Let's start out with Becky, shall we?
I received an email from one Jakey-O, one proprietor of BendBlogs last Sunday, Nov 4. He said that "Becky Breeze" had been advised by her helper monkey to read the derisive horrors that Jake -- yes Jake -- had been writing about her on BendBlogs. It can be assumed that she clicked on a link, say... I don't know... "RIP Breeze & Wurzels' The Plaza, We hardly knew ye.", and became inflamed.
Becky did what any techno-tard would do, and I include my wife in that group, she sent Jake a bit of rebuttal mail via his blog submission form. Now folks, faking THAT sort of technological retardation is truly reserved for those who have absolutely NO IDEA how email & other rock-bottom internet technologies really work. Again, it's something my own lovely wife would do. Which is actually why my initial reaction was it was "How very sweet"! Really! It's like watching a young infant try to figure out a remote or something. Whenever my wife tries to surf the net, I end up giving her a hug & chuckling -- it's just so damn cute what she thinks is the right way to do things!
So upon receiving Jake's email, I KNEW this email from Becky Breeze was authentic. I knew it. I knew it was authentic for other reasons as well, but the manner in which he received it instantly validated it's authenticity, in my mind. You will also see that this is DIFFERENT from the comments left over on BendBB by "Becky". Without further ado, here it is (some formatting is mine, as her message was in plain text):

First of all I have been selling to the most poor and the most rich and mostly to everyone in between in Salem and Bend for 28 years. I have sold real estate with pride and with integrity and no one that can say anything different. My client base is loyal and appreciative of my experience and my loyalty to them.
Unfortunately for me and my wonderful husband in our ever changing market, we followed the request from a wide base of clients that said they needed one level condominiums that was not a retirement center. A place to enjoy and be secure but not be restricted to age in case their children or grandchildren want to stay. They did not want to rent a room from the retirement centers Bend developers were building and have to pay the $3000 to 5000 a month fee for a rental.
I kept thinking that would be a good idea but did not have the time. My husband retired from his real job and asked me what I wanted to do with the almost acre lot we owned. Of course I told him what my client base had been saying. This was 04. I had so many requests for one easy living one level condos from clients I told him that seemed what we needed to do.
We are environmentalists so we made sure we had the largest green roof this side of the cascades, all the clean water from the building goes through underground pipes to the river, all outside surfaces are no up-keep (cement,brick)so there will not be off gasses and maintenance. 33,000 sq ft of undergound parking so we do not impact the Old Mill as every else has.
I can go on but I will not. But call and I will fill you in. It is better for 42 families to be able to walk and bike to their businesses and recreation then it is for them to drive from the out lining neighborhoods. I do not know why you are picking on me and our project. I will be happy to walk you through personally or my crew is on duty daily from 12 to 5. Come by and have coffee. I am a nice person and I am sure you are too.

As I have said 100X, Becky really is a nice gal. And I'll say it again, Becky Breeze is a sweet, well-meaning gal. OK?
But there are a few bothersome little details here that throw a chink in that sweet little armor. First, the idea that Becky asked OR received client recommendations about a "one level condominiums that was not a retirement center", is patently absurd. Those words have never been uttered before in World history.

OK, did not happen. Condo's are built for ONE REASON, and one reason only: So OLD PEOPLE can be entombed and get used to CASKET LIVING as soon as possible. What Becky REALLY should have spent money on is some sort of rocket-propelled modular stacked dumpster that shot condo-dumpster units directly into the Deschutes River when geezers die, ala Spock in "Start Trek: The Motion Picture". I'm sorry Becky, but self-serving tripe Bullshit like that will get you mowed down here. Cut the bullshit.
Becky is also invoking The Whole "I'm Green, Lookie At Me!" Enviro-Nazi, Cloaked Corporate Greed bullshit marketing angle, which will actually be revealed for what it is: Plain old cost cutting.

Now, long about last Monday, Becky figured out BLOGGING, to the extent that is possible, and dropped a note on BendBB's door. I never saw the original, as it was deleted. Duncan asked:

Finally, at 8:03PM the Unwaveringly Correct Voice of Reason, BendBB, imparted from High On Mount Sinai, a message he brought down burned into 2 rock tablets:

The imputence! That "Becky Breeze" character was soon going to be shown what it's like to tangle with The Unshakable Resolution Of BendBB, a man who has NEVER in history been proven even REMOTELY INCORRECT. EVER. But still, the UNBELIEVERS CONTINUED. Another CONTEMPTUOUS "Guest":

OK, now on to Juniper Ridge, the fuckin story of monumental Bend City Councilor INCOMPETENCE that just won't DIE! "bruce", a former Unitarian Polygamist from Sandy, UT apparently poked his arm up the public records rectum of this one-horse shithole, and pulled out the Purchase Agreement for Les Schwabs "Gone In 60 Seconds" negotiation of buying a little hunk of JR back when we were all suckling at Mommies teet. He said:
"Some Shwab purchase info, at last: 12 acres for $3,000,000, or a price of $250,000 and acre. We have a comparable!"
I saw in a recent Bulletin piece that a "Worst Case Scenario" was that the initial build out to make LS feel comfy cozy in JR was $12,600,000. Garzini added as an aside that this figure included a $2.5MM payout directly to Kmart for Holz-tek's light blue polyester leisure suit account.
So, doing a quick calculation yields a KICK ASS -76% return on our first Juniper Ridge deal! YEAH! We're on our way! At this rate, we should be bankrupt by Christmas. Good job Bend City Councilors! They clearly perceived that when LES SCHWAB Legal ROBOBOTS walked in and DEMANDED that they be sold Juniper Ridge land, the property of the City, that they as City representatives HAD NO CHOICE but to sell for 1/4th the cost of simply providing infrastructure (like a fuckin driveway), and that essentially counts the land as free.
But even better, is that "bruce" found this little nugg:

Look what Les Schwab got out of it. 100% control of Juniper Ridge in perpetuity.
This just goes to show that if you want to Get 'Er Done in Bend Oregon that you need to understand what Holzman, Kuratek, and Dick Borgman knew long ago: If you walk in a City Council meeting with a Take No Prisoners attitude, you can pretty much steal any fucking thing you want from this town. "Proper Channels"? "Paperwork"? That shit is for LOSERS! In Bend, we don't roll like that. The trusty graft-ridden Old Boy Network. That GUARANTEES the job will get done right on time & ON BUDGET the first time. Like them fuckin CRIPPLE RAMPS that came in at a mere 2,000% over budget, and were STILL BUILT WRONG.
My God. The INANE incompetence and graft that IMBUE every motherfuckin cubic centimeter of this town is truly mind boggling. As I said a long time ago, BendBuster is one crazy fuckin raving lunatic. But in this place, that's exactly what MAKES SENSE. The fuckin craziest shit ever conceived doesn't quite characterize Bend, because we do shit WEIRDER THAN THAT.
I get a little chuckle that my own overwhelming pessimism about Bend was actually understated because it was built on the faulty assumptions that we have "nominal" leadership at the top. So DEAD WRONG. Now that resources are drying up, the Old Boy Network backbone is starting to cannibalize itself. Graft, the fundamental method of Bend power structures, is falling apart because MONEY is going bye-bye.

Now I want to finish up with todays Bulletin piece, on what I humbly call The Most Important News Story In Bend History, The COLLAPSE Of The LOCAL Real Estate Market. In "How builders plan to face housing slide", inscrutable super-reporter David Fisher described Brooks Resources recent "auction" of 3 RiverWild condos thusly:
"It was a bit of a bust. Only one of the three sold, and at the minimum bid — more than $200,000 below list price.
The other two attracted not a single offer."
Huh? "A bit of a bust"? You must be kidding! They actually SOLD one of these dogs to some moron at THE MINIMUM! My God, that's 1,000,000X better than I would have hoped for. Makes me wonder if the single "buyer" was in fact a plant. So, sure some blog-site's use these 'tools'. I have used them, but its Quite Trivial to OPEN a fucking blog-site in the HTML mode, and read the HTML to see if your opening that page has caused a log.

Frustrated by a season of sluggish sales, Brooks Resources Corp. put the last three unsold townhomes in its prime RiverWild subdivision at Mt. Bachelor Village up for auction Nov. 2.
It was a bit of a bust. Only one of the three sold, and at the minimum bid — more than $200,000 below list price.
The other two attracted not a single offer.
That, for Central Oregon’s largest land developer, was a sign of the times.
Sales in all of Brooks’ most active developments — IronHorse in Prineville, Yarrow in Madras and NorthWest Crossing in Bend — have come in well below projections this year, Brooks CEO Mike Hollern noted Wednesday.
Now, with an overhang of unsold inventory glutting the housing market — the aftermath of a three-year boom run amok — Brooks, along with some of the region’s other large builders and developers, is trying to adjust to a slump that Hollern believes may last another two years.
Whether the downturn lasts that long, or is shorter or longer, of course, is anyone’s guess. Ask the executives at Pahlisch Homes, for example — the region’s
largest homebuilder by permit volume — and you find more optimism for late 2008.
But Hollern’s 40 years of experience in the local housing market is telling him to tread cautiously through the minefields.
“I wouldn’t be about to predict that we’re at a bottom,” Hollern said. “I know that’s not what the real estate community likes to hear. But the problem is, you don’t know when the top occurred until after it’s there, and you don’t know the bottom has occurred until after you’ve been through it.”

A friend bought a place in Bend three years ago (their family has a long-time business in Bend and they went to begin slowly taking it over). They bought a reasonable house (1700 sf) in a new development for a price in the low 300s. There are now seven houses for sale on their street, all empty, all stuck flippers. The CC&Rs forbid renting the houses, which has the flippers hugely upset, as you might imagine. I'll speak with my friends soon and post an update.

In the post you declare that the Royal-Bruce reported that Les Schwab paid $3M for Juniper Ridge, when in fact I reported from this October meeting. ( See below ) Bruce later commented on my number. To date the Royal-Bruce has never actually provided any reference to source material.
Right now supposedly in Nov/Dec Les Schwab funds the $3M, which is going to Kuratek, then there will be a bond issued in Dec to cover the Knife-River ( Hap Taylor ) $6M drive-way to Les Schwab.
Note below the $3M for Les Schwab is 'expected' in Nov/Dec, my guess is that KURATEK wants to sooner, the longer this plays out, the more likely something will go wrong.
Like everything, we'll probably have to wait for the Oregonian to report this story, note it took the BULL a full two weeks to report after the Oregonian that the BendBubble had popped.

But here's the problem: Your ISP still sees what you're doing, and they would be glad, most of them, to hand over info about their customers hitting the proxy at a certain time. You can get around that with some effort, but not if you want an interactive session.

There are 1,000's of external proxy's out there, and BENDBB has only banned about 500 of them from his site.
I agree, that if you search long enough, and test long enough you'll find an anonymous proxy that will work for most things.
For instance a very tough nut to crack, and I'll not give up that proxy location, but try and post at the Source using most common anonymous proxy's, they seem to have the IP list banned for submitting. Normally, its just a matter of allowing cookies to be enabled.
There are many ways to verify that your IP is not being seen by the host your contacting.
To me the most dangerous thing is running these JSP's like that are on the glory-holes BB ( log.jsp ) , these are protected 'java-scripts', they can be analyzed but not easily, at least google lets you see their javascript as .js ( urchin.js ). When you visit sites like BendBB your running computer programs that can solicit all kinds of information from your machine.
On this subject its still very easy to get a proxy, go on BENDBB's site, alias yourself as anyone you wish.

If your worried about being anonymous move about in Bend, or go up to Redmond for a day, and post. Most library's have wifi, all the brew-pubs. That with a proxy is very difficult, always be cash when your there so there is no time-stamp of you being there.

Merrill Lynch & Co. predicts either the United Arab Emirates or Qatar will cut their dollar peg within half a year. Standard Chartered Plc says the six Gulf Cooperation Council nations need to raise the value of their currencies 20 percent. The difference between the price of the Saudi Arabian riyal and the cost of buying it in a year using forward contracts has widened 10-fold since October as traders bet the kingdom will sever its 21-year-old link to the dollar, according to data compiled by Bloomberg.
``The dollar peg is doomed,'' said Jim Rogers, chairman of New York-based Rogers Holdings and a former partner of hedge fund manager George Soros.
The gulf countries, which supply 22.2 percent of the world's oil, according to BP Plc, are under pressure to abandon their fixed exchange rates after the dollar tumbled 10 percent against the euro in 2007. OPEC members Venezuela and Iran want to price more crude in other currencies. Inflation in the region is accelerating at the fastest pace in at least five years because central banks follow U.S. Federal Reserve policy.
The ties are already weakening. Kuwait dropped the dinar's fixed exchange rate in May and it has strengthened 4.5 percent.
Saudi Policy
U.A.E. central bank Governor Sultan Bin Nasser al-Suwaidi said last week that his country, a federation of sheikhdoms, may change its policy. The plan is ``not to drop the dollar peg but maybe to reduce it to a basket which will consist of more dollars, but not totally 100 percent,'' he said in an interview in Gwacheon, South Korea.
Gulf states will jointly discuss a proposal to revalue their currencies at a summit in Doha, Qatar, on Dec. 3-4, the secretary general of the Gulf Cooperation Council, Abdul Rahman al-Attiyah, told reporters yesterday in Riyadh, Saudi Arabia. Bahrain, Oman and Kuwait are also members of the council, known as the GCC.
Saudi officials rejected a suggestion by Iran and Venezuela to discuss ending the practice of pricing crude in dollars at an Organization of Petroleum Exporting Countries summit in Riyadh yesterday. The declining dollar's effect on oil revenues overshadowed Saudi attempts to highlight environmental issues.
``The dollar is in free fall, everyone should be worried about it,'' Venezuelan President Hugo Chavez said yesterday. ``The fall of the dollar is not the fall of the dollar, it's the fall of the American empire.''

The GCC hasn't been given new incentives to preserve fixed rates other than statements by Treasury Secretary Henry Paulson that the U.S. supports a ``strong dollar.'' The government hasn't intervened in the market to influence exchange rates since September 2003, the Federal Reserve Bank of New York said in a quarterly report to Congress on Nov. 8.
`A Dangerous Game'
U.S. policy makers are ``playing a dangerous game by allowing the dollar to depreciate so much,'' said Phil McHugh, a trader at Currencies Direct Ltd., an investment management company in London that oversees $2 billion. GCC officials would make ``a big statement'' if they revalue, he said.
If the GCC weakens its ties, oil producers will have less reason to recycle their revenue into dollar assets. OPEC members increased their holdings of Treasuries by 14 percent this year through September to $125.7 billion, Treasury data show.
Petroleum exporters are buying U.S. bonds three times faster than other foreign investors, the data show. Yields on 10-year notes are 21 basis points lower because of petrodollars, New York-based consulting company McKinsey & Co. said last month. A basis point is 0.01 percentage point. The 10-year note yield was at 4.16 percent.
``Government institutions and residents would likely move assets out of dollars into alternative currencies,'' said Tristan Cooper, senior sovereign analyst for ratings company Moody's Investors Service in Dubai.
Peg `Review'
The widening difference between prices for riyal and dirhams in the so-called spot market and the cost to buy them in a year shows traders expect the links to weaken.
Contracts to buy dirhams in 12 months rose 0.6 percent on Nov. 15, the most in 10 years, after al-Suwaidi, the central bank governor, said the dollar decline will trigger a ``review'' of the peg. The contracts traded at 3.58 per dollar today, compared with the currency's spot market rate of 3.6713, according to data compiled by Bloomberg.
The Saudi riyal rose as much as 0.8 percent to 3.7118 today, its biggest one-day advance since 1989, before paring its gain to 0.2 percent. Contracts to buy riyals in 12 months time rose as much as 0.9 percent to 3.66.
Saudi Arabian Monetary Agency Governor Hamad Saud al-Sayari said in an interview in Kleinmond, South Africa, yesterday that the issue of revaluation had been discussed by Gulf central bank governors a few weeks ago and ``we came up and said `no change in policies.' That is the agreement of the whole group.''
Wealthier Than Ever
Oil exporters are wealthier than ever after prices more than quadrupled since 2001. Crude averaged about $20 a barrel in the previous two decades. The IMF forecasts 5.6 percent economic growth in the gulf region for 2007, almost triple the 1.9 percent in the U.S.
Saudi foreign currency reserves increased 26 percent in the year to Sept. 30 to 969 billion riyals ($259 billion), according to the central bank. The U.A.E.'s reserves jumped 65 percent in year ended in June to 159 billion dirhams ($43 billion).
Faster growth and rising import prices caused by the sinking dollar are spurring inflation. Saudi Arabia's consumer prices rose at a record 4.9 percent pace in August, after averaging less than 1 percent over the last decade, government figures show. Inflation quickened at a 9.3 percent rate in the U.A.E. last year and reached an all-time high in Qatar of 14.8 percent during the first quarter.
Fed Rate Cuts
Gulf central banks can't raise borrowing costs to cool their economies because they must follow the Fed to maintain their pegs. U.S. policy makers reduced the target rate for overnight loans between banks twice since September to prevent the worst housing slump in 16 years from dragging the economy into recession.
``We will have more rate cuts by the Fed, more dollar weakness and probably still higher oil prices,'' said Hans- Guenter Redeker, head of currency strategy in London at BNP Paribas SA, France's largest bank. The chances that GCC nations get ``into a kind of boom-bust scenario is increasing, so it's urgently required to change that mechanism,'' he said.
Any shift to a floating exchange rate would hurt petrochemical and non-oil manufacturing exports, said A.F. Alhajji, an energy economist and associate professor of economics at Ohio Northern University in Ada, Ohio. Saudi Arabia will be reluctant to make pilgrimages to Mecca more expensive for the world's Muslims, he added.
Political Backlash
``Politically, there could be a backlash,'' he said. ``The people who will benefit the most will be foreign workers in Saudi Arabia.''
The dirham link was picked by 11 of 15 strategists and fund managers in a Bloomberg News survey as the most-likely to break. Qatar's riyal was chosen by three analysts and the Saudi Riyal by one. Bahrain's dinar was one analyst's second choice.
Gulf central banks are already preparing for an exchange rate regime that doesn't require dollars to defend.

I paid 23% more than 2001 buyers paid for the same house I bought in the same neighborhood when I bought in 2004. By spring of 2006, the house was up another 39% above what I paid. Murphy Road project, others in Bend could cost city $40M

Creating an overpass for Murphy Road across U.S. Highway 97, along with several new roads and new highway ramps on the south side of the city, would cost a total of $40 million, officials told the Bend City Council on Monday night.
City officials are confident that they can get moving on the project within a couple years by collecting funding from a variety of sources.
Rough plans call for starting the realignment of Murphy Road on the east side of the parkway. The project would start just west of Parrell Road before crossing over and connecting with Brookswood Boulevard on the west side.
Under the plan, the Oregon Department of Transportation would remove the signals on Highway 97 at Pinebrook Boulevard and at Southeast Third Street.
A new set of ramps, including a flyover, would connect Third and the highway on the south side of the city.
“This is just a very positive way to approach problems where everybody is trying to come up with solutions and everybody is going to win in the end,” Councilor Chris Telfer said after a presentation of the plans at a Bend City Council meeting Monday night.
The city is working with ODOT and WinCo Foods, which plans to build a store in the area, on the traffic improvements. In the near future, the current signal at Third and Highway 97 would get a temporary fourth “leg” so that drivers could reach WinCo, which would be on the west side of the highway.
ODOT could pay as much as $15 million of the project’s cost, Bend Public Works Director Ken Fuller said, because a portion of the project involves improving the highway. The costs of an overpass and new local roads could be paid with a new urban renewal area in that part of the city.
“There’s plenty of money we believe, but we’ve got sequencing and phasing issues of how we build projects and pay for them,” Economic Development Director John Russell said.
By next month, officials plan to come back to the City Council with more specifics, including a construction timeline. Russell suggested Monday night that an urban renewal area could be created as soon as next August. That would give the city the ability to get several million dollars in bonds within about a year.
In other business, Juniper Ridge Special Projects Manager Ron Garzini presented the first draft of a work plan for the 1,500-acre mixed-use project. The plan is a large bar chart showing the various phases of construction and significant road work nearby, such as improvements to Highway 97.
“As we begin to firm up dates, timelines, commitments, contracts, we’re going to add them into the work plan,” Garzini said.
The chart places the beginning of construction of an interchange at Highway 97 and Cooley Road in mid-2009. That project would not be complete until 2011, under the draft work plan. The chart assumes that construction of a long-term reroute of the northern section of Highway 97 would not start until 2016.
The plan also proposes putting parcels of Juniper Ridge land up for sale in mid-2009, though city officials agreed that could happen sooner.
“It’s entirely possible, in the middle of 2008, that we could sell property,” Garzini said.

Asked whether the Juniper Ridge controversy had influenced his vote to fire Anderson, Councilor Jim Clinton replied: “Basically that was a very minimal consideration, because as much as a year ago, when [Councilor] Mark [Capell] and I got involved in working on the DDA, Andy was not directly involved anyway. We kind of decided that since the council ultimately had to approve it [the DDA], it was logical to have a couple of councilors have a go at it.”
Although he and then-Councilor John Hummel were the fiercest critics of a controversial closed-door deal with Les Schwab to sell the giant tire company land in Juniper Ridge for its new corporate headquarters, Clinton also denied that was a factor in deciding to remove Anderson.
“I’ve softened up my position on that quite a bit, because Andy was caught in a very bad position because Les Schwab was insisting on a very high level of secrecy,” he said. “Since that came down we got to know the Les Schwab people better and understand they were kind of in a tight spot themselves. That basically did not play any role in the decision to terminate Andy’s contract – at least not for me.”
And Clinton said the city’s decision to buy eight second-hand buses for Bend Area Transit that turned out to be lemons also wasn’t a significant factor.
“For me it was a very minimal factor – minimal to very low,” he said. “I consider it a mistake, but that sort of thing happens in a big organization. I think Andy did what he could to set in place some new procedures so that kind of thing wouldn’t happen again.”
Clinton, fellow Councilor Peter Gramlich and Mayor Bruce Abernethy also said they don’t believe Anderson’s departure will make much, if any, difference in how the Juniper Ridge saga plays out.
Abernethy said he doesn’t think Anderson’s firing will make “one iota of difference” for Juniper Ridge. Asked how great a role the Juniper Ridge controversy played in the Anderson firing, he answered: “I think the city has clearly faced a number of challenges, certainly over the last nine to 12 months, and that was certainly one of them. I don’t necessarily think I’ve done the best job in some areas. I think there’s plenty of responsibility to go around.”
“I don’t see any effect whatsoever on Juniper Ridge” from Anderson’s departure, Clinton said.
“I don’t think so,” said Gramlich when asked whether removing Anderson will make any difference. “Obviously a city manager plays some role, but my first reaction is no.”
The departure of Anderson doesn’t look likely to silence the Juniper Ridge critics either.

With the acute shortage of light industrial land in Bend pushing prices to 25-30% higher than any other community in Oregon and considerably higher than other larger communities in neighboring states, EDCO has been carefully monitoring and participating in, to the best of our ability, progress on the city-owned property called Juniper Ridge. Twenty years ago, this land was deeded to the City of Bend by Deschutes County for future industrial use. The project started in earnest back in 1999 with an industrial land inventory study and comprehensive search for properties most attractive and logical for development into employment lands. For many reasons, Juniper Ridge was selected as the area for Bend’s future light industrial, business and high tech development. Over the period of 2003-2004, a master plan for Phase I and Phase II of Juniper Ridge was developed by a group of local, regional and state experts in transportation, urban planning, economic development, as well as planners from the city, county and special districts. Last year, the City went through a RFP/RFQ process to select a master developer from the private sector to implement the vision of the master plan. Also in 2005, the City successfully established the Juniper Ridge area as an Urban Renewal District with the authority to raise $40 million to pay for on and off-site improvements including all utility extension and road improvements. Since the selection process, a small number of City staff have been working on an MOU with the developer, represented by Ray Kuratek, who has residential and office park development experience in California.
Details of the MOU negotiations have been few, and rumors are circulating that the City and master developer are planning a mix of residential and other non light industrial/employment uses for the first phase of the project. The Bend Chamber of Commerce and other local business leaders have openly expressed their opposition to this idea, and EDCO is also not in support of further conversion of light industrial land anywhere in the tri-county area to other uses - especially at Juniper Ridge which currently has all of Bend’s future supply. We expect the Juniper Ridge development plan to receive considerable discussion at upcoming Bend City Council meetings and to receive more press in the weeks ahead.

No system is perfect. IP banning is common (it's built into Drupal). It's there for a reason. There are people that will try to attack and ruin any system. If you want any control over the content, you have to make some sort of policy. I've never seen a rational one. I've watched many of them, from Motley Fool to Fark, try to figure out how to deal with it.

What people in this town wanted all along was to follow the rules. All the smoking gun's are now publicly available. It is a MYTH that Juniper Ridge is 'dead' the project is alive and well, and Les Schwab has taken control. For a price of $3M, they get $40M in in infrastructure for free. They pay NO SDC's.
The Juniper-Ridge Deed makes it clear that the Juniper-Ridge was to be an open process, it never was. The Deed says land was to be not sold until the final master-plan was approved by the public, this never was.
The Deed and sale of Juniper Ridge is above. All the Garzini/Kuratek business is a sideshow.
Garzini gets $333/day, and Kuratek gets $2,000/day, neither want any of this to end anytime soon.
Your correct HBM, there will be no Juniper Ridge as envisioned by the County in 1990, instead what we got is Les Schwab Urban Renewal Zone, where a tire-flipper got full control of 1500 acres for $3M.
The $3M is in effect a final compensation package for Kuratek. Paid by Les Schwab. In effect Les Schwab got ALL of Juniper Ridge for free. No big deal here, the City only paid one dollar for Juniper Ridge.
To suggest that ALL this transpired because it was the 'citizens' plan is ludicrous, this all transpired because of secrecy and fraud, on the behalf of the most powerful people in the city.

The documents from the last council packet state they expect to receive $3M to $3.2M from LS. Then they can say "LS is too paying SDCs!"

The city council was called into a meeting on a non-meeting day, the public thus wasn't present, they went into executive session, and Anderson told them that Borgman of Les Schwab was buying Juniper Ridge. They had one hour to ALL vote yes on the deal, and read the 32 pages ( http://www.juniper-ridge.info ). If anybody here, actually has the stomach to go read these 32 pages, they'll realize that no mortal, could have in a stressful heavily armed meeting with one hour to read, debate, ... To do anything other than mea-culpa, go with the dictator you know.
That same day KURATEK found out about the deal and went crazy, as this completely destroyed his master-plan, as it meant nothing, as Les Schwab was exempt, and had final say over all aspects of Juniper Ridge.
It all comes down to BAIT&SWITCH. There never was any intention of developing Juniper-Ridge according to the DEED ( posted above ). At the day of the dec 12, 2006 city-council didn't even know that the a bait&switch had taken place, the process so outraged Hummel that he resigned. In April 2007, Les Schwab inserted their own CC&R's into Juniper Ridge.
Why has Kuratek been paid $2,000/mo since 2005?? The money to get rid of him is authorized and is coming from the $3M from Les Schwab when it comes. To date Les Schwab has only ante'd $35k.

There are several ways of looking at Juniper-Ridge: The Outcome - Which is "Les Schwab Urban Renewal Zone".

Kuratek was played the fool, and brought in to develop the master-plan, and then be sent on the road, so that the land could be quid-pro-quo, transferred lock, stock, and barrel to Les Schwab ( Most likely scenario ). In which case, Mr Kuratek, has the right to sue for not only lost time, but major damages. The JR Deed required a master-plan, the City would have never gotten away with stiffing a major Oregon player like Trammel-Crow, but they could get away with stiff Ray Kuratek, so they thought.
2.) That that the City Council wanted University's, and beautiful green buildings, and a world class Industrial zone, as praised by Hummel. The problem was that Anderson ( city manager ), and EDCO, and Borgman of Les Schwab had other ideas, and in Bend the elected City Council have NO real power. The City wasn't just hiding the truth about Juniper-Ridge from the public, they were hiding the truth from each other, and this is the reason the taxpayer is going to get hit with a +100 Million dollar bill, with NOTHING in Return.
Now, this is quite confusing, as City Council was "Shocked", I'm talking Humphrey-Bogart/Casablanca Shocked, when on Dec 12, 2006 they discovered that Juniper-Ridge had been sold to Les Schwab, but the November 15, 2007 "attachment' in the PDF for the Juniper Ridge sales is clearly marked with the City Letterhead and dated November 15, 2006.
This was interesting enough, that I assumed we need to get it on the record. Note the DUBYA parasites, are forming a national league to ban SDC's, as they feel that new homes shouldn't have to pay for infrastructure. It's the same logic that's being used with Les Schwab, $1.8B/YR company shouldn't have to pay SDC's for its new campus.
Bend has an exceptional SDC problem here, because of the rock, its very expensive to lay water/sewer for new developments. This article is just bait&switch, as even I agree this shit shouldn't be applied to single homes in the boony's.

Rankles New-Home Buyers

When Jonette Banzon and her husband, Muhammed Ahmad, sought to build a home in Elk Grove, Calif., outside Sacramento in 2004, the city made a surprising demand: To get a building permit for the approximately $500,000 home, the couple needed to pay $240,357 for road improvements around the rural property.
While the city reduced the fee -- calculated using historical data on the costs of building sidewalks, drainage systems and other street projects -- by about 40%, the couple still sued.
"I didn't expect [the fee] would be half the price of the house," said Ms. Banzon. Elk Grove settled with them last year by capping the fee at $9,750, an amount similar to fees paid by home builders in the city's suburban areas.

While few rocket into six figures, impact fees such as those faced by Ms. Banzon and Mr. Ahmad are popping up in a rapidly expanding number of cash-strapped U.S. municipalities scrounging for new revenue sources while federal funding for local infrastructure has become more difficult to obtain. The one-time fees, imposed on builders and often folded into home prices and passed on to buyers, are used by cities to fund construction of infrastructure such as roads, sidewalks, parks and even fire stations for rapidly growing neighborhoods. A 2006 Kansas State University survey found that 39% of the 292 U.S. cities responding imposed impact fees on new construction last year, up from 25% in 2002.
The fees also are increasing in size in cities that have used them for years. A survey this year of 152 U.S. municipalities by Duncan Associates, an Austin, Texas, consulting firm that tracks impact fees, found that the total charged in impact fees rose by an average of 77% from 2003 to 2007 as those governments used them to pay for additional projects such as firehouses and libraries.
With the residential real-estate boom now over in many states, the extra cost of those fees stands to draw more scrutiny from price-sensitive buyers of new homes. That could translate into more lawsuits in cases like Ms. Banzon's. "It would not shock me to start seeing some increased legal friction in this area," says David Barron, a Harvard Law School professor specializing in local-government and property law.
Property-rights advocates decry impact fees and other so-called exactions -- requirements to donate land or make concessions to gain a government permit -- as a means for local governments to avoid unpopular tax increases for all residents by singling out new arrivals to pay for city projects. Proponents say that impact fees are the fairest way to make growth pay for itself. "If these folks are going to create an impact [on city services], they ought to pay for it. That's as logical as it gets," says Mac Burdette, town administrator of Mount Pleasant, a South Carolina town imposing fees of $1,700 on new homes to finance new roads, parks and sewer lines. Mount Pleasant began charging the fees in 1987 and has increased them since.
Impact fees add roughly $10,500 on average to the cost of new homes in cities that impose them, according to Duncan. They range from $26,392 on average per new home in California to $9,939 in Florida -- two states that fund school construction partly through impact fees -- to $861 in Missouri, according to Duncan.
Legally, most impact fees are defensible. Federal-court decisions dictate that public projects funded by an impact fee must have some relation to the private project paying the fee, and the fee must be proportional to the private project's burden on public resources. Even so, lawsuits challenging allegedly onerous fees aren't rare.
In July 2004, Ms. Banzon, now a 41-year-old accountant and recent law-school graduate, and her husband, a 53-year-old accountant, bought a vacant lot in a rural pocket of Elk Grove. They envisioned a five-bedroom, Mediterranean-style house double the size of their previous home. Acting as their own general contractor, they hired subcontractors, an architect and an engineer. As Ms. Banzon navigated Elk Grove's planning and public-works departments, she learned of the six-figure fee for road improvements, tree relocation and a dozen other items.
Ms.Banzon wrote to the city council and the mayor. She appealed the fee as too large for her project, and the city reduced it to $142,715. Ms. Banzon then enlisted attorney Meriem Hubbard of the Pacific Legal Foundation, a Sacramento-based law firm specializing in property-rights cases, and sued the city in December 2005. The sides settled last year, with Elk Grove reducing the impact fee to no more than $9,750. Soon after the settlement, Elk Grove discontinued the impact fee for all rural construction.
"It was a lot of hard work," says Ms. Banzon. "But in the end, I felt vindicated." Weary from the legal battle, however, Ms. Banzon and Mr. Ahmad still haven't built their 4,460-square-foot home.
Jim Estep, interim city manager in Elk Grove, said the city revamped its impact fees last year due partly to Ms. Banzon's lawsuit. The city realized that its previous system for calculating impact fees failed to take into account that rural lots have street frontages sometimes four times the length of urban street frontages, and thus fees for rural lots shouldn't be determined with the same formula. "We had to recognize that or nobody could ever afford to develop their property," Mr. Estep says.
Pacific Legal Foundation is representing plaintiffs in several cases involving impact fees and exactions: A contractors association in North Port, Fla., sued the city in October to repeal an impact fee that funds repairs of existing roads, arguing that maintenance of existing roads isn't a need created by new development. Officials counter that much of the deterioration of the rapidly growing city's roads is caused by construction vehicles. The case is pending.
Still other cases involve concessions of rights or privileges. Carlsbad, Calif., residents Craig and Robin Griswold sued the city last year after it imposed a $114,979 impact fee for future sidewalk and gutter construction as a condition for granting a permit to add a second level to their house on a rural lot. But the city offers homeowners seeking to expand or substantially renovate their rural homes an option to postpone the payment: They can forego the up-front fee and obtain a building permit by agreeing to waive their right to vote on future street-improvement projects in their neighborhood. More specifically, they must forfeit both their vote on the future formation of any improvement district in their neighborhood and their vote on any assessment against their house up to the amount of their original fee for those improvements.
City officials say the waiver allows applicants the flexibility of deferring the cost of road improvements until their neighborhood votes to undertake them. The waiver also transfers the payment obligation to any new owner of the house if it is sold. The city's aim is to preclude residents who get the benefit of a building permit from later holding out when the neighborhood opts to pay for installation of curbs, gutters, street lights and the like on its streets, says city attorney Ron Ball.
Mr. Griswold, a 62-year-old defense lawyer, pleaded his case with city officials but got no relief. "Trying to deal with them was one of the most frustrating things I've dealt with in my life," he says.
The Griswolds eventually acquiesced, signed away their vote on the assessment-district matter and built their addition. They then sued to challenge the agreement's validity. The lawsuit labels the Carlsbad ordinance a "poll tax" that violates the 14th Amendment by forcing residents to pay exorbitant fees or forego their votes on certain matters. A judge dismissed the case in September, reasoning that the Griswolds hadn't yet been denied their vote because no assessment district had been proposed. The Griswolds are appealing.

Go to any meeting in Central Oregon during the past five years, and you'll not find anyone that cares about the environment. This summer at all the county/city meetings I attended 99% of speakers only cared about getting their piece of the action. Generally I only count less than five people in a meeting of 500 where they actually are there for environment, infrastructure, or sustainability.
99% of all of Central Oregon has become get rich quick, and get out. All elected positions have been filled with 'potted plants' funded by the richest developers in the region.
Then you have the economy collapsing, which means even the Forest Service feels the pinch. ODFW? There's NO money there. Perhaps up to the late 1980's there were lots of environmentalists in Central Oregon. They're gone today, or simply don't bother anymore. I feel its very intimidating to go to any meeting whether in Bend or Prineville and testify on a issue, not having to do with pro-development.
How do we get out of this mess? The pendulum has swung in central oregon to conservative for years now, the rush limbaugh 'wise use' crowd controls ALL, and by that I mean ALL.
We simply have to wait for the pendulum to swing back, will there be anything left?
Personally I think the problem is that environmentalists were never strong, that's why Edward Abbey's ideology started earth-first, but FBI agent provocateurs have destroyed every activist environmental group in Oregon. Today in Central all we have is "Oregon Land Watch", which is really just a few lawyers running a 'green agenda', and as we all know 'green' was co-opted long ago by US corporations.
Solution?? There's really only one that I have seen for years, go buy your little 10, 20, 50, 5,000 acres whatever you can afford, and create your own wild-life preserve, and watch it like a hawk. Public lands will all be destroyed, and so will most private lands. Folks that care must invest themselves. Collectively groups could buy Millican to protect, but the problem is down the line some trust will just sell it to a developer. Such is the way in todays Oregon.

Council 'claims' they didn't know Les Schwab had bought Juniper-Ridge until dec 12, 06, and Kuratek claims he didn't know either until the day. Yet this map at the back of the sale-agreement clearly shows the city had drawn up all the plans as early as November 15, 2006.
My humble opinion is that there was never any intention of implementing Kurateks master-plan, he was used all along, and I mean 'used' as a scape-goat to take attention off the secret Les Schwab buyout of Juniper-Ridge. Anderson could get rid of Kuratek, and thus they brought Garzini the "Terminators" in as the 'fix-it man'.
One thing is for certain, on Council Capell knew all along what was going on, and Anderson was the major 'fix-it' man. Why didn't Capell tell other council members prior to Dec 12, 06 that Les Schwab was going to be controlling Juniper-Ridge and that their sales contract would make them perpetually exempt for all time of any master-plan.
Where in the Juniper-Ridge Deed does it say that you can Sell the land and make the BUYER exempt from the Plan?
Bend City Hall, Staff, and Administration is severely broken, and we had better fix it before it costs 100's of millions of dollars. To date Kuratek has a very good argument for suing this city for ten's of millions of dollars for damages. Once Kuratek deposes Anderson, and Hummel then its going to get really ugly.

Honestly, who buys used stuff without a FULL mechanic,... I own heavy equipment, and I can tell you when I buy equipment, we take samples of ALL Fluids to Halton, and they analyze the stuff, and then and only then do you make a purchase. We're told that the city did nothing! These days with oil samples you can look at all metals at parts per billion, and presence of each metal tells you everything about the engine, and the drive-train is the same, ...
I'm sure the city has no basis, the point here is that the seller, just won the right in court to depose the city staff! But the judge "hogan' ruled they can't ask 'legislative questions', ... I'm sure there's enough public doc, to create a lot of fodder for the attorneys representing the bus company.
Nobody ever wanted the buses, except the city, they had to get big buses, they wanted to get federal matching dollars, .... I wouldn't be surprised if this whole thing was Get Federal Cash today, buy buses that you know are bad, and defer payment, .... this whole thing is just too weird.
This whole thing stinks to me, like somebody intended to buy junk, probably just to get it in place, then do a mea-culpa, and get new nice stuff on the next cycle, when they could force it on the public, more than likely the BAT-MEN never wanted the used buses in the long term in the first place.

This interesting because 'all' council deny's knowing about deal until Dec 12, 06, certainly Capell Knew. Some knew there was a buyer, and some knew it was 'Schwab', but in the Dec 12, 06 minutes all are 'shocked'.

Note that the actual zone change didn't occur here in reality until April 07, the same day that the city bought boyd-acres from Hap-Taylor ( Knife-River ).
Big status report coming out today, I was up a Juniper Ridge this AM and took dozens of pictures.
The most interesting 'disturbing' finding was they have destroyed all surrounding outcroppings to build what I'm calling MT-BORGMAN. This is a huge mtn, acre plateau, +20 feet off ground, made of 3 ft rock, certainly going to be the sill-plate of Borgman-Towers. From this plateau you can see everywhere in Central Oregon, the view from their completed building will be as good as Powell Butte.
What is interesting is that they're digging a well for water, the under-ground power is not completed.
YOUR sales agreement says that the land is to 'shovel' ready, but nowhere did I see a description for building a mountain, this alone is a million dollar job. Who in the hell is paying for this? Where is the description?
The work to date is exactly like the 'map' dated Nov 15, 2007.
No signs anywhere, there really don't want anyone knowing who is doing the work. The only sign anywhere is "H&W Builders", nothing anywhere about future "Les Schwab", or courtesy of Bend, OR. ...

"Despite almost a decade of spectacular growth in Central Oregon, Todd Taylor has not forgotten the hard times in the late 1970s and early '80s that drove his father's first construction company out of business.
When Taylor's father ran the company in the 1960s and '70s, it laid the groundwork for Sunriver, Black Butte Ranch and the Redmond Airport, Taylor said.
His father, Hap Taylor Jr., could provide lessons for companies looking to survive what is expected to be slower growth than has occurred over the last decade. He started a new construction company in the mid-'80s with a "dump truck and a backhoe," said Taylor, 45. "We're going into one of the most challenging markets in a long time," Taylor said. "We're all faced with the same challenges and the key is to separate yourself from your competition by truly being in touch with the marketplace."
In 1988, Todd Taylor and his brother, Jeff Taylor, became equal partners with their father in Hap Taylor & Sons. The company did many of the same types of projects then that it does today - building roads and placing water and sewer lines for residential, commercial and municipal projects throughout the region. The company also delivers and sells concrete and does paving projects. As Taylor said, the company does "horizontal" work, not buildings.
The company had only about $500,000 in gross sales the first year. It eventually picked up enough construction projects that it sold for approximately $30 million to Knife River Corp., a subsidiary of Bismarck, N.D.-based MDU Resources Group Inc., in July 1998.

Economic Development Director John Russell explained that the CC&R’s are not

The timing and coziness is disturbing.
The Bus Company is using attorney Martin Hansen. Martin successfully represented Broken Top Association in getting both land and roads from the BT developer Joe Weston. Martin successfully represented Bauhoffer in the sale of the BT Club to Brenneke and then the subsequent sale to the club members. I think it will come out the city didn't do its due diligence on the busses and instead under pressure made a rash decision.

There's too much to say, but one great contradiction, is in the Dec 12, 06 minutes the council was adamant against the deal, but seemed to suggest that 'maybe' the deal met the 2004 Juniper Ridge Guidelines.

What Les Schwab has done is taken their 12 acres to date, and carved it down ten feet to level, and then with all the rock built one huge fucking mountain, that is to become the fucking sill-plate for the Borgman Towers. I'm calling the mountain, Mount Borgman, in honor of its founder.
From the top of this mountain, you can see all, I felt like I was on Powell Butte. I can only imagine the views from the Borgman towers.

This new offering is an expansion of the neighborhood's "Custom Choice @ NorthWest Crossing" program, which allows potential buyers to select a homesite and work directly with a NorthWest Crossing approved builder to design and construct the home of their choice.
"When we started Custom Choice, we wanted to offer buyers one more unique alternative for living in NorthWest Crossing," said David Quiros, principal broker for NorthWest Crossing Realty. "Adding new homesites to the program just made good sense and we have already garnered a high amount of interest from the public."
