray has received support from the independent Ombudsman.

There is major concern for the welfare not just of humans and animals, not just for bees, but also for butterflies, and particularly bats, all which are major pollinators of food crops and natural insect predators. Bats are now under significant threat from pesticides.
Organic farmers told chemical treatment safe

Ground treatments with Bt, and Spinosad may be utilized in conjunction with aerial pheromone spraying in areas in California where moth larvae have been detected. Bt (Bacillus thuringiensis) kills insects by forming a protein crystal that the bugs ingest. The proteins rip through the innards of insects that go through a worm stage, said Olav Messerschmidt, executive director of the Biopesticide Industry Alliance. The formulations of these products are approved for use on organic crops in the USA, Canada and elsewhere. This has encouraged use by organic farmers and growers in California, who are also told by the National Organic Program (NOP) that they support the combined synthetic pheromone and bt treatment. However, it transpires that the California Certified Organic Farmers (CCOF) has not researched or read, or been provided with any information on CheckMate other than from the NOP or the CDFA. Peggy Miers, the Executive Director of the CCOF said “We are not a health organization and we are not an environment organization, our mission is organic and other organizations will address the health aspects… and environmental aspects. Our needs are to address the needs of our members and the organic marketplace.”

Most opponents of aerial spraying hesitate to question the safety of the pheromones, yet they agree that the additives to the spray mixture (above) are well known to cause the kinds of symptoms observed in Monterey and Santa Cruz. The Californian Alliance to Stop the Spray (CASS) and the Environment and Human Rights Advisory highlight twenty three human rights violations of internationally accepted codes of ethics by the enforced spraying programme that may incur liabilities for the CDPR.
CDPR assurances unreliable - synthetic pheromones lack adequate study

It appears that the CDPR has not been entirely honest in expressing their opinion of the aerial spray mixture. They seem to have neglected the well documented toxicity of some spray additives. This has resulted in the reluctance to fully evaluate the impact of the aerial spray on a very large population exposed to the spray. The evidence on the toxicity of the spray additives was clear while the toxicity of the synthetic pheromones is not yet thoroughly studied. There is a growing body of evidence indicating that the synthetic insect pheromones may also be active in mammals and probably in humans. In the fullness of time, it is likely that the synthetic insect hormones will be seen to have behavioural and cellular impacts on vertebrates and humans. Presently, these impacts have been documented in a few cases, but the field is advancing rapidly. Meanwhile, bureaucrats are using the absence of evidence as evidence of the absence of harm.

A few thoughts: 1) It's a class action lawsuit waiting to happen, 2) how could you possibly ask for any fucking worse PR? and 3) it's not going away anytime soon, as they are planning to spray into 2010.

Under the terms of BUSH/CHENEY and their exemption from the FAA aerial spraying federal statues, they're exempt from normal liability.

Under FAA law, spraying bio-terrorist products from an airplane is strictly limited to the CIA, military, or federal government. The FED was smart enough here to make Calif take the fall, all the while Suterra got the money.

The FDA specifically exempted these folks from liability early on thanks to Cheney. Like the violation of privacy and wire-tap, sure someone will sue, but it will not go anywhere this stuff was all done under the wrap of 'home land security', aka NSA, aka National-Security.

The residents of Monterey and Santa Cruz Counties are being used as guinea pigs. There is no real agricultural emergency. The EPA gave the state an emergency mandate for spraying without any previous testing and without doing an Environmental Impact Report. The State legislature then removed the word "emergency" from their mandate and replaced it with "urgent". These people are being sprayed without their consent and against their will by their own government! If it's allowed to happen there, it can happen anywhere. The planes are loaded and waiting, full of synthetic pheromones and undisclosed trademarked chemicals that have not been tested for human health or long term effects on people and animals.

There is no real agricultural emergency. No crops have been lost. One of (California Secretary of Agriculture) Karamura’s own AG spokespeople said if nothing was done to control the moths, crop damage would amount to about 2% which is actually less than from some other pests and minor as far as production.

There are other ways to control the moths which have been used successfully in many areas by this same agency. This way people and animals will be breathing polymer spheres that will release unknown chemicals in the lungs or not disperse but possibly accumulate with successive spraying. It hasn’t been studied. If it gets on the skin or in the eyes they say to wash it off immediately. How does a dog wash it's eyes? Or a kitty? They'll just rub it in more. People are supposed to wash their clothes, their pets and their plants, and not to leave standing water outside because the microcapsules don’t disperse in water. Pets or wildlife will drink water contaminated by the spray. Run off will take it to the ocean, as will wind, where once the microcapsules hit the water they will not disperse so will become part of the marine environment.


There are many people in the counties of Santa Cruz and Monterey, CA that have to leave their homes because of respiratory conditions, MCS, and COPD. Many children will be kept out of school and indoors during the week of spraying. Pets will be kept indoors as much as possible. But the spray gets on everything. During the thirty day time release after the spraying it will get carried in on shoes, paws and fur. Wildlife will drink it in water, birds will bathe in it. If they continue a campaign of spraying over several years, as they want to, many people will have to move away just to protect their lives, the lives of their families and their pets! No one actually knows what will be the result of this domestic terrorism.

California Governor Arnold Schwarzenegger demanded the release of ingredients to show "the people have a right to know", but only the ingredients of the synthetic pheromone, not the inert ingredients that are protected by state trademark laws. The pheromone is micro-encapsulated in polymer spheres that stay intact in water and disperse in air. There are isocynates (polymethylene polyphenyl isocynate - PPI) included in the inert ingredients which they denied and later admitted but said it dissipates by the time the spray is done.

In 1986 the US passed the Right To Know Act in response to the Union Carbide disaster in Bhopal. Somehow, this aerial bombardment is escaping the purpose of the Right To Know Act. Need more research, there... I do know, however, that the chemical in Bhopal was an isocyanate, a relative of the ingredient in the chemicals being sprayed on the people of Monterey, Marina, Seaside and Salinas, and very soon to be sprayed on the people of Santa Cruz and surrounding areas.

Monterey tried to stop the spraying, and actually got an injunction but then lost it. Santa Cruz City Council and County Board of Supervisors both sued for a restraining order but lost. Monterey was sprayed in October and is being sprayed again now in November. Santa Cruz is being sprayed next. Hundreds of thousands of people and pets, wildlife and birds, ocean life and plants are being sprayed from planes with nowhere to hide from untested chemicals. Schools and playgrounds, parks, cars will all be covered with undisclosed chemicals that could have long range consequences on health and reproduction.

SANTA CRUZ – Assemblymember John Laird (D-Santa Cruz) today issued the following statement regarding the latest round of LBAM spraying, set for November 4-9 in northern Monterey County and Santa Cruz County:

“The Santa Cruz County Superior Court’s denial of the request for a temporary restraining order against the CDFA should not be interpreted as an endorsement by the court of the aerial spraying plans.

Following the ruling, my concerns about the CDFA’s aerial spraying program and request for delay are exactly the same as they were before the ruling, especially with regard to environmental review and public health.

I am also concerned about the lack of adequate notice provided to residents in the population center of the Santa Cruz area spray zone.

It is unfortunate the CDFA has chosen to move forward with aerial spraying, despite legitimate and serious concerns raised by me, the Santa Cruz County Board of Supervisors, the City of Santa Cruz and the hundreds of residents who have contacted my office.

With spraying set to begin tomorrow, it is critically important for those who believe they have suffered health effects from the spraying to contact their health provider directly or visit a local health clinic. Doing so is the only way to ensure incidents are tracked and investigated.

Since August 27th, I have raised dozens of key questions about the spray plans. The questions I have raised (and the CDFA’s responses to them) have become a useful element in the ongoing community dialogue in both Monterey and Santa Cruz Counties. Certain questions and requests have been responded to, such as the establishment of a phone hotline and an email notification system. Likewise, at my request, there has been a more open public process than what was originally planned by CDFA.

However, with the first round of Monterey Peninsula area spraying completed, and north Monterey County and Santa Cruz County spraying set to begin this weekend, I am distressed by the fact that many of my questions have not been answered adequately and new questions continue to arise.

With approximately 100,000 people residing in the spray zones for the round set to begin tomorrow, many environmental, scientific and efficacy questions have not been adequately answered. That is in part because so many of the studies and reports that are essential to getting answers will not be available until after the first rounds of spraying have already happened (see chart below). While it is troubling that so many study and report milestones have yet to be met, I’m more troubled by the lack of studies and follow through related to public health.

Of greatest concern to me is the notion that speculative economic impacts may be outweighing the need to protect human health. In Monterey County there are reports of more than 200 health complaints associated with aerial spraying. Yet, to date there is no evidence that reports have been analyzed, and a promised ‘white paper’ on the toxicological data on the pheromone product and the health complaints taken as a whole has not been released. In fact, in his October 26th letter to me, CDFA Secretary Kawamura indicated there are no plans to either study long term effects of the spraying or conduct an epidemiological analysis of the complaints CDFA has received.

In light of the unresolved health complaints and unanswered scientific questions, the “Precautionary principle” should serve as a guide. It has been described as a political and moral principle that says if an action or policy could harm the public or the environment, the burden of proof falls on the proponent of the action—rather than on the public.

It was determined in Superior Court that the County of Santa Cruz failed to meet the burden of proof required to obtain a temporary restraining order against the state. However, in the court of public opinion, the burden of proof ought to be on CDFA to prove LBAM-F and OLR-F are safe prior to spraying it on residential populations monthly for an open-ended period of time.”

Sometimes bad dreams do come true. My bad dream was that the government issued quarantine, and forced everybody to be vaccinated for some fake disease. In my dream, I took my family, and fled to the hills to avoid being vaccinated.

Now, nine months later, this dream has come true. In an emergency, I relinquished my rental contract and moved my pregnant partner and three and a half year old daughter out of Santa Cruz, CA, to avoid being exposed to potentially deadly chemicals.

The chemicals, known by their trade names as Checkmate OLR-F and Checkmate LBAM-F, have been sprayed via state owned airplanes in September and October in Monterey County California. These same aerial chemicals, despite their known health risks, were sprayed on two nights (11-8, 11-9) over the people of Santa Cruz County. The purpose of this spray is to control the mating habits of the light brown apple moth (LBAM). The reason the moth needs to be controlled is due to the possibility of 100 million dollars of damage

(Realize that this figure is not a fact, but based on a government guess).

Government's Pesticide Experiment Program

The California Department of Food and Agriculture's own doctor acknowledges, in court documents, that aerial application of this chemical has not been tested. Let me repeat this so you understand, chemicals are being sprayed on young children, nursing mother's, people with asthma, lung problems, heart problems, the elderly, the disabled, the homeless and the chemically sensitive - and this chemical formulation has NEVER been tested on even a piece of dirt, let alone, humans. The newly designed Faroes Statement, the consensus of over 200 scientists, calls for a precautionary approach with respect to exposure of fetuses and children to environmental toxins. The consensus is that exposure of fetuses or children to chemicals can cause increased susceptibility to disease and disability later in life. In addition, the U.S. Environmental Protection Agency (EPA) has specific directives and codes that state that they should not experiment with pesticides on pregnant women, or infants. It is a fact, since this aerial pesticide has not been proven to control the moth's mating habits and has not been proven safe to animals or humans, that this is an experiment.

In Monterey, approximately 100,000 residents were exposed to untested chemicals to control the mating habits of less than 750 moths. In Santa Cruz County, over 100,000 residents will be exposed between 11/06/07 – 11/09/07 to untested chemicals to control the mating habits of less than 9,000 moths. This is not a one time application, but will continue monthly beginning again in February, for nine months, and then repeated for up to a total of three years. Again, this program designed to eradicate the moth at best will only control the moth's mating habits; it will not eliminate the moth. At worst, the program will be ineffective, cost tax payers millions of dollars, and cause permanent disability to residents and their pets. All this harm is over a little moth that has yet to cause even $1 of damage in California.

Did you know that each aerial application of Checkmate OLR-F and Checkmate LBAM-F costs approximately $3.5 million and that $3 million is paid directly to the manufacturer Suterra, LLC of Bend, Oregon?

The projected expense of this eradication "attempt" will cost tax payers over $70 million dollars just to spray Monterey and Santa Cruz counties the proposed 9 times. These monthly sprays are already scheduled for next year to begin in March. The California Department of Food and Agriculture has created a map which shows the spray area to grow and encompass various portions of the entire San Francisco Bay Area, click on the Central Coast (www.cdfa.ca.gov/phpps/PDEP/lbam/maps.html) . The United States EPA has authorized an emergency permit which could allow the CDFA to aerially spray the state of California until the year 2010. This Light Brown Apple Moth Eradication could cost California tax payers more than $500 million dollars when all is said and done, which is five times the projected amount of losses to the agricultural industry if the moth were to infest the state. Ridiculous and frivolous spending on untested, unproven and toxic methods of "attempted" pest eradication are unacceptable actions taken by Governor Arnold Schwarzenegger and the California Department of Food and Agriculture. This is not a state plan, but is a plan that is sponsored, endorsed, and largely funded by the EPA and the USDA.

Documented and Undocumented Pesticide Damage to Humans

While the moth may cause an estimated $100 million of crop damage, one cannot put a price tag on the damage that Checkmate's chemicals cause to humans. In Monterey County, the first county in California to be sprayed with Checkmate OLR-F and Checkmate LBAM-F, documented affidavits show that citizens got sick, ill or suffered life threatening reactions to the toxic spray. One infant in the City of Monterey nearly died from inhalation of the experimental biochemical, and now has permanent lung damage. Dozens of women in cities throughout the Monterey Peninsula are reporting problems with their reproductive systems after exposure to the pesticide, including: sudden, severe and irregular menstrual cycles, extreme cases of tender and swollen breasts, and the recurrence of menopause symptoms in older women. Other side effects of both Checkmate OLR-F and Checkmate LBAM-F include: asthma and sudden breathing difficulties, chest pain, vomiting, lethargy, fatigue, and extreme mood swings. Some people have coughed up blood and have gotten bloody noses from Checkmate exposure.

If you are familiar with chemical exposure, then there is something to note which is of great alarm. If you have ever smelled paint, bleach, or something toxic like that, it takes a significant and potent amount of the chemical to make one sick. It is not typical that such small and minute amounts of chemicals can cause such severe damage as described above. The explanation for the severe side effects, is that the chemicals are in miniature balls of volatile plastic called microcapsules; thus chemicals can be introduced deeply into the body through swallowing or inhalation of the micro-sized particles. It is as if this "agricultural" product acted more like a drug on humans, than as a pesticide on moths.

Thousands of residents, including myself, have undocumented pesticide damage. I lived forty miles from the October-Monterey spray zone, and on the last day of aerial spraying, my entire family became ill. My daughter vomited. I had severe intestinal distress and could not eat for several days. I felt nervous and anxious, as if I had the caffeine equivalent of 10 cups of coffee. And for the first time in my life, I had yellow/red colored urine (I am now mostly recovered). I did not link these symptoms to pesticide exposure until days later upon talking and hearing about dozens of other Santa Cruz residents who were experiencing the same or similar symptoms, on or near the same day. Their symptoms included severe vomiting and yellow/red colored urine. Recently I learned that this exposure may not have been from pesticide drift, but a rogue plane releasing chemicals where it was not supposed to. Witnesses have recently linked the red color to the Checkmate formulations, seeing small red droplets where the Checkmate has contacted metallic objects.

The questions I ask myself are: What type of chemical, in such small doses, causes such profound harm? Why does a chemical claimed to be harmless to humans by the EPA, the CDFA and Governor Schwarzenegger have a significant and severe effect on the female reproductive system?

Microcapsules = Microwarfare

The aerial application of Checkmate OLR-F and Checkmate LBAM-F is designed out of the concept of miniature plastic sphere-like particles, generally the same size as the width of a human hair. They are called microcapsules. Each capsule is a biologically "loaded gun" due to its own chemical make-up and that of the pheromones held inside. Research indicates that the capsules are likely made out of a urea-formaldehyde polymer, the industry standard. This is an extremely volatile plastic which, under UV rays, degrades over a time period estimated to be anywhere from 30-70 days. These "agricultural" microcapsules have never been tested safe for humans. Thus, the life of these microcapsules inside our bodies is truly unknown as are the health risks of inhaling or swallowing them. Preliminary research on the microcapsules have revealed that they are made of a new technology, and that the large capsules are made up of a cluster of smaller 3-4 micron size capsules - a size of capsule that can be deadly to humans over the long term.

Many of the chemicals used to make the Checkmate OLR-F and Checkmate LBAM-F products have been deemed harmful for human consumption, like butelated hydroxyl tolune (BHT). For example: on the label for BHT it says (in big letters) "Do not inhale this product. Dangerous to respiratory health." The symptoms documented by Monterey County residents can be directly correlated to the warning labels of BHT, and several other chemicals. BHT, is also known as DBPC, a dangerous pesticide known to cause sterility in men.

Recently, Dole Food Company lost a lawsuit in which Nicaraguan Banana farmers were exposed to DBPC. In pending lawsuits, thousands of South American Farmers are claiming that they were harmed by exposure to DBPC.

Within these microcapsules is an endocrine disrupter which attaches itself to estrogen receptors and forces the activation and constant production of estrogen to occur in the human body. This happens for men, women and children. This chemical is called 2 hydroxy 4n octyloxybenzophenone. The warnings surrounding the exposure to this toxic chemical can be directly correlated to the documented symptoms of women living within the spray zone in Monterey County. These are health concerns which CANNOT be overlooked or swept under the carpet. The entire state of California and its residents are at risk for severe short term reactions to this aerial spraying. The projected long term effects of exposure to Checkmate OLR-F and Checkmate LBAM-F are unknown, undocumented and until now - not even a thought in the minds of those who are authorizing the spraying, and manufacturing the chemical.

In addition to the horrible documented health effects of coming into contact with Checkmate OLR-F and Checkmate LBAM-F, there is a great chance that it will not even prove to be an effective investment. The EPA's own documents state that such a microcapsule cannot successfully release pheromone, and that "The studies show that only a small proportion of the microcapsules actually release any pheromone or only a portion of the total pheromone loaded into the capsule is capable of ever being released."

Science and competent intelligence does not seem to be the methodology of this spray program; in light of such statements made, the technology cannot work.

The EPA masks their "emergency approval" of Checkmate OLR-F and Checkmate LBAM-F behind the assertion that the pheromones in the products are safe. They then make the scientific leap and pronounce the entire pesticide is safe to be sprayed on residential neighborhoods, schools and water ways. This arrogant assertion by the CDFA and the EPA comes, again, without ANY LEGITIMATE TESTING. Under the "emergency exemption" (also known as Section 18), regulations allow the EPA to disregard the important 3% of "inert" ingredients. The "emergency exemption" allows this disregard even though many of those ingredients are not even inert, and are actually part of the "active" ingredients. The EPA then reaches the conclusion, "EPA believes use of these pheromone products, including aerial application over residential areas, presents negligible risks to human health and the environment." This is another case of ridiculous, frivolous and blatant disregard for human health by Governor Schwarzenegger, the CDFA and the EPA.

In addition to the aerial application which focuses on the agriculture industry, microcapsules are used in medical and military technology. In medical technology, microcapsules are used to time-release drugs into the body. The medical capsules are made out of a bio-compatible material that the body can easily absorb. In military technology, they can be used for chemical shields, or for experimental "non-lethal" weapons

(That means the weapon does not cause immediate death). These thoughts do not leave one with a pleasant taste about how these microcapsules are being used in our neighborhoods and communities.

The over 30 billion microcapsules sprayed over Monterey County last month are not bio-compatible; and yet children are playing in them, dogs are rolling around in them, and people are inhaling them. And the state continues to spray more communities as I write this.

Like pollen, the miniature capsules can float in the air and they can stick to surfaces people touch. Imagine hundreds of synthetic microscopic plastic balls floating in the environment and then entering your nose, mouth, eyes and ears. Is this safe? What happens when those minuscule plastic balls are inhaled? We know what happens. They get lodged in your lungs, you cough profusely to expel them, and you go into respiratory distress. Some Monterey County residents report asthma attacks increasing, others report coughing so hard and for such long durations that they cough up blood. One healthy adult male in the sprayed Salinas area, who jogs five miles daily, now has developed asthma since the last two aerial sprays. For the first time in his life, he must use an inhaler to help him breathe. The local doctor he sees is out of inhaler samples, he's given them all away.

These and other serious side effects associated with the aerial application of Checkmate OLR-F and Checkmate LBAM-F are being captured by citizen groups daily. Local doctors are refusing to document that their patients' symptoms have any relation to the aerial spraying. One doctor even told his patient (who was very ill from the spraying) that he would have to consult with this lawyer before discussing the matter further. An attorney representing the CDFA declared to a judge in Monterey County superior court during a hearing where a local environmental organization was suing the CDFA to stop the aerial spraying, that the CDFA has no intention on monitoring or following up on any of the health concerns or complaints that have been or will be filed in association with this aerial application. This is another blatant disregard for the health and well being of citizens. The CDFA can pay $3.5 million dollars to spray the residents of Monterey County, but cannot and will not spend a penny to assure citizens and residents that their health is of consequence to this program. This is repulsive! This is a crime!

Cities Are the Targets!

If you examine the CDFA reports (www.cdfa.ca.gov/phpps/PDEP/lbam/maps.html) you will see the cause for grave alarm. The LBAM aerial spraying program does not target agricultural fields with this agricultural technology, but rather targets mostly residential and urban areas that are great distances from crops and fields.

It does not take a rocket scientist to connect the dots:

1) A biochemical never tested before is being sprayed on cities and not agriculture.

2) The chemical has never been tested on moths, animals, or humans for safety or efficacy.

3) An emergency exemption is used for a moth which is not dangerous to humans; nor does it cause significant crop damage, especially in California's warm climate regions.

4) Minute doses of the chemical causes reproductive effects on women, and likely men.

5) Some of the chemical ingredients have no material safety data sheets regarding human exposure, and samples of the pesticide have never been independently scrutinized except by the EPA.

6) The majority of the funding of this project comes from the USDA and Commodity Credit Corporation funds, these funds are managed by George W. Bush appointees.

7) Plans are being put in place to continue aerial spraying over other populated portions of California, including San Mateo, San Francisco, Oakland, and many regions in Southern California. The moth has a peculiar habit of living in cities.

Checkmate: Killing us softly with bioweapons?
From The Aspen Institute about Lynda Resnick and her husband Stewart Resnick:

"Passionate about all things healthy." Maybe the Resnicks should tell that to the hundreds of people from the Santa Cruz and Monterey areas that have signed affidavits stating that their product, Checkmate (Checkmate OLR-F and Checkmate LBAM-F) got them sick, many seriously, when they were sprayed against their wishes last year.

Even with these affidavits and massive public outcry, high-profile lawsuits and city resolutions demanding an end to the spraying, Arnold Schwartzenegger, Homeland Security, the California Department of Food and Agriculture and the Resnicks have decided to use Californians as guinea pigs for this untested, un-approved by EPA, biochemical to see if it will eradicate the light brown apple moth (LBAM).

Why?

According to the CDFA they have to spray because there is potentially millions of dollars in damage that might occur to state crops due to LBAM.

That's right, the state has declared a emergency and the right to spray Californians with a product that has carcinogenic, mutagenic and reproductively harmful ingredients (see Aerial Spraying for the Brown Apple Moth to Resume) based on a possibility that there MIGHT be damage to crops in the near future by this moth.

What this amounts to is that they want to preemptively take out a potential threat before it's established that it is a threat at all. Doesn't this scenario sound familiar? Weren't we told that we had to go into Iraq because we had to act preemptively to take out Saddam's WMD program before he unleashed a mushroom cloud on some American city? How is the LBAM spraying program any different?

One missing ingredient in the PR campaign is that we didn't have the dazzling pyrotechnic display of 9/11 to get our blood boiling for vengence. Maybe if the state promoted this innocuous little bug as "Mothra" like one paper factiously did, they could sell this campaign to a skeptical Californian public.

However, LBAM is no Mothra and even the CDFA acknowledges this, stating that so far LBAM has not done any damage to crops. This is significant because according to James Carey, professor of entomology at UC Davis the moth has likely been in California for decades.

So, why the urgent rush to spray an untested, un-approved pesticide on children, grandmothers and people with auto-immune and respiratory problems? What form of insanity could explain such irrational, immoral behaviour?

There are many theories out there as to why the rush to spray. The most commonly heard theory (one held by both sides of the issue) is that this is all about protecting the interests of state's multi-million dollar agro-business, which is also the official narrative as well. And there is some validity to this point as the LBAM threat is already hurting local agriculture due to import restrictions by Canada and Mexico on the LBAM. But, this just constitutes a threat to the economy by bureaucratic fiat based on irrational fears, not because of some real threat.

Another theory being bandied about is that this spraying is about cronyism and political favoritism. The Resnicks are the owners of Suterra, the company that manufacturers Checkmate, and are among the top 100 campaign contributors to Governor Schwarzenegger, having donated to his coffers an estimated $144,000. It is believed that Resnick will be getting something in the tune of $75,000,000 if the spray program goes through.

So, is the rush to spray just an example of Schwartzenegger giving political/economic favors to his friends? A quid pro quo of the most prosaic kind?

Perhaps, but maybe we should venture outside pandora' s box into unchartered territory, or maybe we should call it "terror"tory, as that is what the elite do -- create threats -- real and imagined -- trump up the fear (anti-spray activists say that state (company?) goons were coming to the meetings and threatening the audience with visions of massive food shortages should there be no spraying), and then reap the benefits after they provide the solutions. The old Hegelian dialectic at play and we are all pawns in their game. (Perhaps this is the real reason for the name "Checkmate".)

In the mindset of the elite any crackpot, criminal and psychopathic idea is fair game to contemplate and apply in their Machiavellian worldview, including exposing civilians to biological and chemical weapons, as can be demonstrated countless times in U.S. history (see Humans Used as Guinea Pigs By US Government and Military). Recently Salon.com exposed an Army-run bioweapons exercise in Dead or Alive? in which the Army tried to cover-up the fact that they were using a live bacteria, bacillus subtilis, on unwitting civilians.

So, is it out of the question to ponder if this spraying campaign could have a more sinister agenda to it? After all, the American eugenics movement was funded by major American foundations, foundations that today are major supporters of population control programs. Can we rule out this possibility? ("Here is a good summary of an evil "whitewashed" out of our history books Eugenics and the Nazis -- the California connection)

This brings us to the Resnicks and The Aspen Institute, to which both husband and wife are members. Other notables members include Madeleine Albright, Richard Armitage, Prince Bandar bin Abdul Aziz, and Brent Scowcroft, just to name a few of the many political movers and shakers in the organization. It is significant that Brent Scowcroft is on the list as he is the author of the secret (now declassified) paper NSSM 200, "Implications of Worldwide Population Growth For U.S. Security and Overseas Interests," which provided insight into U.S. government plans for population reduction internationally. He linked these plans to goals that have very little to do with alleviating human suffering, and everything to do with the maximization of profit.

And, who can forget ex-Secretary of State Madeleine Albright's quote about the death of more than a half million Iraqi children due to U.S. sanctions: "I think this is a very hard choice, but the price -- we think the price is worth it." (60 Minutes, 5/12/96)

Worth it to whom, Madeline? Your New World Order overlords?

Besides having such unsavory membership, the Aspen Institute is also principally funded by Rockefeller and Carnegie foundation money (See http://en.wikipedia.org/wiki/Aspen_Institute), which were two of the mayor funders in the eugenics movements in the U.S. and Nazi Germany, and today big supporters of population control programs.

So,this brings us back to that unsavory third hypothesis. Could the LBAM spray program just be a cover for some sinister eugenics or depopulation program? After all, why is the spraying slatted to happen in heavily populated urban areas? Cities to be sprayed this summer are San Francisco, Oakland, Emeryville, San Leandro, Tiberon, and other heavily-populated Bay Area communities -- communities that one would not in any stretch of the imagination be called agricultural lands (though one might call them unfriendly to our global overlords). Since these moths have a mobility range of 20 to 40 yards it is a patently absurd notion that they have to spray urban communities to protect agricultural crops.

Anti-spray activist and Santa Cruz resident, Rami Nagel, speculates on this theory as well. He writes:

"Apparently the CDFA or the USDA, or both, decided that the previous chemical formulas used, Checkmate LBAM-F and Checkmate OLR-F were not good enough, which really points to the fact that the past two aerial sprays in Monterey, and the one in Santa Cruz County, were a waste of time and money. Not to mention the tragedy of the many severe health reactions experienced by thousands of people from chemical exposure. It doesn't matter to those in charge at the CDFA, EPA, or USDA, if a new chemical is needed to be used, because the goal is not to stop the moth, the moth cannot be stopped, it can only be controlled. This is known. The goal may be to coat people with a toxic mesh of disease causing microcapsules.

The chemicals that were sprayed, and that are planned on being sprayed, have not undergone thorough safety evaluations. And they won't undergo such evaluations in a legitimate way, because if they did, they would prove only one thing - that these chemicals are potentially deadly.

The chemicals planned to be sprayed will no doubt be similar to the ones used in Santa Cruz and Monterey Counties in 2007. They are a plastic encapsulated microtechnology, a microscopic plastic dust. The reported microcapsule size of the aerial mating disrupter is as small as 10 microns and averages 25-35 microns in size for an undeployed moth spray. For comparison, a human hair is approximately 70 microns in thickness. The size of these chemical containing plastic balls comes suspiciously close to micro-sized particles that are used to evade the body's defensive systems for biological weapons, those are reported to be 3-4 microns in size. Miniature particles between 2.5-10 microns in size, especially from pesticides, are known to cause both short term and long term health effects, including decreased overall life span."

Okay, so maybe Rumi and this author might be a little paranoid, but why shouldn't we speculate on the motives of this program? After all there is a history in this country of secret biological warfare programs carried out on unsuspecting Americans.

It's unpalatable, but plausible.

But, even if we choose to less conspiratorial but conventional in our thinking all we have to do is look at the stupid and criminal spraying of DDT, Agent Orange and Malathion to know that these spray campaigns can have disastrous results.

There is also the question of the legality and the the will of the people being subverted. To quote Rami Nagel:

"This aerial spraying violates several state, federal and international laws. It violates the right to personal safety given by the California State Constitution, the very document that creates the California government. It violates the Americans with Disabilities Act, which protects people with chemical sensitivities and other disabilities from discrimination. It violates the Federal constitutional right to personal liberty. It violates the EPA’s laws against spraying pesticides on people. It violates human rights laws that say that human experimentation without consent is unethical and immoral. It violates criminal laws that claim it is a crime to poison children, or anyone else. It violates pollution laws to spray a toxic substance over plants, animals, and waterways. It violates laws against organized crime and it violates the very tenants of our democracy; a system of government designed to represent the people, not to poison the people to represent private agri-business interests."

What this spraying program constitutes is a de facto biological weapons program against the people of California. And, if they can get away with it here you can bet it will be open warfare on the rest of the country. It is imperative that Californians stop it now.



Here are some thing you can do to stop the spraying.

Ask your congressmember to support A.B. 2892 Voter Consent by Assemblymember Sandre Swanson (Oakland, Alameda, Piedmont). A.B. 2892 would require the secretary of Food and Agriculture to obtain the consent of two-thirds of the registered voters of the cities and counties affected by applications of pesticide if the pest eradication zone includes any urban areas.

You can also boycott all products from Resnick-owned companies. Products include Paramount Agribusiness, POM Wonderful, Teleflora, FIJI Water, as well as the Franklin Mint.

And, definitely call Governor Arnold Schwarzenegger's office (ask to leave a message for his wife, Maria Schriver, too) to demand an end to the spraying: 916-445-2841 (press #1m #5, #0)

California Shock and Awe?

The San Francisco Chronicle reports a plan for aerial spraying of pesticides over several SF Bay Area cities -- including San Francisco, Oakland, Emeryville, and Tiburon -- to combat a potential threat of infestation by the little known light brown apple moth, an exotic agricultural pest. The spraying is proposed to occur at night, starting in August, 2008, and continuing over as much as a five year duration The chemical agent -- Checkmate -- contains a pheromone ingredient to disrupt mating of the moths, as well as other inert ingredients, whose identities, while partially known or suspected, may also constitute a protected trade secret.

Despite local protests and a court injunction (later overturned) spraying has already occurred in Monterey County, where, despite assurances of product safety, some adverse health effects have been reported. Further details appear in the Chronicle story.

My initial response to this story was incredulity mixed with outrage, but I am not asking you to share my views, which I will elaborate below. At the outset let me state my qualifications: I am a Ph. D. biochemist, trained in nucleic acid physical chemistry, currently working in the field of analytical instrumentation. That doesn't make me an expert on pheromones or insect physiology, but it does, I hope, establish a certain baseline competence.

Why am I upset about this project? First, the use of the pesticide agent, Checkmate is being rammed through the usual regulatory channels. Allow me to quote from the Chronicle article:

The U.S. Department of Agriculture obtained an "emergency exemption from registration" from the U.S. Environmental Protection Agency that allows the agency to use the pesticide in aerial sprays over California cities. Because of that exemption, the spraying program isn't subject to state approval, according to representatives of the state Department of Pesticide Regulation.

Second, as reported in the Chronicle, the effects on human an animal health remain in question, but are quite possibly negative.

Third, the moth is not yet established as a bona fide threat in the area.

Fourth, the spraying is essentially an uncontrolled biological experiment performed in a highly populated urban area, where we may count, among the many unknowns, the lifetime and tenacity of the agent in the environment.

Fifth, the decision, although nominally taken at the state level, seems to have had strong advisory component from the US Department of Agriculture. This nexus of state and federal authorities I find troubling, under the circumstances.

Sixth, I cannot force myself to ignore the possibility that there is a hidden political agenda in a decision which I see as harmful to whole San Francisco Bay Area -- which has been markedly unpopular in the corridors of power over the last several years. China Launches Salvo Against Dollar Hegemony (Updated)

We have seen reports on various China-focused blogs and even in the US media that China is increasingly chafing over the US dominance in financial affairs, and is particularly unhappy about the role of the dollar. Consider this quote from an August New York Times article:

Victor Shih, a specialist in Chinese central banking at Northwestern University, said that when he visited the People’s Bank of China for a series of meetings this summer, he was surprised by how many officials resented the institution’s losses [on dollar assets].

He said the officials blamed the United States and believed the controversial assertions set forth in the book “Currency War,” a Chinese best seller published a year ago. The book suggests that the United States deliberately lured China into buying its securities knowing that they would later plunge in value.


“A lot of policy makers in China, at least midlevel policy makers, believe this,” Mr. Shih said.


This is one reason I am perplexed at Bush having a financial summit that includes China and India next month. It is guaranteed that the role of the dollar and the US's abuse of its sovereign privilege will be a major topic. Do we really want to provide a forum and mechanism that could accelerate a move away from the dollar as reserve currency? If you doubt such a move is underway, consider: international shippers are increasing their use of other currencies for invoicing (see here and here).

Today, Reuters reports that the Chinese have launched a frontal attack (hat tip Ed Harrison):

The United States has plundered global wealth by exploiting the dollar's dominance, and the world urgently needs other currencies to take its place, a leading Chinese state newspaper said on Friday.

The front-page commentary in the overseas edition of the People's Daily said that Asian and European countries should banish the U.S. dollar from their direct trade relations for a start, relying only on their own currencies.


A meeting between Asian and European leaders, starting on Friday in Beijing, presented the perfect opportunity to begin building a new international financial order, the newspaper said.

The People's Daily is the official newspaper of China's ruling Communist Party. The Chinese-language overseas edition is a small circulation offshoot of the main paper.

Its pronouncements do not necessarily directly voice leadership views. But the commentary, as well as recent comments, amount to a growing chorus of Chinese disdain for Washington's economic policies and global financial dominance in the wake of the credit crisis.

"The grim reality has led people, amidst the panic, to realise that the United States has used the U.S. dollar's hegemony to plunder the world's wealth," said the commentator, Shi Jianxun, a professor at Shanghai's Tongji University.

Shi, who has before been strident in his criticism of the U.S., said other countries had lost vast amounts of wealth because of the financial crisis, while Washington's sole concern had been protecting its own interests.

"The U.S. dollar is losing people's confidence. The world, acting democratically and lawfully through a global financial organisation, urgently needs to change the international monetary system based on U.S. global economic leadership and U.S. dollar dominance," he wrote.

Shi suggested that all trade between Europe and Asia should be settled in euros, pounds, yen and yuan, though he did not explain how the Chinese currency could play such a role since it is not convertible on the capital account.

A two-day Asia-Europe Meeting (ASEM) of 27 EU member states and 16 Asian countries was set to open on Friday. Though few analysts expect much in the way of concrete agreements, Shi said it could prove momentous.

"How can Europe and Asia grasp each other's hands and together confront the once-in-a-century global financial crisis sparked by the U.S.; how can they construct a new equitable and safe international financial order?" he said.

"The world is waiting for this Asian-European meeting to achieve big results in financial cooperation."


While this is clearly not an official statement, the fact that the commentary was given such prominent placement suggests that is a sanctioned view.

The obvious impediment to any serious action being taken at this meeting is the massive plunge in the markets on Friday. As much as the Chinese may want to take a dramatic move, it is highly unlikely that any other participants will want to take action to undermine the dollar now, with international markets in a panic. Any news that might worsen stability, and putting the dollar in question, is not going to get much traction. The US temporarily (and we stress temporarily) has the upper hand via providing unlimited dollar swap lines to stressed advanced economy central banks and bailing out AIG, which was providing guarantees to European banks that helped them circumvent minimum capital requirements (in other words, if AIG collapses, a whole slew of Eurobanks would be below minimum capital levels, which would have worsened the conditions in interbank markets. Yes, the equity is basically phony, but stripping that away would still have made matters worse).

The Chinese will now be able to have a second go at the US in November, and they seem determined to push their agenda, even thought there could not possibly be a worse time to rattle the international financial framework.

Update 11:20 PM: Reader Chris sent us a link to a report from Jiji which put a different spin on the dollars. Note the emphasis on dollar decline. The dollar fell 3% versus the yen yesterday, and only 0.1% against the RMB.

Leaders of Japan and China agreed Friday that the two countries will cooperate to stem the dollar's further plunge and overcome the U.S.-originated global financial crisis.
Japanese Prime Minister Taro Aso, in separate meetings with Chinese President Hu Jintao and Chinese Premier Wen Jiabao, confirmed that the two nations will strive to maintain the current monetary system with the U.S. dollar playing the role of the world's key currency.

Aso told Hu that the further deepening of the current financial crisis would undermine national interests of the two countries. Aso stressed that world countries must take their respective measures to stabilize their financial systems.

Hu replied that countries must cooperate in dealing with the current crisis including in an emergency summit of the Group of 20 countries in Washington next month, which will be joined by the two countries.

After meeting with Hu and Wen, Aso told reporters that Japan and China are not hoping for a further plunge in the dollar and a meltdown of the dollar-based currency regime, adding the two countries should contribute to maintaining the currency regime.

The dollar, which dived to a 13-year low below 91 yen in London Friday, made China and Japan nervous because they are the world's top two holders of foreign exchange reserves. The nations are believed to have invested massively in dollar-denominated securities.

In a move to beef up the mutually beneficial strategic relationship, Aso and Hu agreed that they will hold telephone talks frequently. They confirmed that Japan and China are permanent neighbors and are in mutually beneficial ties.


In the meeting with Wen, Aso stressed the importance that China pay attention to consumers' worries about and distrust in Chinese food products and wipe them out, referring to a string of problems caused by Chinese foods, including those tainted with melamine, a toxic chemical.

Update 1:00 AM: According to the Wall Street Journal, currencies are not on the agenda for the November international meeting:

Persuading China to change its currency policy would be a worthy goal for a new Bretton Woods conference. But currency reform is low on the agenda of the summit that the Bush administration plans to host on Nov. 15. (The administration styles this gathering a "G-20 meeting," ignoring the European talk of a Bretton Woods II.) The British and French leaders who pushed for the meeting want instead to talk about financial regulation -- how to fix rating agencies, how to boost transparency at banks and so on. But many of these tasks require minimal multilateral coordination.


They may not move now, but they are laying the groundwork for moving away from the dollar soon.

Methinks the downward slide of the US has officially begun. Foreign wars or food and homes? It will be tough to afford both. Which is what leads to the end of an empire.

I remember when Les-Schwab bought JR last year, the first thing the city did was sink a huge well at their site.

I doubt that they're going to share the water, my guess is that Suterra will get their own well.

It's good to hear that Suterra will be on city-sewage, when they put in Les-Schwab all I saw on the ground was power conduit pull vaults, I didn't see any sewer lines being laid.

It seems odd, that the city would not just go ahead and connect to city-water, if they already had city-sewer there, it just doesn't add up. The city spent a fortune sinking that well for Les-Schwab last year at their site.

You must understand how water/sewer works.

There is NO measurement on what is dumped down the drain.

The measurement is on the water meter.

When people are on a WELL, there is NO meter. The city put in the Les-Schwab WELL for their use, my guess is they'll put in a new well for the use of Suterra, who will consume 1000X or more water by definition, as Les-Schwab is NOT manufacturing.

It would be silly to assume that the city knew when they put in the LS water well, that Suterra was coming or what their needs are.

Thus the argument still HOLDS.

Suterra will be on WELL-WATER, and NOBODY knows how much, and NOBODY will no how much or what they dump down the drain.

The good news is that DEQ can and 'might' monitor the output, but doesn't monitor the volume.

Well water waste in Bend is atrocious, just to give you an example, at Highlands@Broken-Top, next to Tetherow, all the homes are on WELL's, and run 24/7 all summer for irrigation, why? Cuz the water is FREE!

Well's aren't measured. If you go back to the Suterra 'letter of intent' that I keep telling you to post, they make it quite clear that they want water-rights, which is the right to sink as many wells as they wish!!

Where I grew up, each house in the neighborhood had a well. You know what happens when your well runs dry? Dig a deeper well.

People on city water are competing for water with people on wells. The difference? One group of people pays, and so has an interest in minimizing their usage. The other group of people doesn't pay. They don't even bother to patch leaks unless the water will do damage to a structure.

This battle ALWAYS comes up in a community when water becomes scare or polluted.

People on wells will take longer showers, flush more often, run washers and dishwashers more, wash the car more. This is especially the case in hard times when people are looking at their bills.

That’s the message fed to consumers of Fiji Water. The artesian spring water sold by the company was created in a volcanic aquifer far away from pollutants, so Fiji Water Co. claims. But to bring the pristine water to market, man is involved at great lengths. From plastic bottle manufacturing to the bottling process, to the transportation involved to export, import and ship water to stores, a vast number of resources are consumed—all for a product that, at least in the United States, is arguably a luxury item given the United States’ relatively clean tap water supplies.

Spurred by increased awareness around climate change and the waste produced by the bottled water industry, many stores and consumers are refusing to ignore the environmental impact of bottled water companies such as Fiji. My Organic Market (MOMs), a grocery store chain in Washington, D.C., recently announced plans to ban all bottled water products not sourced and bottled locally. And numerous mayors have banned the use of bottled water at city events.

Fiji Water is responding in a big way. The Los Angeles-based company announced in 2007 it would become a “carbon negative” company, a first in a fast-growing industry under increasing scrutiny for its adverse environmental impact. The company promised to purchase enough annual carbon offsets to cover 120 percent of its carbon footprint—a calculation that includes the creation of the source material for its bottles (plastic pellets made in Thailand)—while working to reduce its overall footprint by 25 percent over the next three years. Nearly one year into its commitment, it shows signs of swift progress.

Yet no matter how impressive its efforts, many consumers continue to criticize the overall sustainability of an industry that relies on turning a fragile water resource into a commodity [see “A spring has sprung,” Sustainable Industries, Sept. 2006], and relies on the petroleum industry to bottle and ship that commodity. Groundwater depletion from bottled water, as well as soft drink, companies has long been criticized by social justice advocates, most notably Indian author Vandana Shiva, who writes in her book “Water Wars”: “Water is a commons. …It cannot be owned as private property and sold as a commodity.” More companies such as Fiji Water are tackling corporate social and environmental accounting, and purchasing carbon offsets is a viable, yet often scrutinized practice. But many question whether the extraction of natural resources—whether water, oil, natural gas or any number of things—and the act of shipping them across the globe is a sustainable way to do business.

Every drop is green
Americans annually drink 36 billion bottles of water—from small individual bottles up to office cooler size—according to the most recent figures available from the Beverage Marketing Corp. (BMC). In 2007, the bottled water industry created $11.6 billion in sales and grew in volume by 6 percent from 2006, according to BMC.

Per capita, Americans consume less bottled water than Italians, Mexicans or Belgians, according to research compiled by the Earth Policy Institute. But the United States is climbing the list. Each year, bottled-water companies report growth in the United States, often surpassing the salesgrowth levels of other bottled beverages.

While the necessity of providing Americans with artesian spring water from faraway places can be debated, the long distance Fiji Water travels to reach American consumers is not: More than 6,000 miles sit between the Fiji islands and Los Angeles, and the distance between Fiji and New York City (via the Panama Canal) is more than 9,500 miles. Transporting its water to market accounts for one-third of Fiji Water’s overall carbon footprint—despite the brand’s purposely square-shaped bottles designed to conserve cargo space and relying mostly on ocean freight, which is far less polluting than other methods, to move product—the company says.

With solid brand recognition, Fiji Water is a key player in the industry: The company reported $150 million in revenue in 2007, with 90 percent of its sales coming from the United States. Despite the recent backlash over bottled water, Fiji Water’s growth rate by volume was 30 percent last year. It claims it has invested every cent of profit since its inception back into the business, as well as the Fiji islands. Its investments in the islands include building five local schools, helping 100 villages access local water supplies (including the aquifer from which Fiji Water is withdrawn) and partnering with Conservation International to protect the island’s largest rainforest. More than half of Fiji Water’s 700 employees are Fijians, with more than 400 working in the country of Fiji, the company reports. It employs about 50 employees in its Los Angeles headquarters and its remaining employees are spread out around the world.

Yet despite awareness around the impacts of global warming on places such as the Pacific islands, Fiji Water had not invested any of its profits in offsetting its carbon emissions until this year. It’s no secret that Fiji could feel deep effects from global warming, with the United Nations (UN) Intergovernmental Panel on Climate Change reporting that sea levels rose in the South Pacific nearly 20 centimeters in the past quarter-century, with a projected rate of rise that “very probably exceeds” that amount as the 21st century progresses. The panel also projects that air temperatures could rise by 3 degrees Celsius over the next several decades, and that island economies could experience more extreme weather events, such as the strong La Niña of 1998-2000 that was responsible for acute water shortages in many islands in the Indian and Pacific Oceans, which resulted in partial shutdowns in the tourism and industrial sectors.

In Fiji and Mauritius, the UN reports, “borehole yields decreased by 40 percent during the dry periods, and export crops including sugar cane were also severely affected.” The situation was exacerbated, according to the report, by the lack of adequate infrastructure such as reservoirs and water distribution networks on most islands at the time—something Fiji Water’s recent community water-access projects could ameliorate.

When the company made its carbon-neutral commitment in 2007, it launched a marketing campaign to help deliver the new message in its bottle: “Every drop is green.” Fiji Water spent “several million dollars” on the marketing campaign, according to Barbara Chung, the company’s senior manager for sustainable growth. Its marketing efforts included creating the “Fiji Green” Web site, which explains how the company calculated its carbon footprint; includes a blog detailing its conservation and community projects and lists what the company intends to do to both reduce its footprint and become carbon negative— a promise it appears to be keeping in an unconventional, transparent way. “We don’t just want to write a check,” says Chung “We want to make sure what we’re doing is what we’ve promised.”

Rather than buying carbon offsets on the traded market, a business model marred by lack of transparency (see “Carbon offsets: a dicey subject”), Fiji Water is instead working directly with Conservation International (Fiji Water owner Stewart Resnick sits on the board of directors) to reforest large tracts of Viti Levu, Fiji’s main island. The massive tree-planting project is an effort to link protected rainforests on opposite ends of the island by creating a biodiversity corridor.

Based on its 2007 carbon footprint, the company plans to invest about $11 million into the project this year, a figure based on the rate of about $11 per ton, plus an additional 20 percent in treeplanting spending to fulfill its new carbon negative promise.

As far as Fiji Water’s emissions-reduction goal, its efforts will be harder to quantify. First, the company has until 2010 to come through with its 25 percent reduction, and it remains to be seen whether Fiji Water can actually reduce its overall carbon footprint from 2007 levels in tandem with the kind of double-digit sales growth it has seen in recent years. Second, the use of recycled plastic in water bottles is extremely limited, and still largely in the testing stage for Fiji Water. Third, the biggest potential reduction lands largely out of Fiji Water’s control: Consumers must recycle the empty bottle.

The company is also reducing the distances the water is moved in trucks by keeping the product on ships longer—which produces significantly less CO2 emissions than trucks—even if it means the water does not reach consumers’ hands as quickly. Other stated efforts include reducing packaging, using more recycled materials and making sure the bottling plant gleans its energy from renewable sources as much as possible. An audit of the company’s footprint—verified by ICF International—in December 2008 would reveal Fiji Water’s progress on its ambitious carbon negative goal.

All a wash?
Despite Fiji Water’s efforts to make its carbon emissions reporting as transparent as the water it sells, consumers and scholars alike still question whether the company’s carbon-negative campaign is another case of corporate greenwashing.

There’s been much recent backlash against the use of bottled water—with the Center for Corporate Responsibility’s recent campaign to encourage governments across the United States to ban its use. The premise: What message are cities and states sending about the safety of their own municipal water supply by purchasing bottled water?

Washington, D.C.–based Earth Policy Institute keeps a running list of the number of U.S. cities that have instituted some sort of ban, and at last count 30 U.S. cities, including San Francisco, Seattle and Los Angeles, along with 19 international cities have done so. While EPI says it’s not part of the anti-bottled water campaign, the research organization shares its information with activists looking to further the cause.

Janet Larsen, EPI’s director of research, recently co-authored a major report on the environmental impact of the bottled water industry. Her conclusion? Bottled water is a wasteful product. “There’s no way to move such a heavy product such long distances without having a big carbon footprint,” she says.

On the other side, Fiji Water and the International Bottled Water Association say they have no need or desire to compete with tap water and say it’s a misconception that consumers buy bottled water as a replacement for the tap. But not all consumers carry around refillable water bottles, the company points out. Bottled water’s appeal, they say, is its portability and health benefits.

While Fiji Water points out the carbon footprint of bottled water is small compared to other products, such as wine or meat, awareness around climate change and rising food costs have created a nationwide movement to buy wine, beef and fruits and vegetables produced on American soil, a trend on which this magazine has reported extensively.

Bottled water comprises a tiny fraction of global fresh water use, says Tom Lauria, a spokesman for the International Bottled Water Association. He says he finds the controversy over bottled water “mysterious.”

“We’re truly the sacrificial lamb,” he says. He claims he doesn’t understand why other bottled beverages—soft drink companies, juice companies, wineries and the like—haven’t received the same scrutiny for transport of their products. “So many things come from around the world,” says Lauria. “We are so singled out, without anyone taking the big picture into consideration.”

Some of the nation’s biggest soft drink companies—many of which sell bottled water— have been under scrutiny in recent years: Under pressure from the advocacy group Corporate Accountability International, Pepsi in 2007 admitted that its best-selling Aquafina bottled water is just bottled tap water and it agreed to change its label. The infamous “Stop Killer Coke” campaign led by Ray Rogers, a New York–based labor rights organizer, has worked to shed light on the adverse social and environmental affects of soft drink companies’ bottling plants in developing nations.

Fiji Water recently joined the Carbon Disclosure Project, a London-based nonprofit group formed in 2000, in an attempt to validate its carbon reduction efforts. Using a special questionnaire system, CDP gathers and keeps an online public record of the carbon footprint of about 1,000 worldwide companies. CDP’s CEO Paul Dickinson says Fiji Water is the only privately-owned company to join its newest venture called the “Supply Chain Leadership Collaboration,” which takes carbon-footprint disclosure a few steps further.

The company joins much larger, publicly owned companies such as Pepsi (NYSE: PEP) and Wal-Mart (NYSE: WMT), according to Dickinson, that are giving their suppliers the CDP questionnaire in hopes of disclosing their full carbon footprint. The key for this new leadership division of CDP is transparency—primarily for investors, but secondly for companies themselves to figure out how they can reduce carbon emissions and bottom-line costs at the same time.

“That’s the big idea,” says Dickinson. “That everybody wins.” It’s this kind of transparency that the Federal Trade Commission is hoping will emerge from hearings held earlier this year. The agency’s work could result in some form of “carbon labeling” that would help consumers to ascertain the veracity of companies such as Fiji Water that are making carbon neutral or carbon negative claims. The idea being discussed is FTC regulation similar to keeping food claims of “all natural” or “organic” in check. So far, the hearings have not resulted in anything more than factfinding to determine if more study is needed.

“It’s the Wild, Wild West out there,” says Urvashi Rangan, PhD., senior scientist and policy analyst for the Consumers Union. “People are making all sorts of claims about their products.”

Rangan testified before the FTC back in January. She believes greenwashing is a growing issue, but isn’t certain the government is ready to tackle it just yet. “It’s not clear that they [the FTC] will do it,” she says. “We think it needs to be done, and in a meaningful way.”

Like many other critics of the use of carbon offsets to make up for carbon emissions, Rangan points out that at the time of the hearings, Fiji Water was calling itself carbon negative, but not doing enough to generate onsite renewable energy. She thinks companies making big environmental claims need to be doing more than simply offsetting their carbon emissions and that carbon labeling could eventually help consumers determine which companies are truly green and which are not.

So far Fiji Water, by making its footprint and the source of its offsets transparent, has made significant efforts to move itself into the “truly green” category. But as consumers, retailers and even municipalities become increasingly demanding of companies making sustainable business claims—and become more critical of carbon offset trading—transparent reporting will likely become an increasingly important tactic for maintaining brand loyalty in the years ahead.

OVER THE PAST DECADE, a handful of the largest
agribusiness and development corporations in the country
have been rewriting California water policy in secret meetings
to quench their thirst for unabated expansion and privatize
the state’s water supply. Displaying total disregard for the
California State Constitution, representative democracy,
and the environmental and social impacts of their actions,
these players seek to “game”public water projects—much as
Enron “gamed” energy deregulation. Their goal is to siphon
as much of California’s public water as possible to their
corporate farms and “master-planned” cities in the desert
while profiting from insider water sales.
In California state law,as laid out in the Constitution and the
Water Code,water is a public good,held in trust by the state to
ensure the greatest benefit to the public.In Water Heist: How
Corporations Are Cashing In On California’s Water we show
how the public trust has been breached by an entrenched
water plutocracy. The corporate interests that pervade the
water districts that call the shots throughout the state are
setting up insider water trading systems to facilitate the ease
with which water flows to money. With direct corporate
control over vital public water infrastructure—especially
massive public water storage facilities—environmental
protection and justice, urban renewal and smart growth face
a desiccated future where profit rather than need dictates the
destiny of California’s water.
The abuses continue largely because they occur in closed
meetings in hidden forms of government. Public Citizen
aims to help cast the light of public scrutiny on the water
deals taking place using the state’s public water delivery
system so that not just the CEOs of California have a voice
in determining how our water is managed.
The water plutocracy includes some of the largest private
agribusiness and development corporations in the country,
who have created obscure and unaccountable water districts
that act like “hidden government.”
California’s Great Central Valley receives between one and ten inches of rain a year. The diverted rivers sent south to be used as irrigation water
provide the Midas touch that transforms the desert into the richest agricultural region in the world.
Executive Summary
California’s Central Valley is one of the largest contiguous swaths of land on earth to have been so
completely altered by human activity. Lake beds and wetlands have been drained and planted with cotton
and almonds, rivers dammed and diverted over hundreds of miles from their sources, the air filled with
such quantities of dust and pesticides as to become the most polluted in the country, and the dry semi-
desert floor turned into the most productive agricultural region in the world. Now, after a century of such
cosmetology, the Valley is about to get yet another makeover from a boom crop: sprawl.

Usurping Democracy: The Monterey
Amendments
In 1994, the largest contractors with the California State
Water Project (SWP)—the state’s largest water delivery
system—called the Department of Water Resources
(DWR) into a closed meeting. The agreements that the
SWP contractors and the state reached in that meeting
led to a document known as the Monterey Amendments,
named after the city where the meetings took place. These
“amendments” to the SWP contracts included denying that
the SWP delivers half of what the contractors say it does
and effectively deregulating the SWP so that the contractors
can sell contracts for precisely the half of the water that
doesn’t exist. Sound confusing? It is. Welcome to the world
of “paper water.”
In the same Monterey meetings, the state also agreed to give
away an underground water storage facility that DWR spent
$74 million purchasing and developing.
State Giveaway of Essential Public Asset:
The Kern Water Bank
The Kern Water Bank is an underground water storage
facility—the largest of its kind—situated at the southern
tip of the Great Central Valley, the region where the
state delivers 80 percent of its surface water to industrial
agriculture. The water bank is connected to the public
canals and aqueducts that pipe water in from the northern,
central and southern Sierra Nevada mountain range. The
water bank can store about 1 million acre-feet of water and
pump out over 200,000 acre-feet a year, according to official
project descriptions.
The Kern Water Bank is an integral part of California’s
public water delivery system. It could store large amounts
of water for times of drought or natural disasters such as
fires or earthquakes. It could also provide a handful of
private corporations with the keys to a virtual “switchyard”
for controlling water deals between agribusinesses and real
estate developers.
In 1994,DWR gave the Kern Water Bank to the Kern County
Water Agency, which immediately signed it over to the
Kern Water Bank Authority, a supposedly public entity
comprised of a collection of water districts and one
private company. The private company involved is a “paper
company” with no listed telephone number or address:
Westside Mutual Water Company. Westside is owned
by perhaps the largest agribusiness in the United States:
Paramount Farming Company.
Who’s Behind the Kern Water Bank?

Roll International Corporation—a Los Angeles-based
holding company—is one of the largest privately owned
companies in the world, and everything that Roll owns
claims to be the biggest at what it does. Roll International
owns the Franklin Mint, Teleflora, and a collection of

agribusinesses—all of which operate in three California
counties—including Paramount Citrus, Paramount Farm-
ing,and Paramount Farms,Inc.The California Farm Bureau
Federation wrote that together “these firms constitute
the largest farming company in the United States.” Roll
is privately owned by Stewart Resnick, a Beverly Hills
billionaire and major campaign contributor who gave over
$350,000 to the Gray Davis Committee and the anti-recall
groups between 2000 and 2003. Governor Davis chose
Resnick to co-chair his agriculture-water transition team
with the champion of the failed Cadiz groundwater banking
scheme, Keith Brackpool.
Although the Kern Water Bank Authority oversees a vital
water resource, its staff is tucked away in the offices of
Paramount Farming Company, without so much as a sign
on the door. Executives from Paramount, who created an
almond and pistachio empire over the past two decades,
said that they went into the water bank to secure a firm
water supply for their crops. Local newspaper articles,
however, quote Paramount’s vice president, who presides
over the water bank’s board of directors, as saying “sales
from the water bank were contemplated from the time the
bank was acquired.” In fact, the paper reports, Paramount
is particularly interested in selling water to its parent
company’s home town: Los Angeles. Paramount executives
have already had “early talks” with the Los Angeles
Department of Water and Power about selling “an as-yet-
unspecified amount of water.”
The website of Paramount’s Los Angeles-based law firm
clearly boasts about how the law firm advised Paramount
Farming Company to set up a mutual water company
(Westside Mutual Water Company) to “own and operate”
the Kern Water Bank. Paramount, it seems, has been
planning for some time to harvest more than just pistachios
and almonds.
Irrigating Sprawl
California’s population is expected to grow by 20 million
in the next twenty years, and real estate developers are
scrambling to get a hold of “secure” water supplies for their
sprawling subdivisions. Public Citizen found a water sales
contract between WV Acquisitions, a Roll International
subsidiary whose president is also president of Paramount
Farming Company, and Newhall Land and Farming
Company, the largest developer in the state. Newhall has
been taking advantage of the 1994 backroom deregulation
of the SWP to go shopping for paper water contracts for the
new “master-planned” city it plans to build in northern Los
Angeles County.Such sales involve water supplies that are far
from secure because they are based on allocated state water
supplies: that is, paper water. Furthermore, this report raises
the essential question: Should corporations like Paramount
and Newhall be allowed to profit from buying and selling
water that belongs to all Californians?
Usurping Democracy, Again:
The Napa Proposition
In July 2003, just months after the seven-year lawsuit
challenging the Monterey Amendments by a coalition
of environmentalists, public advocates, and one State
Water Project contractor was settled, the participants in
the Monterey meetings met again, this time in Napa. The
agreement that resulted from these meetings—called the
Napa Proposition—plans to further integrate the SWP and
the federal Central Valley Project (CVP). Such integration
will allow landowners, principally in the San Joaquin Valley
and Southern California, to trade off the federal project’s
superior storage capacity and the state project’s greater
pumping capacity with one goal in mind:to continue pump-
ing water to agribusinesses,developers,and water marketing
barons in Southern California, unabated by either federal
or state endangered species acts, water quality issues in the
Delta, or the unmet needs of communities in the Central
Valley that don’t have access to clean drinking water.
End Game: Water as Public Trust
California’s public water utilities and resources are governed
by a plutocracy—a select group of private corporations,
individuals, and semi-public and public officials all working
in tandem to “game” state water policy. They meet in closed
sessions and rewrite public policy, tailoring their edits to the
interests of monopoly-like agribusiness corporations and
real estate developers. Is this a conspiracy theory? No. It is
just business as usual.
The water plutocracy must be replaced with a vibrant water
democracy.
Public Citizen strongly advocates returning the State Water
Project to broad public use and oversight so that it can
benefit all Californians, rather than only a select group of
Los Angeles corporations. Water must be maintained as a
public good, held in trust for broad and equitable use, not a
commodity bought and sold by the highest echelons of the
corporate elite.

We recommend the following concrete steps for accom-
plishing this goal:
Return Kern Water Bank to Public Control
Paramount and its Westside Mutual Water Company
should never have been allowed to “own and operate
the water bank.” The privatization of this vital public
resource should be reversed.
Repeal the Monterey Amendments
The Monterey Amendments should be repealed and
the State Water Project contracts should be rewritten
with an eye to water conservation and environmental
restoration as well as the original stated purpose of the
project: to reallocate California’s water resources in an
equitable manner.
Eliminate Paper Water
The Department of Water Resources continues to
maintain on paper that the State Water Project can
deliver almost twice as much as nature provides. The
water “entitlements” of the twenty-nine State Water
Project contractors should be re-drafted to fit the actual
capability of the project to deliver.
No Resale of State Water Project Water
The individual contractors that receive state project
water should not be allowed to profit from reselling
that water, whether it is back to the state Environmental
Water Account or to real-estate developers.
Democratize Water and Irrigation Districts
Water and irrigation districts that receive public water
deliveries from the SWP should be transparent and
accountable to the public. There should be elected,
public representatives on the boards of such districts
who would represent the non-landowning population
affected by water policy decisions made most often in
closed meetings.
NATURE PROVIDES ENOUGH WATER for California
to meet all of its needs: to sustain water-efficient family
farms and industries; to provide safe drinking water to
present and future generations; and to restore and maintain
California’s much-abused environment. Nature provides
enough water; that is, unless mismanagement and greed
intervene and allow for the state’s public water supplies to be
manipulated for profit. Too much is at stake to let this water
heist continue.

Just got back from "Man On Wire" out at Pilot Butte. Highly recommended. Fucking unbelievable that the guy pulled it off.

On August 7, 1974, shortly after 7:15 a.m., Petit stepped off the South Tower and onto his 3/4" 6×19 IWRC steel cable. The 24-year-old Petit made eight crossings between the still-unfinished towers, a quarter mile above the sidewalks of Manhattan, in an event that lasted about 45 minutes. During that time, in addition to walking, he sat on the wire, gave knee salute and, while lying on the wire, spoke with a gull circling above his head.

Port Authority Police Department Sgt. Charles Daniels, who was dispatched to the roof to bring Petit down, later reported his experience:

"I observed the tightrope 'dancer'—because you couldn't call him a 'walker'—approximately halfway between the two towers. And upon seeing us he started to smile and laugh and he started going into a dancing routine on the high wire....And when he got to the building we asked him to get off the high wire but instead he turned around and ran back out into the middle....He was bouncing up and down. His feet were actually leaving the wire and then he would resettle back on the wire again....Unbelievable really....Everybody was spellbound in the watching of it."

In 2007 the Bush Administration's Agriculture Dept (USDA) and APHIS agency started a program to aerially Spray untested, unwanted Pesticides on the California cities of (and wild habitats neighboring) Monterey and its Bay, Santa Cruz, Alameda, San Jose and San Francisco. This program is to "Eradicate" an innocuous Australian moth (the Light Brown Apple Moth, or LBAM) which has lived in California for at least "several years" and hasn't caused a single dollar's worth of harm - none. This is partially because the moth does not kill anything; it doesn't even defoliate trees or plants.

The USDA then had the US-EPA give overnight approval for California's Dept. of Food & Agriculture (CDFA) to conduct an experimental program to aerially spray cities with a new "Checkmate" Pesticide based on synthetic pheromones - every month until 2010 - but without ever testing the pesticide for harm or effectiveness. USDA then gave CDFA some $90 million dollars to conduct the spraying. CDFA has already crop dusted our Monterey Peninsula twice in 2007 and Santa Cruz once.

HOPE prepared a comprehensive 14 point litigation strategy in August, 2007. We filed our first suit on Sept 24, 2007 to stop aerial pesticide spraying and force CDFA to use non-spraying, non-toxic alternatives. We persuaded the court to halt the spraying for 2 weeks in September 2007. Our case was finally heard on May 8th (originally scheduled for March 7, 2008*). On May 12 we won the lawsuit, Judge Robert O'Farrell agreed with HOPE that there is no emergency and ordered the aerial spraying halted until an Environmental Impact Report is completed.

Update -- We Won - Spraying Halted !!!

Only a month after HOPE won our lawsuit, on June 19, 2008, CDFA and USDA conducted a joint press conference to announce they were abandoning the part of their program of spraying untested pesticides on cities and populated areas. The reality is somewhat more complex, but the aerial pesticide spraying of cities and children is over for the foreseeable future. (Watch HOPE's News column to stay up to date.)

Our Courts have now confirmed CDFA and USDA have systematically and intentionally deceived the public by falsely claiming that eradicating the LBA moth is not just necessary but an emergency -- even though the LBA moth does not kill anything; and it does not harm humans at all. University of California at Davis Pest experts say there is no evidence it does any more harm than its native relatives in California - essentially none.

The vital point is that -CDFA cannot document a single dollar of damage caused by the LBA moth to California's agriculture or ecosystems - even though the LBA moth has been here for years - and possibly decades ! One reason is the LBA moth is only a "nibbler" it is not a defoliator; even on the trees it prefers - it does not eat much of the leaves.

"LBA moths have been here for years and haven't done any damage, there is no emergency, eradication is impossible because the moths are too widespread, and genuine experts tell us aerial spraying won't work. For some businesses, hard times are boom times
Although it’s good for the bottom line, those involved in debt collection say it’s somber work

Times are tough for many Central Oregon businesses, but not as much for some.

“We are slammed,” David Hyder, a sales clerk at Bend Pawn & Trading Company Inc., said Friday. “This (last) week has been a crazy week. People are getting their paychecks.”

With their paychecks, customers can pay back the loans they received for goods used as collateral at the pawnshop — at a profit for the business.

The business has made a record number of loans but has seen its sales drop “just like everybody else,” Hyder said.

“Contractors are hurting,” he said. “People in general are hurting. Many have lost their jobs or are unemployed, and need loans for gas and food.”

Hyder had been a guitar repair person for a different business until about a year ago, when he decided to work in a recession-proof business, he said.

“I was looking for something that would remain steady no matter what the economy was doing,” he said. “This type of business seems to keep pretty even keel, whether it’s good times or bad.”

Businesses that are doing well during hard times are classified not as recession-proof, but as countercyclical, which means that during high-growth periods they might not do as well, said Timothy Duy, adjunct assistant professor in the Economics Department at the University of Oregon.

“There’s always somebody that is going to be able to take advantage of a changing market environment,” Duy said. “The ones that are going to be able to take advantage are closely aligned with the debt-collection industry.”

Business is booming at Central Legal Services, said Michael Long, vice president.

The Bend company performs processing services and evictions for several banks and landlords around the region.

The two-person business works with banks and trustees, who are usually attorneys representing banks, to deliver first notices of default after a homeowner hasn’t made a payment for 90 days, Long said.

In Deschutes County, notices of default, which are the first step in the process toward bank foreclosure, increased 249 percent through Oct. 24 from the same period through Oct. 24, 2007.

“Our job is to let whoever is there know that this house is going to be foreclosed,” Long said. “Sometimes it’s a renter. We tell them they might want to not think about signing a long-term lease.”

Long and the company’s owner, Eric Mathews, also act as auctioneers at the Deschutes County courthouse steps when a home goes into foreclosure, and they serve the eviction-notice papers after the bank or new owner has taken over the property.

“It’s kind of sad,” Mathews said. “It is great for business, but not much fun showing up at somebody’s house saying, ‘You have got to go.’”

Repossession businesses also are seeing an increase in activity, said Merrill Osborne, manager of Western International Recovery in Bend.

“My clients don’t want these rigs back,” he said. “Repossession is a last-ditch effort on the part of the lenders across our state and our community. They absolutely bend over backwards to work with their clients.”

I have not been able to track his explicit contributions to the OREO, as all his money goes directly to the DEM party.

We are headed into Great Depression II and drastic action similar to the New Deal is required to ameliorate it. (Notice I didn't say "avert it" -- we're past that point IMO.) And by drastic action I DON'T mean handing hundreds of billions of dollars to failed companies so their incompetent executives can continue to go on retreats to exotic resorts. I mean putting money in the hands of actual working Americans so they have money to spend ("priming the pump"). This could be accomplished through a massive public works program to rebuild our infrastructure, bring our Internet up to speed and develop alternative energy projects -- including, I might add, nuclear ones. (That was one of the few things John McCain got right during the campaign.) We could have accomplished a hell of a lot with the $500 billion or so that we just let the corporate pirates plunder and piss away.
