Becky Breeze Calls The Plaza "UNFORTUNATE"

Welp, it's been another week where it has been proved that the real value of this blog is primarily in user comments. And I woke up to find that The Bulletin has just printed a fairly informative piece, on what at some point, will be acknowledged as The Biggest News Story in Bend History, The Collapse of The Local Real Estate Market. It WILL NOT, in all likelihood be The Biggest in the US -- that'll be saved for some sort of terrorist nightmare -- but nothing will be as big & far reaching as the local collapse in Bend RE. Not even close.

Let's start out with Becky, shall we?

I received an email from one Jakey-O, one proprietor of BendBlogs last Sunday, Nov 4. He said that "Becky Breeze" had been advised by her helper monkey to read the derisive horrors that Jake -- yes Jake -- had been writing about her on BendBlogs. It can be assumed that she clicked on a link, say... I don't know... "RIP Breeze & Wurzels' The Plaza, We hardly knew ye.", and became inflamed.

Becky did what any techno-tard would do, and I include my wife in that group, she sent Jake a bit of rebuttal mail via his blog submission form. Now folks, faking THAT sort of technological retardation is truly reserved for those who have absolutely NO IDEA how email & other rock-bottom internet technologies really work. Again, it's something my own lovely wife would do. Which is actually why my initial reaction was it was "How very sweet"! Really! It's like watching a young infant try to figure out a remote or something. Whenever my wife tries to surf the net, I end up giving her a hug & chuckling -- it's just so damn cute what she thinks is the right way to do things!

So upon receiving Jake's email, I KNEW this email from Becky Breeze was authentic. I knew it. I knew it was authentic for other reasons as well, but the manner in which he received it instantly validated it's authenticity, in my mind. You will also see that this is DIFFERENT from the comments left over on BendBB by "Becky". Without further ado, here it is (some formatting is mine, as her message was in plain text):

First of all I have been selling to the most poor and the most rich and mostly to everyone in between in Salem and Bend for 28 years. I have sold real estate with pride and with integrity and no one that can say anything different. My client base is loyal and appreciative of my experience and my loyalty to them.

Unfortunately for me and my wonderful husband in our ever
changing market, we followed the request from a wide base of clients that said they needed one level condominiums that was not a retirement center. A place to enjoy and be secure but not be restricted to age in case their children or grandchildren want to stay. They did not want to rent a room from the retirement centers Bend developers were building and have to pay the $3000 to 5000 a month fee for a rental.

I kept thinking that would be a
good idea but did not have the time. My husband retired from his real job and asked me what I wanted to do with the almost acre lot we owned. Of course I told him what my client base had been saying. This was 04. I had so many requests for one easy living one level condos from clients I told him that seemed what we needed to do.

We are environmentalists so we made sure
we had the largest green roof this side of the cascades, all the clean water from the building goes through underground pipes to the river, all outside surfaces are no up-keep (cement,brick)so there will not be off gasses and maintenance. 33,000 sq ft of undergound parking so we do not impact the Old Mill as every else has.

I can go on but I will not. But call and I will fill
you in. It is better for 42 families to be able to walk and bike to their businesses and recreation then it is for them to drive from the out lining neighborhoods. I do not know why you are picking on me and our project. I will be happy to walk you through personally or my crew is on duty daily from 12 to 5. Come by and have coffee. I am a nice person and I am sure you are too.

As I have said 100X, Becky really is a nice gal. And I'll say it again, Becky Breeze is a sweet, well-meaning gal. OK?

But there are a few bothersome little details here that throw a chink in that sweet little armor. First, the idea that Becky asked OR received client recommendations about a "one level condominiums that was not a retirement center", is patently absurd. Those words have never been uttered before in World history.

OK, did not happen. Condo's are built for ONE REASON, and one reason only: So OLD PEOPLE can be entombed and get used to CASKET LIVING as soon as possible. What Becky REALLY should have spent money on is some sort of rocket-propelled modular stacked dumpster that shot condo-dumpster units directly into the Deschutes River when geezers die, ala Spock in "Start Trek: The Motion Picture". I'm sorry Becky, but self-serving tripe Bullshit like that will get you mowed down here. Cut the bullshit.

Becky is also invoking The Whole "I'm Green, Lookie At Me!" Enviro-Nazi, Cloaked Corporate Greed bullshit marketing angle, which will actually be revealed for what it is: Plain old cost cutting.

Q: "Was cement used because it's cheap, abundant, and has been used for 50,000 years as a building material?"

Mark my words: We'll all look back on this GREEN thing as some demented period where Corporate Overlords bent Enviro-Nazi's over a barrel & let 'em have it right up their bran-laden corn chutes. It's already so OVERUSED that it's meaning has been diluted to nil. All I know, is when someone tells me they're GREEN, they are REALLY charging me 50-100% more than the market will bear for the same old shit.

Green Marketer: "Did you know these coffee beans were picked by SUSTAINABLE MEXICANS in the Guatemalan Rain Forests of China?"

Paul-doh!: "Bitch, you been pitching that Juan Valdez bullshit for 20 years! Sorry, but when I hear someones GREEN, I about drop a load in my pants. You ain't GREEN Becky, you're like the rest: you're cheap as shit, and have found the Holy Grail of actually CHARGING MORE for BUTT BANGING your customers for cheap crap.

Now, long about last Monday, Becky figured out BLOGGING, to the extent that is possible, and dropped a note on BendBB's door. I never saw the original, as it was deleted. Duncan asked:

"Did you guys remove that last message or did the writer? Just curious."

Then a "Guest":

"Thats interesting, I read the entire letter. is this more censorship? or just that Becky decided to remove it? "

Then rdc chimed in:

Finally, at 8:03PM the Unwaveringly Correct Voice of Reason, BendBB, imparted from High On Mount Sinai, a message he brought down burned into 2 rock tablets:

The imputence! That "Becky Breeze" character was soon going to be shown what it's like to tangle with The Unshakable Resolution Of BendBB, a man who has NEVER in history been proven even REMOTELY INCORRECT. EVER. But still, the UNBELIEVERS CONTINUED. Another CONTEMPTUOUS "Guest":

Here we see Timmy asking a judge to pull his finger, or telling BendBB he's wrong. He was promptly executed for both.

Such an admission MIGHT possibly be construed as an ADMISSION OF ERROR, which we all know is in the same league of human abominations such as "Jews should not be thrown in EZ Bake Ovens", and "Rwanadan Genocide Isn't Good For The Victims".

"John Thomas"? That there is legit, cuz BendBB hasn't heard of him. "Bruce Abernathy"? Well, that is the mayors name, but also probably the name of other dudes, so we will have to wait until BendBB comes down with more engraved rock tablets to figure out how REAL that name is. People, you need to realize that when you type keys on a keyboard that you are commiting your very soul to a mySQL database, and there is no turning back at that point. OK, now on to Juniper Ridge, the fuckin story of monumental Bend City Councilor INCOMPETENCE that just won't DIE! "bruce", a former Unitarian Polygamist from Sandy, UT apparently poked his arm up the public records rectum of this one-horse shithole, and pulled out the Purchase Agreement for Les Schwabs "Gone In 60 Seconds" negotiation of buying a little hunk of JR back when we were all suckling at Mommies teet. He said:

I saw in a recent Bulletin piece that a "Worst Case Scenario" was that the initial build out to make LS feel comfy cozy in JR was $12,600,000. Garzini added as an aside that this figure included a $2.5MM payout directly to Kmart for Holz-tek's light blue polyester leisure suit account.

So, doing a quick calculation yields a KICK ASS -76% return on our first Juniper Ridge deal! YEAH! We're on our way! At this rate, we should be bankrupt by Christmas. Good job Bend City Councilors! They clearly perceived that when LES SCHWAB Legal ROBOBOTS walked in and DEMANDED that they be sold Juniper Ridge land, the property of the City, that they as City representatives HAD NO CHOICE but to sell for 1/4th the cost of simply providing infrastructure (like a fuckin driveway), and that essentially counts the land as free.

But even better, is that "bruce" found this little nugg:

'LS is also protected against "...any additional restrictive covenents or master plan requirements other than those...approved by the Buyer...The master planning...for the balance of Juniper Ridge shall include provisions to protect the investment being made by Buyer and the value of the Property from being diminished by incompatible uses on other parts of Juniper Ridge."'

Nice! Luckily the City has wrested away control of Juniper Ridge from that horrible Holzman/Kuratek gangbang squad, and put it where it properly belonged, with Les Schwab. I'm sure City Council quickly found a $500/hr consultant who could use a slide rule & protractor to make the following calculations:

“Protect the view from the Property of the Cascade Mountains by limiting the height of buildings abutting Cooley Road west of 18 th Street to a maximum of 45 feet.” “Allow Buyer the right to approve any use or alteration of the land located south of the Property between Cooley Road and the south property line of Juniper Ridge, such approval not to be unreasonably withheld.”

Right. Good. Les Schwab, who lives on in Dick Borgman who swallowed his ashes, has decided that the coming Wal-Mart International Space Station at Cooley & 97 cannot be over 45ft tall. I can only agree with BendBuster that Wal-Mart might be slightly pissed that They Didn't Think Of Strongarming Bend City Council first. Look what Les Schwab got out of it. 100% control of Juniper Ridge in perpetuity.

This just goes to show that if you want to Get 'Er Done in Bend Oregon that you need to understand what Holzman, Kuratek, and Dick Borgman knew long ago: If you walk in a City Council meeting with a Take No Prisoners attitude, you can pretty much steal any fucking thing you want from this town. "Proper Channels"? "Paperwork"? That shit is for LOSERS! In Bend, we don't roll like that. The trusty graft-ridden Old Boy Network. That GUARANTEES the job will get done right on time & ON BUDGET the first time. Like them fuckin CRIPPLE RAMPS that came in at a mere 2,000% over budget, and were STILL BUILT WRONG.

My God. The INANE incompetence and graft that IMBUE every motherfuckin cubic centimeter of this town is truly mind boggling. As I said a long time ago, BendBuster is one crazy fuckin raving lunatic. But in this place, that's exactly what MAKES SENSE. The fuckin craziest shit ever conceived doesn't quite characterize Bend, because we do shit WEIRDER THAN THAT.

I get a little chuckle that my own overwhelming pessimism about Bend was actually understated because it was built on the faulty assumptions that we have "nominal" leadership at the top. So DEAD WRONG. Now that resources are drying up, the Old Boy Network backbone is starting to cannibalize itself. Graft, the fundamental method of Bend power structures, is falling apart because MONEY is going bye-bye.

So Fair Warning: If you want an accurate picture of the future, read BendBusters crazy-ass clapboard. The bastard is getting it right... and he's WAY more pessimistic than anyone.

Now I want to finish up with todays Bulletin piece, on what I humbly call The Most Important News Story In Bend History, The COLLAPSE Of The LOCAL Real Estate Market. In "How builders plan to face housing slide", inscrutable super-reporter David Fisher described Brooks Resources recent "auction" of 3 RiverWild condos thusly:

"It was a bit of a bust. Only one of the three sold, and at the minimum bid — more than $200,000 below list price.

The other two attracted not a single offer."

Les Schwab is obligated to pay Up to $525,000 in SDCs for Juniper Ridge. Thus in reality they only have to pay 1% of the actual SDC cost to develop Juniper Ridge. ( Note $60M is the cost of infrastructure the city will pay to support Les Schwab alone )

Bend is corporate welfare, the actual SDC cost for a new home is $60k, the city charges developers $12k, or 20%, but 1% on Les Schwab is the best subsidy yet! Les Schwab is the epitome of Corporate Welfare at tax payer expense in Bend.

Did you carefully read the NDA section 9.7.1, and 9.7.2 of your LS sale agreement??

Very interesting 9.7.1 is the terms, it basically the 'agreement' is secret, and its existance must be denied, that if it goes public the city must pay for lawyers, that if someone sues for its real it is to be construed as mortage-appraisal document, there-by exempt from open-meeting laws!!

9.7.2 is public communications, is says that ALL Juniper-Ridge comm must be staged at key dates provided by LS, that all comm must be pre-approved. That all public comm MUST be joint ... Some real cool stuff, that explains the complete fucking silence on this whole fucking issue.

Note also that the city has $35k earnest, but for some reason the city bails, they MUST pay LS $100k severance. On this they should have gotten Kurateks lawyer.

Section 4.5 says that the property MUST be 'shovel ready' by Dec 31, 2007. It defines 'shovel ready' as meaning that LS only has to place the building, pave the lot, and landscape.

This obviously means that the city is paying for Mount Borgman, where is the document and design plans for all this excavation???

It's clear that the pretty picture see at bendbubble.blogspot.com of what the LS campus is supposed to look like, is not what its actually going to look like, there must be an ACTUAL plan somewhere.

It would be interesting to find the document that clearly specifies exactly what the city is doing to make the property 'shovel ready', we know its only costing $525k.

What the city provides and pays for includes EVERYTHING except the building, parking-lot, and excavation.

I have seen no doc's that specified the 20 acres be cleared to minus ten feet below datum, and that all materials be used to construct a large mountain in order to place the building.

We're missing lots of documents.

Again read sec 9.7.1 carefully, it says that the city must make it very difficult to get documents, and that if someone files a public-disclosure, they are too be told that ALL documents are appraisal-doc's, and therefore exempt from public access.

[ Well there it is they scrapped the WHOLE 20 acres down 17 feet, to build MT-BORGMAN 180,000 cu-ft of historic geologic rock formations. ]


The emphasis in week 3 will be to complete the north parking structure all the way to paving. This would allow for a staging area for other subs and maintain a clean looking job site as well as offer parking for employees and other subs.The building pad which consists of two buildings roughly covers 1 acre of the jobsite. Building A had a large cut, about 17 vertical feet to subgrade. Building B had about 4 feet of vertical cut. Both of these building pads have been excavated with the rock going thru the track mounted crusher and producing aggregate base rock.“The rock on the jobsite has stayed on the jobsite substantially reducing costs of trucking material in and out. It has also allowed us to quickly change directions if we encounter any problems.” said General Manager Fred Nicoll of Latham Excavation. The crew will then move toward the east of the project to begin sub grade work.

Yeah, that kind of blew me away, considering that sales of public land has to be public by law. Trying to make a Sales and Purchase Agreement into a land appraisal through cute language is rather problematic.

Which perhaps is why Borgman quietly signed the Waiver on Dec. 14th.

BTW--I am revisiting this whole Executive Session issue right now, in my latest Open Records Request. Patty Stell, the City Recorder, left me a message that "they don't give out Executive Session minutes". ORS 192.650 states, in part, "(1) The governing body of a public body shall provide for the sound, video, or digital recording or the taking of written minutes of all of its meetings...All minutes or recordings shall be available to the public within a reasonable time after the meeting...
(2) Minutes of executive sessions shall be kept in accordance with subsection (1) of this section...If the disclosure of certain material is inconsistent with the purpose for which a meeting under 192.660 is authorized to be held, that material may be excluded from disclosure."

That "disclosure...is inconsistentwith the purpose for which a meeting...was authorized" is the key line. For instance, an Executive Session was called during the Dec. 12, 2006 Special Meeting thusly" "Mayor Friedman called a recess to Executive Session at 9:00 A.M. pursuant to ORS 192.660(2)(e)."

ORS 192.660(2)(e) reads "To conduct deliberations with persons designated by the governing body to negotiate real property transactions."

I've seen various reasons for calling Executive Session, including the one at the end of the last City Council meeting, where it is usually called under a proclamation such as "Executive Session pursuant to ORS 192.660 (2) (d through h)". You can see this in the packets for the meetings, between the work session and the regular meeting.

ORS 192.660 (d through h) reads:
(d) To conduct deliberations with persons designated by the governing body to carry on labor negotiations.

(e) To conduct deliberations with persons designated by the governing body to negotiate real property transactions.

(f) To consider information or records that are exempt by law from public inspection.

(g) To consider preliminary negotiations involving matters of trade or commerce in which the governing body is in competition with governing bodies in other states or nations.

(h) To consult with counsel concerning the legal rights and duties of a public body with regard to current litigation or litigation likely to be filed."

Interestingly, ORS 192.660(8) states: "A governing body may not use an executive session for purposes of...conduct[ing] a general evaluation of an agency goal, objective, or operation or any directive to personnel concerning agency goals, objectives, operations or programs."

ORS 192.680 goes into the enforcement of these laws. 192.680(5) puts a 60 day limit on filing suit to void a decision made in violation of ORS 192.610-192.690. The Special Meeting of Dec. 12, 2006, without the required 24 hours notice, seems to be an obvious example of such.

Under 192.885,complaints can also be made to the Oregon Governemnt Standards and Practices Commission.

Nothing in my reading of the relevant statutes allows the City to keep all Executive Session recordings or minutes secret. I have the feeling this will become an issue in the near future. Lots of gray area in the statutes.

Latham ( HSW ) claims that to date they have created 180,000 cu-yds of fill ( 3/4 minus gravel ), however that's just for the 20 acres so it can be paved.

Mt. Borgman is mostly 6" or larger rock, I calculated using the Latham footing projections it is about the same, 20,000 cu-yds.

Note that a dump-truck is ten yards, and that is about $150 in real cost in Bend to create the stuff, so that's what its worth in real cost. I figure about 5,000 dump trucks of rock have been created and or used to date, which would be about $750K just for moving rock around.

Note that Les Schwab is ONLY paying for Building, Paving, and Landscaping, any cost they incur is to be paid in ten days, this in the agreement. I think the $12M to date, is just the beginning of the bills I can easily see another couple million coming in from Latham, bille by Les Schwab.

Note the entire premise here is that ALL these expenses on the behalf of Les Schwab will be paid by future land sales. That said, the current liability's already have exceeded the total worth of Juniper-Ridge.

Les Schwab headquarters moving to Juniper Ridge

In a contentious decision, the Bend City Council agreed Tuesday to a deal that would move the corporate headquarters of Les Schwab Tire Centers to Juniper Ridge. The City Council agreed to sell 12 acres of land at Juniper Ridge at a discounted price to the company, whose corporate office is based in Prineville with about 320 employees. In return, the company would be the first tenant to move into the 1,500-acre Juniper Ridge, which the city hopes will spark interest from other businesses. City councilors someday want a university, research and development park, housing and light industrial uses at Juniper Ridge. After an hourlong executive session Tuesday morning, the City Council adopted the agreement in a 4-3 vote. Mayor Bill Friedman and councilors Bruce Abernethy, Dave Malkin and Chris Telfer voted for the agreement.


Councilors Jim Clinton, John Hummel and Linda Johnson voted against it. Councilors and city staff supporting the agreement said the deal was an opportunity to keep roughly 350 jobs in Central Oregon, noting Les Schwab was looking to move out of the region to Sacramento, Calif., Reno, Nev., or the Portland and Vancouver, Wash., area. “Les Schwab will be an incredibly good business to start off our operations at Juniper Ridge by bringing in 350 jobs to Bend,” Councilor Dave Malkin said. “They are one of the leading employers in Central Oregon and one of the strongest national businessesin the West. I am just pleased to get them and to retain them here in Central Oregon.” Several councilors said they were told there was little room for negotiations with Les Schwab and the deal was “all or nothing.” Some councilors raised objections to the lack of time they had to make the decision, Les Schwab’s demand for secrecy after the details of the agreement were reached, the effect the company’s plans would have on the vision of Juniper Ridge and how the deal would affect the city of Bend’s relationship with Crook County and Prineville. “To me the contract is remarkably bad, unacceptably bad,” Councilor Jim Clinton told the City Council on Tuesday morning. The agreement At the crux of the agreement, the city agreed to sell a 12-acre parcel just northeast of Cooley Road and 18th Street. Les Schwab also has the option to purchase another 8 acres in the next 12 years.The company plans to build a 120,000-square-foot office building for the 350 employees it expects to hold. The city agreed to either sell the land for $6 a square foot and cap the amount of system development charge fees Les Schwab would pay at $525,000, or charge $7 a square foot and have the city cover the system development charge fees. City Economic Development Director John Russell said the price of industrial land in Bend runs around $10 to $15 a square foot. The city has until March 31 to decide how it wants to sell the land. If the city decides to sell the land for $6 a square foot, it would get $3.1 million. The city has yet to calculate how much extra money a 120,000-square-foot office building would bring in property taxes. Russell said it would be significant, but noted the taxes from Les Schwab would go to the urban renewal agency, which has formed a district around Juniper Ridge as a way to generate money for the infrastructure the city has to build there. This summer Les Schwab plans to start construction on the site and the city plans to begin working on building roads, and water and sewer lines into the undeveloped land, city officials said. In a prepared statement, the company noted it anticipates the headquarters to be completed by the fall of 2008. “This concludes a long process that I have been working on for the last year. We wanted to remain in Oregon but also looked at areas beyond the state,” Les Schwab Chairman Phil Wick said in the prepared statement.

“The Bend headquarters location provides the land and infrastructure needed to
support our business and reinforces our commitment to the Central Oregon region that has supported us.” Les Schwab spokeswoman Jodie Hueske said the company would not comment on its decision beyond the information provided in the press release.

Negotiations begin In May, the executive director of Economic Development for Central Oregon, Roger Lee, approached Russell and City Manager Andy Anderson about a company potentially looking to move to Juniper Ridge, Russell said. Later in the summer, the two learned the company was Les Schwab. “We didn’t go to recruit them. The company approached us,” Russell said. This fall, city councilors were told a company was interested in moving its headquarters to Juniper Ridge and that it was asking for some concessions as an incentive to come there. However, councilors said they did not receive the details of the agreement or the name of the company until early last week. On Tuesday, city councilors met for the first time with city staff to discuss the agreement in executive session, Councilor John Hummel said.The council had little time — less than 25 minutes — to delve into the meat of the agreement, before Les Schwab representatives said they needed an answer, Hummel said. “John Russell came into the room five minutes to 10 and said he just spoke to Les Schwabrepresentatives and he said if we didn’t make a decision by 10 o’clock the deal was off,” Hummel said. The City Council knew a decision was expected Tuesday, Hummel said, but he believed the councilors would have three or four hours to discuss it. “I think 25 minutes wasn’t enough,” Hummel said. The city’s decision to accept the agreement coincided with a corporate meeting Les Schwab held Tuesday where the company planned to make the announcement in Prineville, Russell said. Councilors weigh in In a public meeting directly after the City Council’s executive session, Mayor Bill Friedman cast the deciding vote. After listening to the comments, Friedman said he heard both affection for Les Schwab and excitement that the company wants to come to Bend. But he also heard worries about the secrecy of the negotiations, which conflicted with the image many held of the company. “I’ll vote yes, in hopes that the real Les Schwab emerges,” Friedman said. His fellow councilors had concerns that the company was placing far too many restrictions on what the council could discuss about the agreement, some of which might be against state public records law.

“However, there comes a time where a line is crossed and after that line is crossed, the public has a right to know what kind of contracts the city is entering into with their money and assets at stake,” he said.Clinton, along with Hummel, said he also was worried that nothing in the agreement mentioned Les Schwab’s commitment to follow the city’s vision for Juniper Ridge.

The city has consistently said that it does not want Juniper Ridge to be a traditional office park with isolated buildings surrounded by a sea of parking lots. Instead, the city wants Juniper Ridge to have more buildings on less land with businesses close to housing and retail shops, so people can walk to work and the stores. Clinton said Les Schwab’s proposal to put a 120,000-square-foot building on 12 acres “scares” him. “It looks like we are embracing a model that is different than what the city’s vision for Juniper Ridge is,” Clinton said.

Russell said Les Schwab’s interest in Juniper Ridge shows its commitment to the city’s vision.“I think the choice of Juniper Ridge speaks highly of their vision,” Russell said. “If they didn’t want to be there, they wouldn’t have approached us.” Hummel and Clinton also are concerned about a section of the agreement that would exempt Les Schwab from following the building design standards established for the rest of Juniper Ridge. The city is still working on those standards, which should be finished by May.

The master developer the city picked to help build Juniper Ridge, Ray Kuratek, said Les Schwab is a fine company for the project, but was disappointed that it was not a company from outside Central Oregon that would bring in new high-paying jobs. “Not to knock on Les Schwab, but it is not as exciting as I hoped it might be with a company coming out of the area,” he said. Kuratek said he found out about the headquarters move late Tuesday morning and was not involved in any of the city’s negotiations.

Not everyone in the community was disappointed. Bend Chamber of Commerce Executive Director and President Mike Schmidt said Les Schwab is a great fit for the kind of companies Juniper Ridge should attract. “This is a good first move, and we’re tickled pink,” Schmidt said. “We welcome Schwab and their people.” In a memo to the City Council, staff noted that about 60 percent of the jobs relocating from Prineville would be salaried positions. The average salary is around $73,100. For those employees who work for hourly wages, their average annual compensation is $26,800. Despite their concerns over the agreement, Hummel and Clinton said Les Schwab is the kind of company they want to see at Juniper Ridge.


“From everything we have heard in the past, Les Schwab is a model company,” Clinton said. “A company that any city would be proud to have. But the way this has come together, it has put some very serious question marks in my mind — and they are shared by a number of councilors — that are at odds with everything we know about Les Schwab.”

This is what is so weird here Capell is working with Anderson and EDCO on Les-Schwab, and Clinton is working with Kuratek, you would think that spending money here was like the US government, folks that work in the same building had no fucking the guy in the next room, was selling the same thing you were selling to someone else.

It was all like a fucking game, to see who could sell Les Schwab the quickest.

EDCO hated Kuratek from day-one, like always which is the history of Bend, like BECKY-BREEZE said the other day, "got a problem"? Bring in Les Schwab the richest man in Oregon.

Trouble was for EDCO to induce Schwab, they had to give away the fucking store.

That is the BULL article from Dec. 13. They got most of the details right, price per acre, SDC's, etc.

The minutes I'm going after right now are much more recent, from the last Exec Session, Nov. 4, '07. Along with the actual CCR's. I'm expecting to get a written denial for the minutes, which I'll have to follow up on.

On LS plans, I found a recent rock crushing app, which has obviously been granted, and also found a reference to a presubmittal checklist application on May 23, 2007, Project #302. Handled by "HKE".

I think that's the one we need. Unfortunately, there doesn't seem to be any way to look at a specific plan unless it is your plan and you have a PIN. That might be something a future council could fix.

I'm not an attorney, but have dealt with legal stuff quite a bit, repping myself. So far, never lost, but those were patent cases. In the closest thing to this, we never had to go to court but ended up getting 3 of 5 condo board members voted out overwhelmingly. Spend enough time in law libraries and you can figure it out. My current quest is unearthing some precedents regarding executive session minutes.

The hardest thing for non-lawyers to get right is the minutae(sp?) of process.

But who knows whose pockets some judges are in ;)

Thus you need to be there, and then sit through all the shit, and when they declare executive session refuse to leave, I did this 100's of times when I was younger 90% of the time, they'll just give up, and declare end fo meeting.

The reason things have been working to date in Bend is that nobody attends the meetings, and those that do, don't fight the 'exec sess', because everyone is there to beg their cause, and those that have $$$ in the game get shit if they piss off the judges and jury running city hall, a man at a meeting who is not their to fill his pig trough, they simply don't understand, if you know the law, and can recite a name of a law firm, like the firm that just won the BT case, its like a magic verse, these pig-shit-dog-fucking-eater's that run city hall fear the lawyers that WIN,...

The first step is to be at these meetings, like you said, sometimes if you can make up your own press pass that works, but the first step is to be there at all meetings, ...

The problem right now in Bend is that the last 3-5 years the system is broken, and they're used to leading the public around by the noose, because all those that attend are kissing ASS so they're property gets zoned the magic label.

Bend is a joke, its been so many years since the city-hall has had a loyal opposition, that they simply would stop dead in their tracks if someone at a meeting forced them to follow state law.

Scott Cooper the KING PIG judge of Crook County, is also the real estate board member of central Oregon and king pig pen of EDCO. He is also the executor of the Les Schwab estate, and a favorite boy of Governor KissHAbber.

A local expert on Exec Session meeting allowances and non-exemptions is Mike Morgan in Sisters.

He sued the Sisters School Dist and got them to now record in audio tape their Exec Sessions. He also won his legal fees.

It sounds like the Bend City council is also using the exemptions fast and loose. City councils and school boards follow their legal advice, which generally means they always try and do things in Exec session. It is really amazing that the Bend City Council and Les Schwab got putting their deception in writing. "Yeah, lets call it a lease appraisal negotiation, so we can keep it secret". Disgusting.
