The meteoric rise and fall of Deschutes County’s unemployment rate has garnered national headlines as a prototypical boom and bust story, but what lies behind the county’s unemployment rate increase of 12 percentage points from May 2007 to May 2009?

Where have all the jobs gone? And how will the region look when it recovers?

Many companies reported difficulties finding employees in May 2007, when Deschutes County’s seasonally adjusted unemployment rate was 4.7 percent.

Now, with an unemployment rate of 16.7 percent reported last week in the county and rates of 16.4 percent in Jefferson County and 20.9 percent in Crook County, employers report an abundance of labor with companies slashing wages and jobs, unemployment rates at all-time highs and job-seekers going to great lengths to find work.

Experts who study the region’s labor trends agree that the region’s housing market and construction activity became overheated during the boom years between 2004 and 2006.

“I don’t know what we’re shifting to, but when you look at that loss in (mining, logging and construction) jobs in just the last two years, it is safe to say the development-based economy has slowed,” said Carolyn Eagan, the region’s economist for the Oregon Employment Department.

“The county and city of Bend (have) had to cut staff, engineering firms are operating on bare-bones staff and many Realtors are not renewing their licenses,” Eagan said. “I don’t know what we’re shifting to. I don’t think we’ll know until it’s happened.”

The collapse of the housing industry has resulted in a net loss of 3,050 jobs in the county’s mining, logging and construction sector from May 2007 to May 2009, a 36.2 percent drop, according to the Oregon Employment Department. Most of that sector is construction, according to the department.

The county has 4,860 fewer jobs overall than it did in May 2007, the department said.

Other sectors where job losses were reported included manufacturing; professional and business services; and trade, transportation and utilities. They lost 910 jobs, 530 jobs and 710 jobs over the two-year period, respectively.

Individual industries such as high-tech and biosciences, which are smaller in size, are grouped under larger sectors such as manufacturing or professional services, depending on whether they produce a product or conduct research or provide services, for example, according to the Employment Department.

Professional and business services jobs range from those in law offices and architectural firms to employment and janitorial services. The trade, transportation and utilities sector includes retail and wholesale businesses, as well as private utility companies and private transportation companies.

Educational and health services jobs were up by 400, and leisure and hospitality jobs by 240, from May 2007 to May 2009, according to the data.

Those sectors demonstrated growth, but at a milder pace than during the boom years, the department said.

Over the same two-year period, there were 360 government jobs added in Deschutes County.

In May 2007, there were 67,120 jobs, 8.7 percent more than May 2009, according to a report last week from the Employment Department. The county peaked in total employment with 73,510 jobs in June 2007.

Job losses alone do not explain the state and county’s record-high unemployment totals, Eagan said.

The civilian labor force — which includes anyone 16 and older who either has a job or is looking for work — has been growing in the county and statewide despite fewer jobs available, according to the Employment Department.

More people are postponing retirement and staying in the work force, and second-wage income earners such as spouses who previously didn’t work and retirees are re-entering the work force. Additionally, more people are continuing their job search longer than they would normally without finding work, Eagan said.

Unemployment trends

Oregon’s 12.4 percent unemployment rate is the second-highest in the nation, behind only Michigan, which had a 14.1 percent seasonally adjusted unemployment rate in May, according to a U.S. Department of Labor report issued June 19.

The Midwestern state, which has been decimated by the loss of auto industry-related jobs, has seen its civilian labor force shrink from 4.97 million in April 2007 to 4.78 million in April 2008, according to the state’s labor Web site.

Meanwhile, Oregon’s civilian labor force grew from 1.91 million to nearly 2 million over the same time period, according to the state’s employment Web site.

The collapse of the housing market — one part of the asset bubble that also included stocks, retirement savings and other investments — also contributed to the rise in the civilian labor force in Oregon and other Western states, said Timothy Duy, adjunct professor of economics at the University of Oregon.

People who were living off their assets, particularly in a resort community like Central Oregon, were forced to go back to work when they saw their houses and other investments lose value last year, said Duy, who follows the region closely and authors the quarterly Central Oregon Business Index.

“As assets became increasingly impaired and foreclosures started rising, the labor force started (increasing) quickly,” Duy said. “That started a process where the unemployment rate started spiking.”

Mounting job losses also contributed to the rising unemployment rate, which spiked nearly 10 percentage points over the past 12 months — from 7 percent to 16.7 percent, Duy said. Both trends, an increasing number of people who had lost equity in their homes and money in investments, and an increasing number of people who lost their jobs, increased the rate of unemployment, he said.

The county is on track this year — with 1,661 notices of default through Wednesday — to easily surpass the record 1,928 notices of default filed in 2008, but notices appear to have peaked in April. A notice of default is the first step in the foreclosure process but doesn’t always result in bank repossession.

While the unemployment rate could still go higher in coming months, the high unemployment numbers are more of a lagging indicator for the region, a fallout from the overheated housing economy, said Roger Lee, executive director of Economic Development for Central Oregon, which promotes development in the region.

“It cannot be overstated that while it is definitely a painful process, there is a purpose to the business cycle,” he said. “We’d like to have it a lot less deep and prolonged, but we’re seeing people get lean and mean.”

Hardest hit

Construction and manufacturing have been hard hit throughout the region, accounting for roughly half the region’s unemployed workers, but several industries, while battered, are still holding their own, Lee said.

Lane Lehrke, 42, who moved to Bend in 2003 with his wife and two children, bought a home and worked for a local builder as a production manager until October, when he was laid off due to lack of work. He had owned his own company in Oregon City before he joined the Bend builder.

But Lehrke has not been able to find work in the construction field, despite sending out résumés to five different Western states and online sites, he said.

“I have put in résumés in lots of places,” Lehrke said. “I have gotten a lot of nonresponses. Very rarely do I get a response.”

Lehrke, while collecting unemployment, still makes $400 monthly payments to pay for the cost of his builder’s license, insurance and bonding, he said.

“I’ve got some opportunities in the fall,” he said, referring to potential jobs in Portland. “A lot of it has to do with stimulus funding.”

What comes out of the current trough in the business cycle will depend upon how much the county diversifies its employment base, said Lee.

Construction was 11.7 percent of the total work force in May 2007, and is 8 percent today, according to the Employment Department. Manufacturing, meanwhile, was 7.7 percent of the work force in May 2007, and is 6.9 percent today.

“This place is not tanking,” Lee said. “There are indicators of economic activity still going on here.”

The economy needs more diversity, but is not on a tipping point like it was in the 1980s, Lee said.

That was when the region’s mills were crippled by changing forest policies and the area began to rebuild its economy, he said.

“There are a lot of examples in the West where the change in forest policy decimated those areas,” he said. “Central Oregon has done a decent job, but we still need to do better in targeting industries that have promise.”

The region needs to target companies in knowledge-based industries such as renewable energy, software and medical device manufacturing, he said. Global competition is fierce in recruiting “green” companies, which provide top wages and heavy capital investment, Lee said.

Central Oregon has been competitive in its recruiting efforts for those types of companies, Lee said, citing more affordable land in the region, a ready work force and quality of life. Lee expects to find companies that are the right size for the region, possibly landing suppliers for Portland’s growing green manufacturing base.

Companies such as Bend-based dog apparel manufacturer Ruff Wear and Warm Springs Composite Products, which both ship products overseas, are faring well. Others that have been hit hard by the national recession, such as Madras-based manufacturer Bright Wood and Contact Industries in Prineville, are retooling and will eventually provide jobs in Jefferson and Crook counties, Lee said.

“With very few exceptions, these are very sophisticated wood products manufacturing companies,” Lee said. “They will be back with those kinds of jobs. Our challenge is to diversify with other types of jobs.”

Right. The first one implies jobs that are gone. The second implies that the jobs are "still there", they are just hanging out somewhere smoking cigg's or something.

Very sleezy writing, and something I guarantee Costa jumped in to change. Sooooo... the first is a more appropriate title, but of course it is the second that was actually used. You can tell, because the writer uses the obviously "correct" title in his second paragraph:

You find, of course, there is no answer to either.

So it is a STATEMENT, not a question. And it appears that the answer is NOWHERE. They're just gone. They aren't hiding somewhere, waiting to be found.

You gotta love these softball pieces, where the reader is treated like they are 5 yrs old.

Where have all the jobs gone? And how will the region look when it recovers?

Here's the real answer: Most of that employment near the peak was FAUX JOBS & FAKE BUSINESSES, 100% fake and unneeded and unsustainable jobs, businesses that never had a chance.

Building houses no one wanted. Mortgage brokers hired, apprasiers for falsified appraisals. And all the "multiplier" jobs: All the jobs & businesses that were spawned from a credit-fabricated bubble, to feed demand that had no basis in reality.

Those jobs are gone. And the "multiplier" jobs; the coffee shack purchases, the Jamba Juices, the oil changes and all the other stuff that "fuels" those faux jobs will soon be gone too.

Remember the local business index that the Bully used to print? Well, one of the most out-of-control pieces of that index was the Help Wanted ad count.

Over the course of just a few years, it went from 1-2,000 to something like 12,000!

THAT was the bubble. Well, at least it showed the jobs bubble that happened here. We should have known FULL WELL something was wrong when we saw that stat.

But we didn't despite have sharp as nails local experts making the following observations:

Funny. In this sentence, it starts out regarding experts studying the "region's labor trends", and ends up with a conclusion about our "overheated" construction market.

And what's great is although we are promised some sort of insight into what the area will morph into, the piece never delivers:

Never "shrunk". Not "lost". No, no. Slowed.

Q: "Dude, are you feeling better after that motorcycle accident where you lost your fucking arms and legs?"

So, needless to say there is a ton of Costa-fueled double-talk in this piece. But there are also outright contradictions of earlier "assertions":

Real Estate Associations Want Appraisers To Inflate Home Prices

The housing is still struggling because appraisers are being too tough assessing the value of homes.

That's the self-serving argument being made by realtors who are complaining that lower appraisal values of homes are delaying deals, ruining sales and prolonging the housing crisis.

Appraisal fraud was an enormous contributor to the unsustainable run up in prices during the boom period. Many (but not all) mortgage brokers and realtors referred buyers to appraisers that ALWAYS hit the number of the home purchase price

Now, NAR and other real estate lobbying groups, who are trying to maintain stay in business despite the total destruction of their market, are mobilizing a major effort to reach out to Congress and housing officials.

As NAR economist Lawrence Yun said earlier this week, "Lenders are using appraisers who may not be familiar with a neighborhood, or who compare traditional homes with distressed and discounted sales." Instead, Yun and his bunch want appraisers who won't be too tough. As Yun puts it, "There is danger of a delayed housing market recovery and a further rise in foreclosures if the appraisal problems are not quickly corrected."

And what about the RIDICULOUSLY LUCRATIVE easy-life of local moving companies? Well, they are finally getting their comeuppance!

Sinking home prices and a weak job market have forced normally restless Americans to stay put in an uncharacteristic shift that has, among other things, clobbered the moving industry.

"When I was a kid my brothers and I made money by doing yardwork for neighbors, babysitting, having kool-aide stands, washing cars. and doing housework for neighbors. Yes, all these monstrous state agencies are supposed to "protect" the consumer but they just create more out-of-control spending government with perks and pers. A claim against a contractor needs to go through a long process and even when the contractor is licensed and bonded, if he (she) files bankruptcy, your claim could be released in the process regardless of their bonding.

Oregon Construction Contractors Board allows the licensed contractor 6 months to pay a judgement or settlement agreement before a bonding company is involved if they fail to pay. Oregon licensed contractors can appeal the decision and again this takes months. Who pays for any necessary immediate repairs?

So, do you think this highly over-regulated state will pay your claim? Nada. Many bonds are for $10K and if you as a homeowner get a judgement over the bonded amount, all you are left with is a piece of paper that you likely will not collect on, over the bonded amount of money.

I tried to find someone to do some weeding for me this summer. Every licensed landscaper, or yard worker wanted from $40-$67 HOURLY. They explained that was because of the high cost of the state requirements for licensing. I did not use them.

Did all the people working at Cessna that are unemployed or soon to be unemployed make that much money? I personally would hire an unlicensed mover, yard worker or babysitter any time I could and use my own resources to determine if I feel they are qualified and honest to complete the job properly.

As for my weeding, I found a very dependable, responsible, hard-working and honest person that quickly completed the work I needed done. I paid him $25 an hour and he was not licensed. I am very pleased with his work and more pleased that he is not licensed.

Harney County losing jobs, hopes

When times were good, logging trucks and recreational vehicles burned rubber down the pavement. When times are bad, as in the past year, the roads are starved of vehicles. Shuttered businesses sit on their shoulders. There no new jobs in sight.

Soon the empty roads around Harney County could be the way out for people with no job prospects and no more unemployment checks on the way.

As the recession wears on, an uncharted phase of the downturn is setting in not only in Harney County but also across the state: Workers, jobless for longer than a year, are beginning to exhaust their unemployment benefits.

Harney County wasn't always economically depressed. In the early 1970s, the county had among the highest incomes in the state, above the national average, with timber fallers and others raking in the dough, an era some residents remember.

County officials say they haven't given up hope for a rebound, and instead, are getting creative.

With so many unemployed residents with time on their hands, Grasty has launched a finder's fee for anyone who successfully tips off the county's economic development arm to a business looking to relocate.

The county spends about $80,000 a year on economic development, advertising on local billboards. On its Web site, it claims the county is "rapidly becoming the most attractive place to locate your business in the Pacific Northwest."

The county will pay anyone who gives it a solid lead $1,500 to $5,000, depending on the size of the business. So far, no one has found one that panned out, Grasty says.

"One of these days we'll hit a home run," he says. "We're trying to market to people who can ship high value things via UPS. Something that doesn't need rail cars. If you need natural gas, we can't help you."

Grasty has a vested interest in luring jobs to the community. His own daughter and son-in-law worked at Monaco and now are considering moving.

Young families with children are becoming a rarity in a county with few family-waged jobs. Grasty keeps a database of kids who've graduated from Burns High School. Every now and again, he'll send them a letter, asking when they to return. He has yet to get a response.

"We're not about to quit," Grasty says, " Let's get after what we can. We just have to find it."

New Research on Walking Away


Here is an interesting new paper on homeowners with negative equity walking away: Moral and Social Constraints to Strategic Default on Mortgages by Guiso, Sapienza and Zingales. (ht Bob_in_MA)

The WSJ Real Time Economics has a summary: When Is It Cheaper to Ditch a Home Than Pay?

The researchers found that homeowners start to default once their negative equity passes 10% of the home’s value. After that, they “walk away massively” after decreases of 15%. About 17% of households would default — even if they could pay the mortgage — when the equity shortfall hits 50% of the house’s value, they found.
...
“Our research showed there is a multiplication effect, where the social pressure not to default is weakened when homeowners live in areas of high frequency of foreclosures or know others who defaulted strategically,” Zingales said. “The predisposition to default increases with the number of foreclosures in the same ZIP code.”


Walking away (what the researchers call a "strategic default" and the mortgage industry call a "ruthless default") is when the borrower decides to stop paying a mortgage even though they can still afford the payment. This has always been difficult to quantify. Whenever a lender calls a delinquent homeowner - if they can reach the homeowner - the homeowner always tells the lender some sob story about why they can't pay their mortgage (lost job, medical, rate reset, etc.). As the researchers note:

It is difficult to study the strategic default decision, because it is de facto an unobservable event. While we do observe defaults, we cannot observe whether a default is strategic. Strategic defaulters have all the incentives to disguise themselves as people who cannot afford to pay and so they will appear as non strategic defaulters in all the data.

So the researchers conducted a survey to attempt to quantify the percent of strategic defaults. This has drawbacks - the questions are hypothetical and there are no actual monetary consequences - but the results seem somewhat reasonable.

Note: the researchers use Zillow for negative equity numbers, and I think those are overstated. I prefer the research of Mark Zandi at economy.com or estimates from First American CoreLogic.

I think one of the key points in the research are changing social norms - the more people a homeowner knows that he believes "walked away" the more open the homeowner will be to mailing in their keys. This is what I wrote in 2007:

One of the greatest fears for lenders (and investors in mortgage backed securities) is that it will become socially acceptable for upside down middle class Americans to walk away from their homes.

This research suggests that this is happening in significant numbers.

This has led many people to suggest principle reductions (as opposed to payment modifications) is the only solution. Tom Petruno at the LA Times has more on this: Is it time for underwater homeowners to be given a get-out-of-debt-free card?

Government and private-lender attempts to stem the home foreclosure crisis so far have mostly focused on loan modifications or refinancing -- giving borrowers a temporary or permanent reduction in their monthly payments.

But some housing experts say the next wave of help will have to address the core problem for many homeowners: negative equity.

This camp believes that there is no alternative but outright forgiveness of a substantial chunk of mortgage debt for many people who are underwater in their homes and at risk of foreclosure.


And a final note, the researchers also touch on the recourse vs. non-recourse issue:

While only few states have mandatory non-recourse mortgages (i.e., do not allow creditors to pursue borrowers who walk away from their mortgages for the difference between the amount of the mortgage and the resale value of the house), the cost of legal procedures is sufficiently high that most lenders are unwilling to sue a defaulted borrower unless he has significant wealth besides the home.

And that fits with an email Tanta sent me in 2007 on recourse loans:

Back in my day working for a servicer, we never went after a borrower unless we thought the borrower defrauded us, willfully junked the property, or something like that. If it was just a nasty RE downturn, it rarely even made economic sense to do judicial FCs just to get a judgment the borrower was unlikely to able to pay. You could save so much time and money doing a non-judicial FC (if the state allowed it) that it was worth skipping the deficiency.

They completely ignore the fundamental incentive to just walk away from a financial drain. Loan mods are only accepted by people who are near mental retardation.

PRINCIPAL FORGIVENESS is the only thing that will keep people in homes. I don't like it, it rewards stupidity, but that is the fundamental incentive that will keep people paying.

But banks better be prepared for Phase II (and Phase III) of this procedure in the years to come. Mortgage principal forgiveness is going to be an anchor around banks for decades.

My sister works for one of the smaller cities in Oregon. Her boss cruises streets on the weekends, looking for unlicensed, untaxed businesses. I read this book about 10 years ago and it changed the way I view our country and government. It's actually brilliant how the Rothschild family figured that's much more effective to conquer a nation by taking control of it's monetary system (the federal reserve) than war and enslave the people in debt. NEW YORK (CNNMoney.com) -- Home prices continued to tumble in April, falling 18.1% from a year earlier -- but the month-over-month change in a closely watched real estate gauge narrowed sharply, indicating that housing markets may be starting to turn.

The 20-city slice of the S&P/Case-Shiller Home Price index recorded a drop of 0.6% from March to April, compared with a 2.2% drop in the prior month. The index has declined every month since July 2006. The 10-city index fell 0.7%.

"The pace of decline in residential real estate slowed in April," says David Blitzer, Chairman of the Index Committee at Standard & Poor's. "Thirteen of the 20 metro areas also saw improvement in their annual return compared to that of March."

Not only that but every metro area save one -- Charlotte, N.C. -- reported improvement in their monthly return compared with March.

"While one month's data cannot determine if a turnaround has begun, it seems that some stabilization may be appearing in some of the regions," said Blitzer. "We are entering the seasonally strong period in the housing market, so it will take some time to determine if a recovery is really here."

Blitzer pointed to some factors that may be lifting the housing markets. For one thing, the stock market bottomed out in March and started a strong recovery. The S&P 500 has gained about 37% since then. Consumer confidence has also improved, making house hunters more likely to pull the trigger on deals.

Not all optimistic: The housing market picture is still very murky, according to Pat Newport, a real estate analyst with IHS Global Insight. He's not convinced that the improved April report means much more than a seasonal variation in housing markets. Spring is, historically, a strong time of year for housing markets.

He said that not only are home prices still falling but other metrics, such as unemployment and foreclosure rates, are worsening as well.

"Foreclosures are still driving markets, and the rate of foreclosure is still going up," Newport said. "I think that's going to continue"

Job losses will all but guarantee that will happen, according to Newport, especially since price declines have put so many homeowners underwater, owing more on their mortgages than their homes are worth. By some calculations as many as 20% of homeowners are underwater.

When people are underwater and they're losing their jobs or some of their income, that's bound to result in more foreclosures, more vacant homes for sale and more downward pressure on prices.

Huge declines from peaks: Phoenix, where homes have lost 35.3% of their value over the past 12 months, was the worst performing market over that period. Las Vegas prices plunged 32.2% and San Francisco dropped 28%.

Denver prices fell the least over the last 12 months, down 4.9%, followed by Dallas at 5% and Boston at 7.7%.

Prices in Dallas rose 1.7% between March and April, the largest increase among the 20 cities. Las Vegas prices dropped 3.5%, the biggest decline -- which was still narrower than the month before.

Dallas also has suffered the smallest decline from the top of its market, off just 9.6% from its peak in June 2007. The rest of the cities have all suffered double-digit percentage drops from their peaks, with the worst being Phoenix, down 54.1% from June 2006.

(Antioch, Brentwood, Discovery Bay)
Those prices are off 50-60% from the top of the bubble.

But it remains a desirable area to live for many reasons -- great climate, great universities, urban amenities, jobs and economic opportunity -- and it will rebound. I have been hearing this here for more than two years, in which time we have seen prices drop in that sacred "one mile of Deschutes Brewery."

Take one of the newer examples - 1029 NW Lexington, which is .9 miles from the pub. It's 1160 sq feet and has a studio not included in the sq footage. It can be yours for $149k - but nobody wants to pay that for it.

1240 Milwaukee - 1.0 miles to the pub. A complete shithole, but someone bought it for $260k in July 05. It's on the market now for $160k - and has been for a long time. This thing is going close to $100k, or maybe below.

1677 NW 4th st - .6 miles to the pub. Sold in May 06 for $489k, and in May 09 for $270k. That's a 45% drop and we aren't near bottom yet.

1526 NW 3rd st. Sold in Feb 06 for $420k and currently on the market for $300k. It's not worth $300k. Good luck with that.

The last sale that I can find on coveted Drake Rd was last July, for $468k - $144/sq ft.

Newport moderns? Bad project all around and not worth nearly the $895k they were planning on getting. However, the first sold for $450k a year and a half ago, and they can't get $277k for the last one now. That's a 38% drop off a sale, never mind the original asking price.

Having the area around Drake Park only drop 50% makes it look like a winner when most of town drops 60% and the shit subdivisions drop 75%.

The stuff in the Congress and State St areas? So little is for sale or has sold that we have no idea what that stuff is worth. My guess though - it's not worth what it was. It's also worth more now than what it will be in 18 months.

We still have a long way to go, and the stuff around Drake is still going to lose a lot of value.

The Commission presented its strategic plan to the Council. Eight strategies were developed.

1. Art: Sustain and capitalize on our public art collection
2. Beautification: Collaborate with the community on beautification projects
3. Culture: Develop and enhance citizens’ awareness of cultural diversity and inclusion
4. Contribute to the unique character of our city (Advocate for arts, beautification and culture to increase economic vitality, the ability to
attract tourists and the distinct image of the community
5. Establish a marketing strategy to support our mission
6. Annually recognize individuals, businesses and organizations that foster art, beautification and culture in the community
7. Develop successful partnerships to promote the arts, beautification and culture
8. Provide sustainable fundraising for the commission without impacting the City of Bend’s budget

Matt McCoy, Jim Middleton, Miles Conway, and Deborah McMahon made a presentation on its request for this special planned district.

The zone would be Public Facility with the special planned district over the zone.

Memorandum of Understanding with Deschutes Water Alliance (DWA)

Patrick Griffiths, Mary Meloy, and Steve Johnson presented information on the DWA MOU, a proposed forum to meet regional water management needs through collaboration. Council Capell is the Council’s representative to the Alliance

* Liz O’Connel, a resident on Awbrey Butte, discussed the COCC proposed Special Planned District. Neighbors of the area should be involved in the process.





Diane Ross gave a report from the Southern Crossing Neighborhood Association. Ms. Ross discussed current projects including restoration of a Burlington Northern structure, good Samaritan program, and beautification efforts.

An Ordinance Amending the Bend Urban Area General Plan Chapter 3 to add the Nels and Lillian Andersen House, located at 63160 Nels Andersen Road, as a Historic Structure to the City's Inventory

The Deschutes County Historical Landmarks Commission unanimously approved a motion to recommend the City Council add the Nels and Lillian Andersen House as a historic structure to the City's inventory listed in the Bend Urban Area General Plan. The property owner has requested that the house be added to the Historic Landmark inventory as a historic structure. The farmhouse was built between 1929 and 1931 by Nels and Lillian Andersen. The property served as a dairy farm in the 1920's and continued as such until the Nels Andersen family left Central Oregon in 1945

During the Public Hearing two individuals spoke in support of the ordinance. The first reading of the Ordinance was held. Second reading and adoption of the ordinance will be considered at the next Council meeting.

This proposal from Westside Church would remove park identification and shading from figures in the Northwest Crossing Section of the Development Code.

Council continued the proceeding, at staff’s recommendation, until the August 5, 2009 meeting to allow the parties additional time to negotiate a settlement agreement regarding this text amendment and an associated Site Plan, Conditional Use Permit, Variance approval on the subject property.

Councilor Eager gave an update on local efforts related to unequal and arbitrary enforcement efforts of OLCC regulations which have caused economic impacts to local businesses. A group of local businesses and elected officials will send a letter to the governor raising the issue and asking for equal, fair enforcement of the law.

Receive City Manager's Report

City Manager Eric King asked legal staff to look in to the allegation that noticing requirement for the Development fee amendments were not met and legal counsel determined that notice requirement was met.

As City funding for road maintenance is reduced, service clubs, private individuals, church groups, Neighborhood Associations and others can volunteer to remove roadside litter and provide landscape maintenance under the program.

Our highly touted education system is, in fact, mediocre or worse. Years ago my daughter, a Bend High senior, wasn't considered "college material" by the "guidance" people. Why? When they saw her SAT scores they changed their minds. She went to Reed and graduated summa. (Better than her old man did, I must admit.)

It's not that our schools are "so bad," but that they're not excellent. How many kids from the 2009 graduating classes of Bend's high schools went on to Ivy League or comparable colleges (Stanford, MIT etc.)? How many National Merit Scholars did our high schools produce? I bet you could count them on the fingers of one hand.

In my high school graduating class of about 200 kids we had four who went to Ivy colleges (two Princeton, one Harvard, one Yale) plus one who went to MIT and a girl who went to Vassar. And it was a predominantly working-class school. All six of those kids got full scholarships except one who was the son of a doctor.

[1] Hired by Summit Originally to assist them with their restructuring efforts. Instead, they took privileged information to the Perkins Coie and the Creditors’ Committee, somehow convinced them to push to replace the CRO (who was supposed to be Obsidian’s boss), and got Obsidian’s, Senior Principal, Kevin Padrick the job of bankruptcy Trustee.
[2] Enemy who knowingly took advantage of Summits liquidity issue and turned it upside down to profit from Brian Stevens, Mark Neuman, Tim Larkin, and Lane Lyons and their family friends and business associates.
[3] Enemy’s Legal counsel who smugly lie and spends their time harassing all these folks until they don’t have any money or energy to fight.
[4] Good man who brought 750 K worth of cash into the estate and has only charged 90K. MUCH LARGER RETURN for the exchangers than Padrick’s cost which is almost 1 Million between his company, Obsidian, himself as trustee, and his legal counsel. They have only brought 10 K worth of cash into the estate and have ignored offers that would have brought 900K into the estate.

Pursuant to Code § 330 (Chapter 11 Bankruptcy Law), I have filed an Objection to Obsidian’s, Padrick’s, and Tonkon Torps Fees totaling $922,231.22 (copy attached). I have had to learn how to work within the system to get the truth out. The Court will not pay attention any other say. An unsecured creditor, Mark Knowles, for no benefit filed the objection with me so I could get standing in the courtroom.

I have already explained. I was given a proposition of buying 20 RAI ( 2.4 rai per acre ) on the beach for $1k, so I said DELIVER THE FUCK TRIO ( DEED ), I just got the DEED last week and in THAI the deed clearly said "GOVERNMENT LAND", non-transferrable,...

This was just a clear case of mom's brother trying to get some money by selling what was not his to some farang, regarding the girl, she can't read legal thai, she didn't know what the fucking DEED said she just passed it on, and the other thing the sales-agreement said was $20k USD, not the orginal $1k, ...

But just like BEND, we read the sales agreements and we read the TRIOS's RIGHT-MARGE?

I would have never paid over $1k, even if the land has of been kosher, but this 'government deed' was so bad it said that "All straw-man sales to foreigners of government land are punishable by one year in prison", ... so most likely the real deal here was to get some idiot in a pickle, so he has to pay off some government official $10k USD.

Just my humble opinion, but you guys are ALL morons, and I tried to explain this before. ...

End of story. Cost to me? About $100 USD and three months of pussy.

The principals have wanted to liquidate their personal assets since Day One in an effort to pay you back as soon as possible. The principals were willing to give up all that they had to pay you back. But he did lose the really nice house.

Larkin kept his house, three cars, two ATVs and $90K in cash.

Stevens kept his house, four cars, motor home, and only $6K in cash.

Unwillingly, I have acquired an interest in, and more knowledge on bankruptcy (BK) than I ever wanted to know because Summit Accommodators, Inc. (Summit 1031) filed Chapter 11 bankruptcy in December 2008. I am affected by the results of this action two-fold…
1. I am an investor in 4 of the LLC’s where the principals’ interest has been transferred to the Trustee of the Summit Bankruptcy.
2. I am the daughter of Mark Neuman, one of the principals of Summit 1031. This situation has been challenging, but has brought me much closer to my dad, and I am grateful for that.


I was as surprised as the rest of you when I saw the news of Summit’s closure and short fall on the front page of the Bend Bulletin. I had no idea anything was wrong.

A couple of months prior to this news, I got in an argument with my dad. I had come to him for help with finishing a project I was working on for one of the LLC’s.

Instead of assisting me, I felt he was starting to micromanage a project that was already complete, only needing a signed legal document and a reduced payment to the seller. I thought his impatient “help”, as dad describes it, was inconsiderate and disrespectful. I had spent hours well beyond my regular work hours to get us to this point, and I was not getting the assistance and help I felt I deserved. What I needed was for my partners to do their part in finishing it so I could go home and be a mom to my boys. I missed them.

You see, we purchased a piece of farm land that was in the path of progression based on estimated future value. Big mistake! Now that path of progression had come to a screeching halt. My task was to renegotiate the purchase options with the seller. This is not an easy task, but I was able to arrange an agreement with much better terms than the original. I thought my dad should be proud of me. Now I know he was proud of me, he just has a hard time telling me.

Instead of being able to express my feelings to dad in an adult-like manner, I decided I wasn’t going to talk to him until he apologized! Does anyone else have a story like this?

No apology came and I thought he really didn’t care about me. Then one day, my girlfriend sent me an email asking me if I had seen the newspaper article about Summit. I hadn’t, so I went to the reception area and picked up the Bend Bulletin. Obviously my dad had other pressing matters requiring his attention. Maybe this explained why he wasn’t apologizing or talking to me about our argument.

As the story was unraveling in the news, I grew concerned for his well-being. About a week later, I woke up in the middle of the night feeling a deep pain…it wasn’t my pain. It was my dad’s pain. I started to email him, “Dad, are you OK?”, but I didn’t feel it was appropriate given the circumstances. A phone call would be more so. The next morning, instead of heading to work, I headed toward his house. On my way there, I called him. He sounded horrible.

When I got to his house, I found a man that looked like my dad, but a much paler, weakened version. I sat next to him and hugged him and kissed him and told him that everything will be all right.

There have been many very difficult days. Feelings of failure, hopelessness and powerlessness are almost overwhelming. Facing the harm this problem of liquidity has caused to the exchangers, the community, and to their own families is heartbreaking. It has been the most trying time of our lives, but we are all gaining a better appreciation for family and friends. Now our relationships are what we are living for. As you can see, you can work hard your whole life and have nothing to show for it in the blink of an eye.



The purpose of this website is to shed some light on these events, so that our community can clearly understand what has happened, as well as finding what it can do to address the problems in ways that are more constructive.

I have given a lot of thought to this and have come concluded that the way we as Americans generally view money needs to be modified.

Money is what we need to live in this world, but it is not what we should live for. It is just paper that flows through our hands, then another’s hands, then another’s hands. The money is not ours; it is for us to use as we walk through this life. For the past few years Americans have generally been too focused on money and not focused enough on experiences, family, friends, love, growing, learning….These are the things that can never be taken away from us.

We need to start working with each other and not against each other. Is it not human to make a mistake? What should we do when we make a mistake? We need to try to make up for that mistake in any way we can. We are all imperfect, we all make mistakes, and we all deserve a chance to make up for those mistakes. This is what has been so frustrating for the principals. They want to fix the problem so much! The principals want to see efforts being made to pay back their customers. The only money that has gone to the exchangers is about 20-30% of the cash that is sitting in Summit 1031’s bank account. The rest of the cash, approximately $6 million, is sitting in a bank account and will be used as Kevin Padrick, the bankruptcy trustee, sees fit. In just 5 months, the legal fees charged in the case are up to $1.4 Million. The investment portfolio the principals turned over to the creditors is being significantly depleted by the legal fees, lack of cooperation and communication from attorneys and Obsidian, and the paralyzing “process” of our legal system.
